Guys have their guy friends and there are somethings he will want to do just with his guy friends. Watch sports, drink, hang out, relax. Around his girlfriend he'll pay more attention to her and cant do things around her. I'm pretty sure most girlfriends dont want to sit around and yell at the game or just sit around playing videogames telling dirty jokes and talking about what they did last week. Guys have war stories and stuff they do, "guy stuff" if you will. If you are ok or want to be a part of his "guy stuff" express an intrest in it but remember a man's friends are sacred and there is an unwritten code of men that keep them together. It's not that he doesnt want to spend time with you. If you're his girlfriend, you are for a reason, but grated, boys will be boys and need to hang out with the guys sometimes.

Nope. Tax refunds can only be garnished generally for child support or taxes owed to the IRS or PA DoR.

However, the creditor who holds the judgment can levy (freeze) your bank account if you keep more than $300 in there. They may also go after anything else you own. I don't know your assets and circumstances so I don't know what is at risk or not.

You need to think about how you are going to resolve this debt. It will not go away - judgments last forever. Judgments will be a lien on any real property that you own for 5 years and they can be renewed every 5 years. They are collectible (enforceable) against any personal property that you own for 20 years. They also earn interest at a rate of 6% per year so they will only get bigger.

Depending on your circumstances and the amount of the judgment, you may want to file bankruptcy. I would consider this only if you have over $10,000 in debt and you are going to be needing credit in the future.

If you cannot file bankruptcy for whatever reason, then it may make sense to save up and try to resolve the debt. Most creditors will accept between 50% and 80% to settle any judgments in 1-12 payments, but the exact amount and whether they will let you pay in installments depends on the creditor. Some creditors are nice to work with and some are not.

Yes, but insurance companies normally make checks out to both the client and the attorney to prevent being caught in the middle of the dispute as to attorney fees to be paid. The check probably is made out to both of you. Also, there may be some medical liens that have to be paid out of the settlement so your attorney is not going to be willing to turn the entire check over to you without being sure that the liens and he/she is going to be paid [your giving the attorney at check at the same time you get the insurance check does not guarantee your personal check will not bounce].

My suggestion is that someone will need to file a guardianship. That can be done even when the mother is still alive. It does not matter if the mother signs a letter. The court will only consider that. With the children at their age, the court should assign an attorney to represent the children in the guardianship proceedings. It is hard to say what effect the CPS case will have on you, although it will come up in the 1513(c) report which the court will most likely order. You very much should have an attorney who specializes in family law and who has done many guardianships to help you with your legal issues. Good luck!

Nobody will deal with the sister without the sister's having legal authority, and with the cousin being an adult the relationship is not enough on its own especially when it comes to Medicaid. That program is really just a payer program; it makes NO medical decisions. All it does is decide if a particular health care option is covered, and if so, will pay for it up to various limits similar to any "insurance" program.

The cousin is clearly an adult, and if she is decisional, she is the only person who can make decisions. If the cousin is NOT decisional, it all depends on who her legal guardian is. It could be a public guardian that the hospital got appointed to make decisions, which is most likely the case, or possibly another family member or third party has a health care power of attorney.

The sister should start by contacting the hospital and finding out whether there is a guardian or power of attorney. If the cousin was admitted as decisional but is now NOT decisional, the sister may be able to intercede but there is a court process.

Since you do not yet know what has been filed, it is hard to determine a defense/response to the filing. Parents have to support their children. Any filing for Paternity or Time Sharing (visitation) will also address child support.

The age of the baby, his/her need, the role each parent has played since birth, living condition, background of the parent and a host of factor will determine the time sharing schedule. It is not unusual for the schedule to address differing visitation schedule as the child gets older.

Kung Fu originated in China with some influences from India in the 7th Century AD, and other origins dating back thousands of years in China. From there it traveled to Okinawa and was combined with the local fighting arts known as "te" ("hand"). Centuries later, the Chinese hand fighting had made its way again to Japan, this time directly from the mainland of China to Japan. The people of Japan began to refer to this ancient form of of boxing as "Kara-te" (pronounced "ka-la-tay" not "Kor-ah-tee") meaning "Chinese Hand." One of the Chinese Characters for "Kara" used in Japan meant anything of ancient China, particularly from the Tang Dynasty. In time, the average Japanese person was calling all Martial Art systems in Japan "Kara-te. This bothered some Martial Artists as it gave credit to China for what Japanese Martial Artists had perfected as their own unique systems of fighting. The famed Karate Master, Gichen Funakoshi had brought the predominantly hand fighting system out of Okinawa, and into Japan as Shotokan Karate. Funakoshi suggested that a different Chinese character be written the Japanese art, that was pronounce the same as "Kara," but meant "empty." Thus the term "Karate-do" became applied to Japanese systems as distinguished from the Chinese "Kara-te"

Korean Martial Art techniques and philosophies existed in ancient Korea during the three kingdoms period. While little is known about the actual techniques used, there was hand strikes and grappling in Subak, and a unique tactic of using the legs as a primary weapon in Tae kkyeon (aka: "Tae kyon" - the "Kicking method"). During the Japanese occupation of Korea during World War II, a few Koreans had been introduced at a young age to the kicking of their native Tae kkyeon, then later studied Chinese hand fighting to create a Korean version called Tang Su Do. In Japan, some Koreans were permitted to study Japanese Shotokan Karate under Gichen Funakoshi, and others studied Judo and Aikijutsu and Aikido. The Koreans then developed their own grappling system of Yudo based on Judo, and Hapkido based on Aikijutsu.

A Korean college professor named Won Kuk Lee had become one of the highest graded Black Belt students in Shotokan Karate under Gichen Funakoshi. He combined his knowledge of native Korean Tae kkyeon, Chinese influenced Tang Soo Do, and the Japanese Karate, and in 1944, opened the first official school of Korean Martial Art run by a Korean which he called the Chung Do Kwan. After the liberation of Korea at the end of WWII, several Kwans (schools) of Korean Martial Art opened between 1945 and 1955.

On April 11, 1955, the main Kwan leaders united together, and with the support of the government officials, officially chose the name of "Taekwondo" as a title for both ancient fighting skills and philosophies, and modern developments of unarmed combat. Shortly thereafter, the Korea Taekwondo Association (KTA) was formed, and Taekwondo was named the national Martial Art of Korea. In 1972, the Kukkiwon building (national academy and world headquarters) was build in Seoul, South Korea. In 1973, the World Taekwondo Federation (WTF) was established for the purpose of organizing the sport aspect of Taekwondo tournaments and world championships.

The reason that I ask is that a violation of Penal Code section 12020 prohibits carrying things like billy clubs, blackjacks, saps, and slungshots. A violation of this section would carry a maximum sentence of one (1) year. But if you are being charged with a different section, the punishment could be more or less, depending on what specific section you are charged with.

Generally, it is my understanding that you may file Judgment with the clerk under the settlement and affidavit upon default. Therefore, you would not have to re-start the process.

The Tenant, assuming she or he was not aware of the limited rights of your Aunt, will probably seek to enforce the lease.

Alternative is to sell the property with the Tenant in it or to make a deal with the Tenant to terminate the lease sooner than next year. You indicate there is a legal apartment in the home, which leads me to believe this is a two-family home. It is not uncommon for two-family homes to be sold with one unit leased.

If you do not think you can sell it with the current tenant, then you need to make a deal for them to leave.

You can try to terminate the lease early, but it is likely to be an expensive exercise and there is no guarantee of success.

I'm sorry to hear that you have lost your aunt.

Although it is somewhat murky, the law would seem to indicate that the death of the landlord terminates a tenancy by operation of law. You will want to be very careful how you go about this, and I strongly recommend that you have tenant-landlord counsel in place as well as real estate and probate administration. Before too much can happen, somebody will need to be appointed personal representative of your aunt's estate.

First steps would be to send tenants a letter informing them of the death and letting them know that you would like their cooperation in finding a new place to live. Once you have your ducks in a row, you can go ahead and file for eviction in court. It is possible that, with some incentive and cooperation given on your part, your tenants will agree to move voluntarily.

I normally do not start one of my answers with a question but I am intrigued, why do you believe the fact that the father has not been in the child's life is in anyway relevant whatsoever? Obviously CPS believes placement with the father is better than the situation the child was in. As to 'just going and getting your son back' - of course you can't do that - not legally anyway. Asking a question that silly indicates that you really need the help of an experienced family law attorney who can help you get through the steps necessary to get your son back. If you can not afford an attorney and have to go it alone, please at least follow this bit of advice in dealing with those condescending and sanctimonious jerks from CPS (they may not all be condescending and sanctimonious jerks but every one I have ever met was). Always be butt smochingly nice and polite to them. 95% of you getting your child back is simply if CPS likes you. If you give them slightest reason to not like, say by allowing your emotions to get the best of you and acting inappropriately in front of them, you will most likely never get your child back on your own.

Generally the children of adecedent are not personally liable for any of the medical bills of their deceased parent. There are a few exceptions, such as where an adult child signs a request for care form that includes an agreement to guarantee payment.

The estate of a decedent is vulnerable for a claim by unpaid medical providers. This might decrease the inheritence of adult children. In a way, this is collecting from the adult children. But, that does not occur if there has been no estate opened for the deceased parent.

If he has been discharged by the court i don't think there is any recourse. The court usually sets what is known as an Order to Show Cause hearing if an estate has been open too long, but once its closed, its closed.

Sounds to me like you may be experiencing the wrath of that ever so popular, "lockup" converter. You can have a switch installed so that you can control exactly when that illustrious even transpires. I know. Hold back your excitement level, please. It will be tough to explain, but, basically, the torque converter, which kind of takes the place of the clutch on a stick shift vehicle, when stopping, or getting started out, is designed to slip a little bit. If the engine were connected direct to the trans, and differential, you would not be able to stop, and idle the engine, or, get started out without having the vehicle rolling first. Well, in a effert to save fuel, they made it so that it locks up, direct, anfter a certain speed. Bad idea. There has to be slippage there. Minimal, but, some. No big deal. It is doing what it is assigned to do. It is operating as designed. That doesn't make it right. Just functioning as designed...........chuck

It will depend on the tenancy. Did your folks own it as "joint tenants" or "tenants by the entirety"? Assuming that they did, then the house will, by operation of law, go directly to your Mom. The mortgage thing is another question. An attorney would need to review the signed Note & Mortgage to determine her liability. If she didn't sign the note or mortgage then you may be able to have it discharged without paying anything.

If the deed is into your parents as "tenants by the entirety" or "joint tenants," your mother owns the house as of the date of your father's death. Only if they owned it as "tenants in common" does it matter how your father's estate passes under the MA law of intestacy. It should say on the deed whether they owned as tenants by the entirety, joint tenants, or tenants in common. If you determine that your mother owns the house, the mortgage company should talk to her. Point out to them that the house is hers and tell them that if they want their money, they'd better talk to your mother. Your mother should call the company and ask to speak to a supervisor if they keep giving her the runaround.

If your parents owned the house as tenants in common, it will be somewhat more difficult to straighten things out; if that's the case, please e-mail me directly and I'll suggest how best to proceed. But it's most likely that they owned it as tenants by the entirety, so you shouldn't have much of a problem.

First, you and your siblings can decline any interest in the home so it passes your mother.

Second, you need to look at the deed to the home, if it is in both your mother and father's name as tenants by the entireties, then the home will automatically go to your mother.

If not, then probate needs to be opened,, if it has not been done so far. She can be appointed executor of the estate of your father with the consent of the children. once she is appointed executor she can get a court order making her the person to whom the Mortgage company has to deal. She may need to refinance since she is not a signatory to the note.

Notwithstanding this, she can make principal payments on the Mortgage.

I would suggest she contact an attorney who handles probate matters ASAP.

I strongly suggest that you consult with a probate attorney. There are too many uncertainties in what you stated in order to give a definitive answer.

A few general propositions- normally, husband and wife take as "tenants by the entirety", or "joint tenants by right of survivorship", which means that the surviving spouse receives the house by operation of law upon death of the first spouse. It is more the exception than the rule for husband and wife to take as "tenants in common." So, it is important to know what exact language is on the deed.

Secondly, if life insurance is payable to a surviving spouse, and in the absence of a taxable estate (more than $1,000,000 without reduction for mortgages, etcetera), things would be fairly straightforward, and an attorney could, in short order, assist in completing the necessary steps without significant costs.

If the estate is taxable (actually, not exactly taxable, but requiring the filing of an estate tax return, even if no tax is due), it would be more complicated, but even more important to consult with an attorney.

The description of the refinance also raises certain questions, including why, if the property were held as a tenancy by the entirety, your mother was not involved.

As far as "disclaiming," as another response suggested, that may not be an option as it is "normally" limited to nine months after the date of death, and if any of the adult children who would disclaim have their own children, their share would not pass to the mother-grandmother, but rather to the grandchildren of that child.

Finally, there may be some estate planning issues that your mother should be considering as she decides what to do. Paying off the mortgage would not be complicated, but it might not be the best thing to do under the circumstances, especially if your mother may need the cash in the near future. You are strongly advised to speak with an attorney.

I have an estate question regarding the obligation to pay bills left by the deceased love one:

Here's the situation: My mother was the chosen executor of my great grandmother's estate, for which she established a separate estate bank account once she sold my great grandmother's house. According to my great grandmother's will, my mother (the executor) was instructed to disburse equal shares of the money left in the estate account to the heirs after all my great grandmother's expenses/bills were paid off.

However, my mother just recently passed in July of this year before she could finish carrying out the disbursements to the heirs. My mother was very sick for a long time and may have accumulated a few unpaid medical bills of her own. She did not have a will in place before she died. Her only estate was her personal belongings, which have already been claimed by immediate family members, an old car she owned, and an open (but now frozen) checking account with less than $2,000 in it.

I need to know,

(1) If I go to court and fill out forms to become an administrator over my mom's affairs, do I have to open an "estate" in my mom's name in order to close my mom's bank account and get the money out to split with my sister, or could I do that without officially opening up an estate in my mom's name?

(2) If I can close her account without opening up an estate in her name, could my sister and/or I still be held personally liable for not paying off my mom's left over medical bills first with that money before closing the checking account and claiming that money for ourselves?

(3) Finally, If I am awarded by the court full legal administrator rights over my deceased mom's affairs, would I have a fiduciary responsibility to pay off my mom's bills with my great grandmother's estate money before disbursing it to her heirs as stated in her will, or does my mom's left over bills have nothing to do with my great grandmother's estate?

You need to retain a lawyer before you get yourself in a mess (and you could get into one on these facts).

First of all, someone needs to apply to complete the probate of your greatgrandmother's estate. To the extent those assets belong to your mother, they will get probated twice.

Second, while there are possible shortcuts with small estates, if you take money before paying creditors, you can get sued. If her assets are exceeded by her debts, you may do better to never probate anything than to do a probate that will only partially pay creditors. Discuss this with your lawyer.

My office does handle these type situations. I'd want details on both estates to be able to advise on the best options. Don;t dispose of any assets until you see counsel.

You have 2 estates that need handled - your great-grandmother's and your mothers.

Did your great-grandmother have a will? If so, then read the will to see who is named as a backup executor if your mother resigned or passed away. If there is no will or if no one is named, then someone needs to do it and you should apply. Any monies belonging to your great-mother's estate should be in an estate account not in a personal account in the name of your mother. Your great grandmother's funds do not go to pay your mother's bills. You first need to see who the beneficiaries are of your great-grandmother's will or via the intestacy law of the state where your great-grandmother resided at the time of her death.

Assuming that your mother is a beneficiary of your great-grandmother's estate, then you will need to become the administrator of your mother's estate, open a bank account in the name of your mother's estate and deposit any funds that would be owed to your mother from your great-grandmother's estate into the bank account for your mother's estate. The rest of the money from your great-grandmother's estate goes to the beneficiaries named in your great-grandmother's will or to her heirs via the intestacy law.

Since your mother has some assets, know that the heirs cannot keep money or other possessions and NOT pay the creditors. Creditors are paid in order of priority before anything goes to the heirs. While you are not personally liable for your mother's medical debts, you may have to pay money into your mother's estate if you start distributing things without properly probating her estate.

I know what you listed as assets, but you are going to have to go through some form of probate in order to close your mother's bank account. If the estate is very small, you may be able to use a more simplified procedure, although there are advantages to going through more complex probate. Chief among the advantages is that you advertise notice of your mother's death and if the creditors do not step forward and file any claims, then they are barred. You will need to discuss the pros and cons of probating your mother's estate versus the more simplified procedure with an attorney.

However, there can be liability to a party who is injured by an agent's negligent failure to file such as might occur if a lender is injured because a later mortgage gets priority. Generally, problems of this nature should first be referred to the escrow agent for correction.

You should go to your local District Justice Court (small claims court) and file a Complaint for eviction.

If you win and he doesn't appeal, you can have the Sheriff phsically remove him. You can try the police, but usually they will say it's a civil matter and won't be much help. Finally, if you want him out faster, you should consult with an attorney to learn of any other options avalable.

You should work with an attorney to make sure that you collect everything to which you are entitled without violating any restrictions.

Hello, I work in New York City and my salary consists of a base + commissions; these commissions are percentages (tiered and increasing depending on values we bill) of each deal that we close. We are paid our commission at the end of the month following our company's receipt of invoices.

Our exact commission is determined by individualized spreadsheets that calculate the amount we're owed as a function of monthly billing. Additionally I have a contract spelling out baseline commission amounts (from my initial hire)

I am considering resigning, and if I do I will have a) deals closed with invoices raised that we have yet to be paid on and b) invoices paid and received by my company that I will yet to be paid on.

I will be resigning in good standing and am not going to a competitor (not even staying in my current industry) - What are my rights to my commission for the deals I've closed ? (and are there any differences between (a) and (b) as outlined above ?

Also, my company has merged with a sister company and has a new name / entity than what is on my contract - does this change things at all ?

Finally - if I am legally entitled to money and am not paid - how difficult will it be for me to seek redress?

The problem is that it was never taken out of the student loan data base and continues to keep me from going back to school. The college states that the Department of Education has the ability to remove the default status and the Department of Education states that since Community College is where the loan was given, they are responsible for removing it. I have been back and forth with both of them and I am very concerned about being dropped from school in two weeks. I sent Kaplan University a copy of the default clearance letter and was told that was sufficient. I am now being told it is not. I have suffered a great deal of anxiety over this and the thought of being asked to leave school is very upsetting when I recently lost my job and have a daughter to support. Apparently someone dropped the ball and no one cares about what my family and I are going through because of it. Can you help?

Your remedy is to sue the community college and perhaps the federal government for slander of credit. By naming all parties in the suit, one of them will sort it out. The problem is that this is not inexpensive and there is no guarantee that you will be able to recover your costs.
