You are correct about needing to witnesses and a notary (assuming you will is "self-proving"). In theory, since the will is self-proving the witnesses would never need to be called to court; but it is always possible that the witnesses would need to be called to testify. Just make sure that you identify the witnesses with enough specificity so that if a court will be able to find them if it needs to...20+ years from now.

Note: There are several procedures that must be followed in a will signing, You should consult with other counsel to ensure that no mistakes are made.

Her spouse is deceased and so are all of her siblings. According to what we have been told via a family member the next of kin would be her siblings children. These types of matters can be contested if your husband knows that an actual will was executed or if there was substantial evidence that his aunt wanted to name him in her will. Was any copy of the will ever found? A copy can be probated if an original will is lost. Does your husband know which attorney she used to draft and execute her will? You can always go to that attorney to find if one was executed or even stored by the law firm.

If the will cannot be found, then the law of intestate succession specifies who inherits. If there is no surviving spouse or descendants (children, grandchildren, etc.) of the decedent, then in Ohio the next of kin would be siblings or their descendants. But if a copy of the will can be found, and the copy shows that the original will was in fact executed, then there is a process to ask the probate court to accept the copy with the same force as the original. It's called a lost will proceeding. Then the provisions of the will would apply. If the will specifies your husband as an heir, then he will inherit. If you have a copy of the lost will, or any other legal estate planning documents prepared for the deceased aunt, consult that lawyer to see if he/she either has possession of the original will or a photocopy of the lost will showing the deceased aunt signed it. Then you can proceed under the lost will statute. This process is complex and you should have legal counsel to see that it is done correctly.

I finally saw the signed copy in the record two months after the hearing. It has three layers of whiteout over the date. A series of earlier dates can be seen through the whiteout. The judgment cost me hundreds of thousands of dollars by ignoring my opponent's correction, after the first day in court, of an "error".

Does the opposing party's failure to serve a signed copy on me extend my appeal deadline? Do I submit a copy of the unsigned order with my notice of appeal? Am I responsible for buying a signed copy from Records?

The hearing was continued. I needed remarks in the early transcript for a post-hearing motion. I received the transcript four months after I requested it, an hour and a half before the office closed on my deadline. The transcript showed me a pattern of judge bias against litigants who do not have the money to hire attorneys. It reveals that the judge cannot function without an attorney at his elbow, or opposing attorneys offering him a choice of scripts. He did not seem to remember any fact in either side's pleadings, or recognize code sections. He kept turning to the opposing attorney for direction. I do not want to go before him again. I suspect the problem is not so much prejudice as declining competence. If this is true, my saying so in a pleading would be cruel as well as dangerous. What recourse have I?

What the trial court does pending receipt of the mandate depends on many, many factors.

A motion to change venue on FNC grounds must be made rather early in the case. If the contract has a forum selection clause, the party is stuck with it. But there are sometimes jurisdictional issues that can quack like change of venue.

IF the motions are frivolous, the court can award fees, but don't hold your breath waiting.

If this is a STATUTORY notice and you pay in full, nothing happens as full payment satisfies the notice. If you pay less than the full amount, the landlord can still sue to evict UNLESS the landlord agrees not to in writing. If you don't pay or the landlord won't agree to a lesser sum, then the landlord has to file the lawsuit. It requires actual legal service of process, so the 1st court date can be 3 weeks out from filing, which itself may not happen for a few days after the 5 day notice expired only because landlords don't want to spend money filing lawsuits until they know they're not getting paid). If you are served the 1st time around, you would be in court on the first date, which could be 3 weeks from filing. If you are not served the 1st time around for some reason, the landlord will try again and this will kick the court date out a minimum of 2 weeks from the first date. Once you are served and must go to court, then it depends on how much of a fight you put up, and how quickly the court rules. If you lose on that first court date, most judges will then give 30 days for you to move. If you don't move within that time (if the court gives you that time and most do but there's always the exception and no guarantees), then the landlord has to place the order of possession with the local Sheriff, and then it will be up to the Sheriff's schedule to get out. All in all COULD be 60+ days, or more. But there are NO guarantees it may NOT be less.

I am now being told that the juvilniles, now 15 year old, are the ones that are suppose to pay me back. My qquestion is, How do the courts think 2 15 year olds are suppose to pay me back since they arent even old enough to get a job? Is this basiclly the courts telling me to fix everything myself and get over it? I am a single mother of 4 and cant afford to fix everything that they broke. You can sue them. It may end up being that the parents would pay, but there is nothing stopping you from suing a minor. However, this is not a criminal question, so you should talk to an attorney that does civil law suits to find out your best option.

It appears from your zip code that you are in Utah County. Go to the County Recorder's office in Provo and ask for help finding out if a Notice of Default has been recorded on your rented property. If you have the lot number and subdivision name that will save a little time in looking it up. You can also file a Request for Notice of activity regarding the property so that you will get notices of documents recorded that affect the property. The clerks are not allowed to give legal advice but may assist in locating a sample document to base your on.

If there is a foreclosure you will be notified whether you file such a notice or not. There will be notices posted on the property regarding foreclosure proceedings (and before that there would likely be a notice of default mailed to your address).

The HOA may be a little more forthcoming in letting you know as the occupant whether the owner is behind on HOA dues.

Power of attorney ends at death, so the fact that your sister was power of attorney is meaningless. The question is did your mother have a will and who is the personal representative?

Medicaid by law is obligated to seek recovery from your mother's estate. You suggest that your mother conveyed her land away 3 years ago and was on Medicaid. That is not possible. Medicaid has a 5 year lookback period from the time your mother applied for Medicaid. Either your mother conveyed the property away more than 5 years before the time that she needed Medicaid or she engaged in fraud or she would have been ineligible to receive it before the 5 year period expired. Or you have misstated the facts which is another reason why you need to speak to an attorney.

I am not sure what you are being asked to sign. If its just a consent to have a family member be the administrator of the estate, it would probably be o, but without looking at the form, no attorney would tell you to sign a document that you do not understand.

If you are only being asked to consent to the appointment of an administrator, you are not giving up any rights of inheritance. However, heirs can only inherit assets after all the debts have been paid and your post suggests that Medicaid is going to seek reimbursement. In that case, there will not be anything left to inherit if your mother only owned the cars. You could buy the cars from the estate but then you add that you had problems with the family and the administrator could sell them to someone else.

Hello: My son moved into an apartment in April 2013. It is one apartment in a quad home in Tallahassee, FL. He is a student at FSU and we pay his rent. Upon moving in there was a slight smoke odor in the apartment. The landlord said the apartment had been closed up for 3 months. Over time, the problem has become much worse. He lives in a upstairs apt and his neighbors directly below are smokers. It was only really bad at night until they became unemployed. Now they smoke in the apartment 24/7. The smoke has permeated everything. My son has allergies and is constantly battling them. Luggage has to be Febreezed and set outside to air-out. The problem has been reported to the landlord and he has said that he has talked to the downstairs neighbors and they are no longer allowed to smoke in their apartment. Here is the question: His lease states that his is a non-smoking apartment however, he is subjected daily to smoke infiltrating his living space. Does he have grounds to break his lease?

I went through a lawyer and bought the 2 daughters share, the lawyer had the deed to the house put in my name and registered in the public records. However the mortgage is NOT in my name. It's still in my dead wife's and her dead 2nd husband's name. I have been making payments for about a year and a half since my wife's death. jThere is about half of the value still owed. The house has problems I didn't know about when I did the buyout and I am thinking of just walking away and let the house be foreclosed. . It possibly may not (if you never assumed the mortgage), but from what you posted why would you walk away from a home where the mortgage balance is half of the value? Wouldn't you want to sell it and pocket the cash?



Answer

Generally when you inherit real property, you inherit it subject to the mortgage. If the home was upside down in value (where you had little or no equity), I could see telling the bank to come and get the home.

When you notify the mortgage lender (did you do that here?) some mortgage companies will automatically add your name to the mortgage. Some will not. I suggest that you check with the lender about this and look at the mortgage loan documents to see if they say anything about assumption of the mortgage by beneficiaries.

However, if the mortgage balance is 1/2 the value of the house, I wouldn't walk away. I would either fix it up and rent it out, or sell it. If you don't fix it, that is ok - you can sell sell it as is but you will have to disclose the existence of the problems. However, you will not be able to get as good a price as if you fixed it.

Regarding your credit, the answer is if the mortgage is not in your name then it should not be reported, unless your name is added or you are deemed to have assumed the mortgage. As I said, you need to check with the lender about this.

The person whose name was on the title signed over the car to the person who sold me the car, but the seller was supposed to first register it on his own name before selling it. I don't know any of these guys and can't get in contact with them. The title is from out of state. and the car is not reported stolen. Can I get the rights to own this car in small claims court ?

If the title from the other State is signed by the original owner and passed to you, why not just have the title reissued in the other State? If not, then it sounds like you may need to be in Circuit Court as an equity court to have the title transferred to you. It may actually cost more than the car itself to pursue this. He requested I take the road test, get my license and come back. He extended my court date for 2 weeks, during those two weeks I tried to find a car to take the test in but couldn't. I told him this and he extended it again. After returning with no license he said I had one more chance but by that time I was living over two hours away from the town I got the ticket in, I was watching my child full time and was not in contact with any family or friends. I didn't have the money to pay the fines because I was supporting my child with all my money.

I recently returned home and my mom told me that I have a warrant, that the cops had shown up to the house. I have a job now but need to stay out of jail because I am taking care of my 3 year old daughter wile not working. At this point, initially you need to have the warrant vacated and have the Court schedule a new Court date. There is probably a bail amount that is now required to be posted before the Court will schedule a new Court date for you. You also need to see if the Court will eliminate the bail requirement and agree to give you a new Court date without having to post bail money to get a new date. These are all things that an experienced Municipal Court attorney can do for you. I would also be interested in knowing why you moved two hours away from the Court and missed your last Court date when you had shown up several times to try and work out your case. Many Courts do take payment plans, but you need to get the Court date rescheduled and do it without being arrested before the tickets can be worked out. You most likely would need to file any Petition to Modify in NJ, unless we can allege that there is an emergency. I would need to know more. Also, I do know that Arizona has a criminal statute which would apply to not returning the child. I am not sure of NJ does. Filing an Emergency Petition can be considered a defense to that statute.

If the person making the power of attorney (POA) is in North Carolina and this is very simple, then no, you do not need an attorney. The POA must be signed and notarized; it does not have to be witnessed. The person makiing the POA has to be mentally competent.

Its always a good idea to have an attorney draft one - I can do one for you if interested for $50 - $75.

Your 30-day period starts on the day you actually received the document, so save the envelope with the postmark as evidence that you were not served on June 18th but instead were served on July 1 or so.

If your current orders do not specify otherwise, then the statutory timeframes will apply. Generally speaking, you must present him with written proof of the out-of-pocket expense within 180 days of incurring the expense, and he must reimburse you within 45 days. If you have presented proof of the expense, then you have preserved your claim to come back and enforce that expense, but if you don't give him proof and request reimbursement by the end of the 180 days, then that particular expense will expire.
