I am sorry, but if she filed a Workers' Comp. case 15 years ago and nothing was done, it would be barred by the statute of limitations and equitable defenses. If she continued working for that employer then she could perhaps file a cumulative trauma case. Originally CAV filters were intended mostly for tractors but are now also used in trucks and 4WDs everywhere.The whole CAV 'system' is in 4 parts -1. The head/top has inlets and outlets, a bleed port and mounting holes to bolt onto your vehicle/engine/chassis, etc. There is a central exit pipe for filtered fuel to rise up from below which has a long, thin bolt hanging down through its centre. 2 gaskets are fitted to the bottom of the head, one on the outside of the central outlet pipe and one in a groove around the outer edge of the whole unit.2. The 'throw-away filter' itself is a can with lots of holes in the top and bottom. A tube through its centre fits over the outlet pipe in the head unit and is sealed by the central gasket mentioned above. The outer edge of the filter is sealed by the outer gasket in the head unit. Fuel coming into the unit therefore must pass through the can which is filled with a specially impregnated paper that also has a carefully controlled pore size.3. A glass sight bowl with a drain port is clamped by the centre bolt below the filter. A perimeter gasket in a groove around the outer edge of the bowl seals the outside to the filter while a small o-ring seals around the central bolt (under a washer on the outside).4. [Not always present] Between the filter and the glass bowl an upside-down plastic 'tree' attracts and holds tiny water droplets so that they are prevented from being passed up the central pipe and out of the filter assembly. The minute droplets join together (agglomerate) and drop to the bottom of the bowl where they can be drained out periodically.The special paper and the agglomerater work together to extract water from the fuel. Running the filter backwards defeats the purpose of the coating and agglomerater by pumping the small water droplets through and directly out the top of the filter unit. The small pore size of the paper removes fine, suspended particles from the fuel either way.This filter is NOT designed to separate large particles or large drops of water from the fuel (although it still does do this, and it will clog very quickly). Good fuel tank design and good fueling practice should keep the larger particles out of the final filtration path which is where the CAV system is designed to perform a final 'polishing' of the fuel.Cheap CAV filters used after a cheap, coarse pre-filter and a water trap provide superior filtration to protect engine parts from abrasive particles and disruptive water. The sight bowl with its water drain are not only reassuring when it remains empty, but a very simple warning system when it starts to fill.Many vehicles fit a (cheap, throw-away) CAV filter between the coarse filter (located near the tank) and the final filter (located on the engine). First, is the former employer's location in New Hampshire? If not, you'll need to contact an attorney in that jurisdiction.

If the building is in New Hampshire and the owner is not being cooperative, you may need to file a law suit called a "Writ of Replevin" to obtain your business property. The underlying issue is that you have no legal relationship with the Owner, and only with your former employer.

On occasion, a polite phone call from an attorney to the owner and the former employer may help to address some of these issues. Otherwise, litigation is the likely path to follow.

I hope you didn't collect more than $500, because the legal limit on deposits for home improvements is 10% or $500 whichever is LESS. There is also a statutory cooling off period for home improvement contracts. I don't do a whole lot of home improvement litigation so I'm not sure what the period is off the top of my head, but if it is 4 days or more, she had the right to cancel. You should know this, by the way, if you are a licensed contractor. Which brings me to the next point. If you aren't licensed you have no case. Now, assuming your deposit was legal, she was outside the cooling off period, and you are licensed, you don't need to cite code sections. Just go to the Judicial Council's website to the "Forms" tab, and fill out the breach of contract complaint forms. Bear in mind, however, that you will have an uphill battle proving you would have made a profit on the job. I've had clients pay tens of thousands of dollars to claims consultants trying to prove their lost profits on major construction jobs. It won't be much easier for you, but for less money.

The first thing you do is get a lawyer to determine if the will is even valid, and, if it is, what to do with it.

This was your step-father? In that case, you and your son do not have a right to inherit from the man and the new wife would be entitled to the step-father's estate unless the will is valid. I agree with Attorney Ashman that you need to go immediately to a probate attorney in the county/state where your stepfather resided at the time of his death to determine if this will is valid or not.

You don't indicate where your step-father lived. If outside of GA, many states have elective share laws and even if the will is valid, the new wife may be entitled to a share of the property if the will was made prior to or after marraige and made no provision for her. Was there a prenuptial agreement between your step-father and his new wife by chance? If so, pershaps the new wife waived any interest she might have in the estate. However, you still need to make sure the will was valid as assets will not pass to you otherwise.

When your mother died, did she have a will? If not, then you and your stepfather and any other siblings would have shared in your mother's property, depending on what she had. Regarding insurance, if the step-father was the beneficiary, that money was his. It will pass per his will if valid.

This case illustrates why people should not make handwritten wills. One's legacy should not be a lawsuit. Spend the few dollars on a properly drafted will.

Drafting a quitclaim deed is relatively easy; many, but not all, people without legal or real estate training can do it. Having said this, I hasten to add that there is another reason to consult with a lawyer first, and that is related to the minimization of adverse tax consequences. Whether or not you would consider it an ordeal, you'll need to engage in at least some legal work. When a person dies in Texas, their property belongs to someone or several someones. Making a Will in Texas is a privilege that, when exercised, directs the decedent's property to the people that they choose. Dying without a Will means that the property will pass to the decedent's heirs as defined by Texas law. In either case, some steps must be taken in order to clear up title when it comes to real property.

Unless you've been appointed as the administrator of your mother's estate, or have taken the steps necessary to perfect your interest in the home, you cannot legally lease your mother's home. Any lease that you sign would be worth the paper that it is written on.

Contact an attorney in the Houston area. Shop around, as there may be some alternatives to formal probate that you can take advantage of. The Internet is a fine place to begin your search, or you might consider contacting the Houston Bar Association for a referral.

Petitioner and I had a deal that was worked on between our attorneys at a court hearing. The deal, which was recorded by the court at my former attorneys request, stated that I would provide support to Petitioner (a temporary support until our next hearing) in conjuction with Petitioner moving out of the marital residence. The residence is separate property but it is also common sense that I could not afford to pay my expenses (new apartment), the mortgage (Petitioner living rent free) and all the house expenses including paying her support. Petitioner never moved out of the residence and my attorney informed me to stop paying support. In result of doing that, Petitioner filed a wage garnishment order against me. She is also getting welfare for food. Without knowing all the details, it is obvious that my attorney "messed up" without including a move-out date and they found this loophole in our deal. There is no way I could afford to pay all of the above and would never have agreed to that number (even if it was only for 2 months) if Petitioner was going to stay in the house. My plan was to attempt to rent the house out to cover the mortgage (which I have had many offers for) which I can no longer afford to pay.

Is there a family law code that I can use at our hearing next week to contenst this wage garnishment and ask the court remove it? I am happy to pay support but it must be in line with my current wages. If the judge grants support based on guideline I am almost certain the support will be hundreds of dollars less than what our deal was for.

I would never instruct a client to violate a Court order. Then you BOTH are violating the agreement instead of just her. You really need to go in ex parte on the basis that she is violating the agreement, so you need relief from the orders. I would suggest a new attorney. I don't recommend you representing yourself, because it could end up costing you more in the long run. You can't afford to have this case messed up any further, and Lord knows what other potential problems are present already.

Drunks and binge drinkers behave very differently from sober people, and even though his alleged drunken behavior is dissonant with your experience of him, Your Friend could well be guilty -- especially since he was so blotto he doesn't even remember. The legal time limit for prosecuting a rape is much longer than 6 months, but the more time that passes the easier Your Friend can rest. What is this person doing in the present to address his drinking problem? The third, fourth and fifth time he gets drunk and is accused of sexual assault, nobody is going to believe it's a he-said she-said.

I agree with Mr. Stone. To answer your last question, waiting until after your friend turns 18 to file charges would not allow the authorities to charge him as an adult. What matters is the defendant's age at the time of the offense, not the time he is charged or put on trial. Even so, if a crime is particularly egregious, the juvenile court can order that the defendant be tried as an adult.

Assumpsit just means the suit was in contract rather than tort. In either case, you can appeal a final judgment within 30 days after the judgment was entered on the docket.

The more important question is whether you should appeal or not.

Appeals are very very costly if you get a lawyer (I charge $7500 to $10,000 on average because they are very time consuming and detailed). If you aim to represent yourself, then you are almost guaranteed to be unsuccessful for many reasons. Leaving aside the merits of your claim, there are numerous rules to follow which are traps for those who are not lawyers. You will be held to the same standards as a lawyer.

And don't rely on the appeal court for justice. The court is there to act as an umpire of sorts, not as a lawyer for you. They are not obligated to point things ouit which would benefit your case. An appeals court is even more removed - their only mission is to determine whethe the trial judge erred in some way and, if so, whether the error was bad enough so as to require a new trial. And appeals courts don't like to send a case back for a new trial unless absolutely necessary. I worked at the PA Superior Court (the appeals court) for over 10 years and at the trial court for several years, so I know how the courts and judges function.

So before you appeal, what is your case about? How likely is it that you would prevail?

You indicate that a default judgment was entered. Why? If that is the case, what grounds are you going to assert on appeal? You cannot assert that you don't owe the debt (if this is a case about that). Rather, you would have to indicate that the default judgment was improper for some reason. Instead of appealing, have you filed a motion to open/vacate the default judgment?

You can do that. Its a whole less costly and your chances of success are greater if you can show that you acted promply in filing your motion to open/vacate, that you have a good defense to the allegations in the complaint (like maybe the statute of limitations or some other contract defense) and that your failure to answer the lawsuit was a good excuse (like you were served at the wrong address or you were deployed in Iraq). Just knowing about the suit and not bothering to do anything is not going to be a good excuse.

Is this for a credit card debt? Or a breach of contract?

There will be a little give and take, but given the wide income disparity and the length of the marriage, it is likely that you would be entitled to a good amount of alimony. If you can come to an agreement, then as long as it is not too one-sided, the judge will simply approve the agreement. If not, the judge will do what she thinks best.

Here's one possibility:

Get it all in writing first, the whole procedure. Then, on a day when each of you has sufficient time, drive to the storage place in your vehicle. You pay the storage fees and keep the receipt, but you appear together in front of the resident manager who accepts the fees. Explain that you have bought the contents and that the renter/former owner is with you to assist in carrying out the delivery. Then the two of you go to the locker and unload it into your car, working together, and making at least a rough inventory including an agreed guesstimate of value by item.

You don't need to completely unload the locker; just get enough to cover the new indebtedness total, including the rent, with a comfortable safety margin. When you're done, have him initial the inventory, then take him home or back to his car.

Sell the stuff in a commercially-reasonable manner, and keep records. When you're paid off, including your costs and expenses, send him a final accountung and return anything you didn't have to sell.

An alternative is to tell him, "Sorry, the loan was cash and repayment has to be cash."

To do this you'll probably have to pay the back due storage fees to gain access.

You'll probably need your debtor to accompany you or give you a letter advising the storage manager of permission to enter his unit.

Once you gain access, inventory the items and transfer the storage locker to your name.

I don't believe you need any special paperwork for this. Just ask the storage manager.

Once the property is in your possession, do with it as you please

A.R.S. 28-2091(T)(4) defines a "Salvage Vehicle" as a vehicle that the owner or insurance company considers "uneconomical to repair". In this regard, A.R.S 28-2091(T)(4) states:

"Salvage vehicle" means a vehicle, other than a nonrepairable vehicle, of a type that is subject to titling and registration pursuant to this chapter and that has been stolen, wrecked, destroyed, flood or water damaged or otherwise damaged to the extent that the owner ... or insurance company considers it uneconomical to repair the vehicle."

The statute requires that the vehicle be "other that a nonrepairable vehicle." The vehicle has not sustained any frame damage or any damage that would make it a "nonrepairable vehicle." The insurance company agrees that the vehicle is repairable, they are just of the opinion that it is "uneconomical to repair."

In terms of whether or not the vehicle is "uneconomical to repair", the statute gives the owner or the insurance company the power to make this determination. As the owner, I have determined that my vehicle is not "uneconomical to repair". However, my insurance company has determined that my vehicle is "uneconomical to repair". Therefore, there is a dispute between the owner and the insurance company over whether the vehicle is "uneconomical to repair."

Unfortunately, the statute does not define the terms "uneconomical to repair". Therefore, how is this determination of whether a vehicle is "uneconomical to repair" made? Is there a standard that is used to make this determination or is it just an arbitrary determination?

Probably not. Many people use that term ("annulment") without knowing how it is used in the law. Perhaps, they are thinking of some religious context, or basing their use of the term on televison or movies. In most cases, a Dissolution of Marriage will be necessary.

If you have judgmetn against you, and the home is in your name, it is unlikely that the buyer will get title insurance for the proeprty, until the judgments are satisfied or their lihes released. Sometiems judgment creditors will release their lien for a payment of part of the judmgent debt.

If your mother receives MassHealth benefits, then all she keeps of her income is $72.80 per month as a personal needs allowance. If the nursing home manages her Social Security check, these funds are usually held in an escrow account at the nursing home. It's not clear if you have power of attorney for your mother or not -- if you do not, you have no legal say over how the money gets managed.

I explained to him that I had switched insurances a few weeks prior but he stated that he had to go by what was in the system and he had my car towed. The next day I contacted the insurance who stated that it was their error and would pay for the towing. I have to go to court for the citation that was given to me for the unregistered/uninsured vehicle. I have a letter from the insurance company stating it was their error. This all happened after 11:00 p.m. at night on my way home from an emergency vet visit where I had to have my dog put down and actually her him in the car with me. I had to walk to a near by shopping plaza while carrying my deceased dog and wait for my daughter to pick me up. I have feel so overwhelmed with everything and want to know if I have any rights to mental anquish from the insurance company because of their negligence?

It would seem unlikely, however you could certainly retain counsel and pay your counsel by the hour to prosecute a claim on your behalf, pay the court filing fees, sheriff expenses, and expert witness testimony from a doctor and go to trial and see if you recover anything. There are not that many cars around with a password, however some exist and more is probably comming in the future.
This question is not mentioning which car it is all about.

Given a lot of time opening it, I would try to get at the controlpanel for the code entering inside.. Then I would strip it apart and try to locate where the chip for storing the password is. It might be possible to attach spechial designed computerequipment in order to read out the password, if not, maybe just bypass it all together.
If the password is actually stored inside an electronic box that is controlling the entire car, then I would not touch it.

The best thing is probably to contact the producer of the car and send it in for maintenance. They have the equipment for doing such a thing, allthough they might charge you an arm and a leg for it.

In Ohio, usually the municipal court conducts the arraignments, even for the felonies. If the case is a misdemeanor, then the muni court randomly assigns it to a judge (unless the muni court only has one judge). My question: Under what circumstances is it typical for the landlord to institute action "d?" Would they evict me, yet not terminate the lease, if I am behind on rent payments? I have already moved out of the apartment and into a new one. Currently, I am seeking someone to sublease the bedroom and finish the lease- which ends July 31, 2012. However, I am having trouble finding a subleaser and would welcome the eviction if they also terminate the lease.

Another clause that I find interesting...

"No termination of this Lease prior to the Ending Date of the Lease Term will affect our right to collect the total amount of the Rent. You will not move out of your Bedroom or exercise any right of termination arising out of any breach by us of any provision of this Lease due to the condition or state of repair of your Bedroom or the Apartment, and you waive any right, statutory or otherwise, to do so. No surrender of your Bedroom by delivery of keys or otherwise will terminate this Lease unless and until expressly accepted in writing by us."

So even if they do terminate the lease, may they exercise the right to collect the remainder of rent? And do I really not have any right to terminate the lease under any conditions?

Short version. They can continue to collect from you, but are required to minimize their damages by seeking to rent the place to someone else. If they cant, you oculd be responsible until the lease term is up. If the place was uninhabitable or your quiet enjoyment of the premises was interefered with, you might have grounds to argue that you should be permitted out of the lease.
