Representational art consists of pictures that depict some recognizable thing or scene. It includes portraits, still lifes, and landscapes. It is includes both realist art, which attempts to reproduce the actual appearance of the things depicted, or an idealization thereof, and expressionist art, which depicts recognizable things, but in a way that incorporates an emotional reaction to them, without attempting literal reproduction of their appearance. Leonardo's "Mona Lisa" and Munch's "The Scream" are both representational, the one realistic, the other expressionistic. Representational art contrasts with abstract art.

I had left for a couple of months but returned due to rays medical condition. ray passed away in january. the property had been left unattended and was being destroyed.. ray and i were the best of friends as we worked as cowboys we became really close. i made a promise to ray that when he passed on i would keep the hay sales buisness afloat. my question is can his step sons have any athority in the process of evicting me if the property is being foreclosed. You need to find out who inherited the ranch. Property can pass upon the owner's death in at least three ways: (1) under the terms of a will; (2) in a trust set up during lifetime but with passing the property in mind; or (3) according to the laws of "intestate succession," which is a part of the Probate Code that says who inherits when there is no will.
The only way you are likely to have any future rights to remain on the ranch would be if Mr. Parker named you in a will or trust. More likely than not, he didn't.
The stepsons are probably legally entitled to the property and the related business, since they probably are the heirs. You might want to ask a local lawyer who does work on wills, trusts and estates to do some checking for you. For example, if Ray had a will, the heirs may have filed it in the probate department of the county court.

The house is completely in her name. Both have maintained separate jobs and accounts for the duration of the relationship. Currently she is mad and living at another residence. She had the police over so she could remove some items from the residence (entry never was denied to her; she attempted to have the police remove the man which they explained to her they would not do and could not do).
The man wishes to leave when he is financially able to leave. There is no record or history of domestic violence by the man; nor is the man aware of any current allegation of same.
Can the woman obtain a restraining order which would require the man to leave immediately, meaning before he's financially able to leave and to obtain a new residence?
What remedy(remedies) does the man have in the event she attempts to change the locks, shut-off utilities(phone, cable, gas, electricity, water) or in some other way make his living situation worse?
The man's belongings are in the home and have been for well over 10 years, it is the residence address listed on his driver's license, employment records, etc.
What legal remedies exist in the event the woman goes to court---meaning, is there a logical, available means for the man to obtain representation. As near as I can tell this is a "domestic partnership" under California law but there is no corresponding written legal agreement of same between the man and the woman.

If the man has been contributing to the household expenses, he at least has a theoretical case that he has paid rent and therefore is a boarder. That entitles him to 30-days notice, theoretically. Since he would be the sole boarder, she would not have to file an unlawful detainer. He would automatically become a trespasser after the 30-days. Other than that he has no rights to remain in the house. In no way shape or form is this a domestic partnership. A domestic partnership must be registered with the Secretary of State. It also must be between two people of the same gender, unless at least one of them is 62 or older and entitled to collect Social Security. If the man wants representation he has to hire a lawyer.

Unfortunately this is a common problem with foreclosures involving associations. You are likely correct, there is probably a mortgage on the property and title is in fact not clear. The clerk cannot give advice as to the condition of title to the property, you must have a real estate attorney or licensed title company research and review the title to this property immediately. He receives a bi weekly disability check which is being garnished $200 by the IRS for the past 3 years to pay off the lien.
My mother is currently filing for a divorce, and I would like to re-finance the house soley under my name, but cannot do so because of the lien. Am I just as liable for this lien? You are asking for us to guess about how the lien attached to your property. UNtil you have and provide that information, no one can give you a definite response. You need to get a copy of all relevant documents, including the lien, deeds and everything else, and be able to specifically tell us the names on the deeds, and the tax lien. Your uncle may have bigger problems than the Judge at this point. You said that his wife had a baby by some other guy. Under Oklahoma law a child of the marriage (born while they are still married) after two years becomes legally his child. I would advise him to retain legal counsel as soon as possible. The guy who we bought this furniture from is just a dealer who buys his furniture from distributors, and sells to consumers. He's saying that the distributor first will pay him, and then he will pay us, and that the distributor will come to pick up the furniture from our house. I told him that what happens between him and distributor is his issue, and that since I paid him, he should pay me back right away. You have no legal rights. Unless your sales agreement says you have a right to return and a refund (or unless they delivered the wrong item) the merchant does not have to do so. So all you can do is hope he wants to be nice to you. This is by the way why you always should pay with a charge card, as sometimes you could attempt to resolve this with a chargeback.

A finance company that bought over another failed company did not sue me for debt owed to the former company and have in fact given me a Form 1099-c debt cancellation note filed with the IRS.
However with the suggestions of the collection agents from the Failed and closed complany they have added the company that have cancelled the debt as Plaintiffs and then assigned the case to the Collection agents as Assignees for the claims so that the collection agents could collect the cancelled debt for themselves.
Is this claims valid in the small claims court.
The Judge in the small claims court do not even understand the Implications of a Form 1099-C debt Cancellation note. and have given a judgement to the Plaintiffs who have cancelled the Debt naming the collection agents as Assignee.
This is a tossed-up case and the judge may have made a technical error.
How could I get the case dismissed...as null & Void.

The judge ruled correctly. A 1099-C is a tax matter and accounting matter. It does not affect the actual liability on the underlying debt. Taxes are calculated on the basis of income and expenses. Making a loan is not an expense, it converts one kind of asset (cash) to another kind of asset (accounts receivable). When a loan is repaid, the principal is not income, only the interest. When a loan is not repaid, however, after reasonable efforts to collect the IRS allows the lender to convert it to a tax-deductible expense by treating it as no longer a loan, but rather as income paid to you. The 1099-C is the method the lender uses for putting you and the IRS that they are electing to treat it as an expense to them and income to you for tax and accounting purposes. That does NOT mean the debt is legally ended. All it means is that if the lender later collects anything on the loan, either by collecting from you or selling the debt to a junk debt buyer or other assignor, they must treat that as income rather than repayment. If the assignor collects from you, they also must treat it as income, less whatever they paid for the assignment.

You can pay your girlfriend. The motorcycle is in her name and thus she is the lawful owner. This is no different than any other type of gift. If a boyfriend buys a gift fr their girlfriend and they break up, the gift belongs to the giftee, not the gifter. The fact that you paid for it simply establishes that you got her the gift. Unfortunately you can't stop her from doing what she wants with her property.

I wouldn't really say this is a criminal law question, but let me offer a different perspective. I'm not so sure that I would call this "her property". I think it may be possible to sue her, but it will require some proof that this was NOT a gift. Just because the bike is titled in her name doesn't necessarily mean it belongs to her. You could hire an attorney to get a declatory judgement, or even a remedy such as specific performance, but again it comes back to proof. Can you prove that this was yours and not hers. Your brother could file an affidavit, but that will require you to file suit. If this seems complicated, it's because it is and that is why you need an attorney.

My employer informed me this week that we had to renegotiate my contract (basically the salary) because there was a mistake in the way my contract was written up. I am a full-time employee receiving the hourly wage of a part time employee in this organization. Is your contract for a specific period one year several years etc. A defense to a breach of contract action is that there was a mutual mistake but again this does not seem to be the situation Of course the employer can terminate you if you don't agree to changes but he would be breaching the contract and you could sue for damages and other possible remedies. This may be spelled out in your contract. Of course all this is based on what the contract says and you would be advised to review the matter with an attorney to get a clear evaluation of the situation and determine your options.

You say that you have been convicted - this would mean that you received a jail sentence or a fine. This would be a final conviction. Unfortunately final convictions remain on your record indefinitely. You really do not have any options except perhaps to get a governor's pardon - an unlikely event.
If you actually received deferred adjudication probation and completed it, then you could probably petition the court to seal your record. I say probably because some offenses are exempted from nondisclosure.

That is all wrong. Your landlord cannot use your rent money to finance repairs to the property without crediting you for payment of the rent. My mom is in a nursing home, and my dad lives in the house with his niece. I, along with my wife and seven kids would like to move into the house. The house is not finished, but in great condition. My father is behind on the property taxes by $5,000.00. My wife and I are considering getting a loan and paying off the taxes, as well as not only finishing the house, but expanding to fit my large family. My father and I do not get along, so I have a feeling that he will be against the idea, but seeing as though I am on the deed, and am willing to invest so much into the place, I am wondering if I can make the decision on my own to not only move in, but also build against his wishes (seeing as he is a co-owner. (I do not intend on trying to push he and his niece out.) Can I just get a contractor on my own and just start working against the wishes of a co-owner?

First, an attorney really needs to read this deed to make sure of your ownership rights. If you are a co-owner, then you can move in. You can not necessarily add onto the premises, and I doubt whether I would just move in with my family. Best alternative is to sell the house through a court proceeeding and split the money.

So that being said I traded my car that is worth 4200 plus a few electronics. We have no bill of sale. I signed my title. He didn't sign it. There is nothing on the website that mentions that. The director of the international office told me that their policy doesn't allow international students to pay in several times. The case was dismissed after one year, but I still have a "misdemeanor for 3rd degree retail fraud" on my record. My lawyer told me that I would have no record, but when I did my student teaching, my criminal record came back with the misdemeanor. It was a very unpleasant surprise and the school was not very happy about it. I had no intention of lying to the school - I was under the impression that my record was clear!
It would very much appreciated if as many of the following questions could be answered as possible:
- Was there some kind of mistake? Why would my lawyer say I don't have a record and then I actually do?
- Is my only option to clear my record to wait until 5 years have passed and then try to have it expunged?
- If I do indeed have my record expunged, when I go to apply for my teaching license, will the state of Michigan still have access to this information?
- If I have it expunged, will I honestly be able to state on job applications that no, I have not been convicted of any crimes?
- Can schools in the state of Michigan view expunged records?
I have not been able to get straight answers to any of these questions. Please help.

Were you actually served with the subpoena? That is what matters. If the date was changed and you were not told about it in a timely fashion, let alone provided with written notice, then you can hardly be held responsible for it.
Before you can get in trouble or held in contempt, there would first have to be a hearing. You would be provided notice of that too. You would have to explain to the judge why you didn't show up and it sounds like you have very good reasons.
Keep in mind that many prosecutors will not try to have a victim held in contempt for not showing up to a deposition or a trial because they don't want to "re-victimize" the victim. Keep trying to get in touch with the Assistant State Attorney. Ask to find out his or her name and then ask to speak with them personally. Call every day until you get a hold of them. That is of course assuming you want to assist in the prosecution of this case.

An arrangement for services for payment is a contract and if the service provider fails to provide material aspects of the services then yes breach of contract is the customary route.
"Detrimental affect": sometimes a disreputable company will tell you what they will do and then intentionally fail to follow through. That is called "fraud in the inducement" and so you may have a fraud action that led you to sign a contract that they intended not to perform or give you less than you should have been entitled to.
Discrimination? Nothing you've presented suggests "discrimination".
If you know of other people who have been affected by the same behavior, you call all sue separately, or you can see if an attorney might be willing to take on a "class action" - often class actions help people who on their own have relatively less at stake and for whom mounting a lawsuit could be costly, but for under $2000 you can risk a small claims action.
You can also report the company to the government if the services provided are licensed or require permits of some kind, or to the police as a "white collar crime" of sorts, or to the Better Business Bureau so others will get the low down....

my solution has not been tried and tested but you can try.First melt it then leave it in the scorching sun for about six(6) to eight(8) hours preferably from ten(10)am to six(6)pm.Then come back and see what has happened to it.
