The children are now 14 and 11, neither wish to see their father because of what happened. And they are also in fear for their mother and new brother. I'm afraid the law still won't help you if it's a private boot camp you are paying to attend: a breach of contract is still a breach even if you have really good reasons for it. You probably could not be forced to attend, but you would still have to pay the fees called for in your agreement.

Ok.. so here is the problem. My boyfriend and I moved into an older home last September, the landlord was asking $450 for rent, but we noticed that the house needed to be painted so we offered to paint it for her for $50 off the rent. It was starting to get cold outside at the time, so we decided to wait til after the winter to paint it. In March of the next year, we found a newer and nicer place we wanted to move into (we only had a month to month lease, since the house was for sale), and we notified our landlord. She said to make sure the house was painted before we left, or we were not going to get our $400 deposit back. The garage was made out of really old wood and when my boyfriend tried to pressure wash the old paint off, it kind of imprinted the wood. We still painted the house, garage, and fascia as stated in the lease. It was not the best job, but it was not horrible either, and we did the best we could with what we had. She lived a couple hours away, so never came and looked at the job before transferring our money back into my boyfriends checking account. A month later, she called my boyfriend saying the job was not as good as she had hoped and told him she wanted some money back because she had to buy more paint and supplies to fix it. Now... in the lease, under "security deposit", it says that once the landlord agrees that the property is in good standing and that the "tenants have fulfilled all of their obligations" the landlord will return the security deposit and the lease will be terminated. Can she really come back a month later and ask for it back?

She can ask for anything, of course, but whether she'll try to come after you for $400 is really whether it's worth her time and trouble. She certainly had the right to come out before sending you the $ and look see if the job was passable, and if the only language about returning the security deposit is what you included, theoretically at least on paper she blew her chance and shouldn't be entitled to ask for her money back. As to whether the work is what she should have expected, it has to do with what the lease said, and if there were no specifics as to the quality of your painting work and it was understood you two would actually be doing the painting but were not professional painters, then all she could have expected was a "reasonable" job for two non-professionals who chose their own paint. One other thing in the lease you should check too is whether the lease has a provision (which most do) about your having to pay her attorney fees and costs if she has to sue you and wins. She might think that it won't cost her much to sue you, and if she does you may wind up having to make a choice of compromising the situation or taking your risks with a judge. If you don't have picture of the paint job she could claim it was horrible.... Best thing is to have an attorney review the entire lease and any pictures of the paint job.

First of all, you can't serve papers at all. That's because you are a party to the dissolution petition, and papers need to be served by someone over 18 who is not a party to the petition, or a protected person named in any restraining orders.

Second, if you know she is out of the country, then it sounds like you may know where she is. The fact that someone is out of the country does not mean you can dump papers somewhere or not serve her.

You may have to comply with the Hague convention, but should do so if she is out of the country and you know where she is. I suggest using a registered process server to help you.

You obviously need to deal with the complaint. Typically, this would require you to hire a lawyer in New York to represent you. A lawyer not licensed in New York cannot file documents in a New York court, unless he or she has New York co-counsel.

I would review the contract with the credit card company to see if you consented to jurisdiction in New York. I would also look at the terms of cancellation.

I would probably do an Internet search about this company to see if there are businesses in a similar situation. It may be worth contracting the Better Business Bureau.

It is not possible from the facts you provide to tell if you have a claim against the credit card processing company. While I could not represent you in the New York action, I would be happy to speak with you at your convenience about this situation to explore the possibility of claims against this company based on CA or federal law.

Depending on what the easement says, the utility probably has the right to continue to have the line through your property. Deeds do not have to repeat every easement or other restriction recorded against a property.

Check your deed. It probably has words like "UNDER AND SUBJECT" to existing [easements, restrictions etc.] of record. Check you title insurance policy: it probably also lists the easement as an "exception" to the insured title. That means that your title is not insured free and clear of the exception.

If there no longer is a neighbor and no one needs or benefits from the telephone line, you could negotiate with the utility company to remove the easement. That would also have to be done by a document that will be recorded.

Unfortunatley we have an unrelentless, nitpicky neighbor living across from our home , that has no couth or comman sense.

Without reason or warning, I received a copy of an email she'd forwarded to our entire neighborood, accusing us of being problem neighbors. She began her email with the fact that our legally parked boat (covenant approved), rubs her the wrong way. She then outright admits secretly videotaping a "verbally abusive" conversation between her husband, myself and another neighbor concerning keeping their vehicles on the street as a blocking device in order to prevent our vehicles from using "her side of the street"(we park there when we mow the lawn). According to her, the law states it's not ok to park our cars in front of others homes without permission, even though my vehicle(s) were not obstructing her mailbox or driveway.

Finally, she concludes her email by falsely accusing my 11 year old son of physically assulting her 10 yr old son with an pellet gun, leaving him with a bruised cheek, which is a complete lie.

She states her children do not venture outside due to the unsafe, harrassing and unruly environment we're in part, responsible for.

We continually stive towards esthectially improving our newly built home, I am a courteous neighbor, pay my taxes, HOA dues and keep my pets, yard and children in order. I'm not sure what my options are but I'm tired of being harrassed by this family!

If the house was granted to you and her, she cannot sell the house without either your consent or a Court Order. It might be foolish, but a realtor can list the house for sale without your consent.(they just probably can't sell it) But, if you are not on the deed, the selling of this house is a matter of your Divorce case. If she is single, and the only person on the deed, your ex would probably not be barred from selling her house. You need to check on how this house is titled with the Recorder of Deeds, for the county in which it sits, and the property division portion of your divorce decree.. These two things should tell you if you have any say in whether this house can be sold, or if you are entitled to any of the proceeds.

Hi. I have a civil union in the state of NJ. My partner and I moved into an apartment in June/2013. The management was aware she would be living with me, but we did not include her on the lease because her credit was poor.

My partner and I recently separated (and are seeking legal separation and a divorce when enough time has passed to file). I cannot afford the 2 bedroom apartment alone, and she is pressuring me to find a roommate by Jan 1st. The rent is high, the apartment size/layout not ideal for 2 people who don't know one another, and no one in my immediate network needs a place to live, so I will have to rent to a stranger.

We have 2 bedrooms and I suggested she move into the second and we see out the lease until the end. She said she is moving out instead and has not stayed at the property since the day we agreed to separate. Our separation was not dramatic. We had been living as friends for a very long time. Consequently, I feel she is being unfair and unreasonable, especially since I have proof that I financially carried her in many ways since we got married.

My question is: if I can't find a suitable roommate, would a court system see my wife as having a legal obligation to pay toward the apartment costs until the end of the lease despite her not being on the lease? I know she would have no obligation if we were not in a civil union, but I am wondering if she does since we do have one.

There is not a whole lot of law yet on this type of situation. However, the intent of developing law appears to apply the divorce laws the same for both gay and non-gay couples. Using that as a guideline, it would appear to me that both of you would be obligated to pay the rent because it is marital debt, no matter who it was incurred by. That debt would not necessarily be borne equally in that equitable distribution means "fair" distribution of debt, which is not necessarily "equal" distribution. If the two of you could not agree, a Court would ultimately decide. And by the way, there is no "period of time" that the two of you need to wait to get a divorce. Proceedings can be immediately started.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Yes, but it would be foolish to do so without seeing a lawyer first. For six months after you leave Georgia courts will retain jurisdiction over any divorce or custody case, and Judges may not like you deliberately separating the children from the father, affecting what happens to you in future custody rulings.

I had H1B (same employer for last 10 years) and my wife was using EAD for work purpose for last 3 years. We visited India last month and got H1 and H4 stamped. Before travel, we applied AP for her also (waste of money ....Thanks to our attorney).

During rentry at port of entry, we used H1b and H4 visa for my wife (did not use AP).

I94 has 3 years stamping per H4.

Now, she resumed work.. EAD is valid till 2012. Is there any immigration issue ..I think her H4 is still valid as EAD and H4 are independent things in my understandings.

About a year after my wife & I seperated she moved to NM with our kids, we were living in OK & have a child support case & I have been paying child support for about 2 yrs now. I finally was able to get a default divorce because she would not sign. I had a standard child custody plan with the original divorce decree. Since I had to settle for the default divroce the judge in OK said he did'nt have jurisdiction to do the custody plan because the child support case was in a different county & she & the kids now live in NM. My kids were recently taken by CYFD in NM & temporary guardienship was given to my dad in NM. We had a meeting with CYFD & I told them I want my kids to live with me in OK I am stable, want & able to care for them. I was told by CYFD that they cannot give them to me & this I do not understand? How do I get permanent custody of my girls? They are ages 3, 5, & 6 years old.

This is a great question in a somewhat complex area of the law. Also, it is not a question that can be easily answered in a forum such as this because any single answer I could give you will raise two or three new questions by you. Also, as to NM law it matters in which county the children are located and it will matter as to the exact 'charges' that were made by CYFD against the mother. CYFD may appoint an attorney for you and you can call them and ask them to do so. However, if they are not "charging" you with any abuse or neglect in the CYFD case they will not be inclined to appoint counsel for you.

You should be able to present it as an agreed order and the judge would sign off on it without you appearing, but i would ask the court clerk in your county what needs to be done.

What do you mean "main name"???? Either you are on the lease with your brother, or you are not. If you are, yes you can be evicted too if the rent is not paid wince the way leases work (unless there is something very special about yours) is that each tenant on a lease is liable for all the rent and the landlord cares less who pays what share. Even if your name is NOT on the lease, then you can still be evicted as an "UNKNOWN OCCUPANT" along with your brother if he doesn't pay the rent.

No, this situation as described would appear to require the professional services of a Virginia attorney appropriately experienced in real property and probate law. And, furthermore, any attempts to handle such a matter (pro se) on your own and without counsel is certainly to be a losing prescription (in my opinion), and if you cannot afford to retain such counsel from your own funds, then get these other 12 cousins who supposedly have a legal interest in this matter to "chip in" their respective shares so that competent counsel can be retained to represent you (and the others as may be appropriate) in what certainly appears to be on its face a legally complicated case.

Possibly, but restraining orders and domestic abuse injunctions are often narrowed by the context in which they were issued, and may contain further detail in terms of what constitutes a violation. For example, if the respondent already lived nearby when the order was issued, the judge may not have anticipated forcing him to move; rather only to avoid unnecessary confrontations. He should promptly discuss this potential violation with his lawyer, however, unless there is any real danger of imminent injury, in which event the petitioner should contact the police immediately.

Remember that I am only guessing here because I have not seen your paperwork, so have a private consultation with a lawyer for review of the docs before you act on my suggestions.
