It depends on what crime you were an accessory to the fact of. If, for example, it was murder, then the answer would be no. On the other hand, if it was a petit theft, then yes you should be eligible. Those crimes are extremes on both ends of the spectrum, so I think you get the idea. They can sign it and have it notarized at a U.S. Embassy or Consulate if they are U.S. Citizens or resident aliens, or it can be notarized, verified or authenticated, under the laws of the country they live in if they are nationals of that country. Alternatively they can just give you a written signed agency agreement, which would certainly empower you to find tenants, sign a lease for them, etc., but you might run into issues managing the property for them, if you have to deal with the government, banks, etc.

He needs to document everything that he is doing. He should keep a dairy of each phone call to CPS with the date, time and message left. What you state occurs often with CPS cases - the CPS case worker is overwhelmed with cases & does not return calls. He should also call the CPS supervisor and leave messages.

I have been contacted several times over the last two months about Vivint wanting me to renew my contract. I told them that I was not interested. I assume from your question there was a pending motion for spousal support filed by your ex that was dropped from calendar because your ex was late to court. I don't think he can work here because he can not communicate on a corporate level again repeating because of the person linguistics he is not hireable for the postion. They are walking along the edge with what they did, but it doesn't sound to me like they crossed the line. I should clarify one point: it was discrimination, but not all discrimination is illegal. Employers are allowed to discriminate for a lot of reasons, or even no reason at all, without incurring legal liability. Discrimination only means treating one person or people with a particular trait differently or disfavorably compared to others. An employer certainly is entitled to discriminate in favor of hard working employees against those who just barely get the job done. They can also discriminate against people who wear red clothes if they feel like it. The law does not require employers to be fair or even sane. In this case the implication is that Cam is of some ethnic or national minority. Discrimination based on that is illegal. However, an employer can discriminate against people who have trouble doing a good job, in favor of those that do the job well and easily, and they can discriminate in hiring on that basis as well. If Cam's english language skills were a barrier to him being effective in his job, it is not illegal to discriminate against him on that basis. Now if they discriminated against someone from Cam's same ethnicity or nationality who spoke perfect english with no accent or little enough accent it did not affect his ability to communicate clearly and professionally, then it might be a different story.

What made his position and job skill different at this time than any time before during his 9 years of employment? The fact that they are using his lack of language skills to terminate him is not, as Mr. McCormick mentioned, per se illegal, so long as there is a legitimate business reason behind the need for Cam to be able to communicate properly. He was put on probation on Feb 13. On April 28 he rcvd a summons from and incident that he was never arrested for and appeared in court of may 17 for a misdemor that happened prior on January 20. He saw his probation officer last Friday and she knows about the new chage but did not violate him. On Saturday he was picked up for vop from the other county in regards to the new charge again he was never arrested for the new charge just summons. Right now he is on hold with no bond waiting to be transferred to the original county. How can they do this especially since the incident was in January prior to being on probation.

Sounds like you made a really bad deal. If you have labored under this for any great length of time without complain, I question why you are now asking.

If you really are a salaried exempt manager, as long as you get 2x the minimum wage for a 40 hour week, they can work you as many hours as they like 24/7.

As to deductions, sounds like you agreed to a share of net/net/net profit, which can be 'legal' in some circumstances. They are really pushing the limits though, with what you describe. This is more like an owner's position, with all the risks of loss and high cost being paid before taking any 'profit' home.. Bottom line, I think you have real grounds for legal claim and complaint.

I did answer this too. If you all agree, appoint one of the seven as "Executor" when the time comes. If the time never comes, you need do nothing. If you don't agree, one of you has to file a Petition with the probate court asking to be appointed even though there is no probate matter. You will need a Judicial Council form that can be found on most court websites or the State Bar website. That will require the filing fee of $395 or whatever it is locally in San Diego or where ever when you file and the person asking to be appointed will have to explain to the Court what the "just in case" nature needed is. It is then up to the Court to agree to appoint or not.

You need to get the estate file for the husband to see exactly what grandmother got and then you need to see the estate file for grandmother as well as the deed to any real property in order to determine who gets what. I suggest that you make copies of the above and have them reviewed by a probate lawyer who practices in the county/state where your grandmother and her husband lived at the time of their deaths.

In Ohio, if you sue the driver at fault, the court is going to give you what the car was worth at the time it was totaled. You can generally find out the value for a car from Kelly Blue Book, though going back to 1995 might be difficult with them. Another way would be to look on craigslist and/or ebay to see what the same vehicle in similar condition might be going for. But you will never get sentimental value to a car (let's say it was your grandfather's and you recall going to baseball games in it).

If you had any personal injuries, of course that would be something you would also want to be compensated for. You could also speak to the prosecutor in the OVI case and tell him what restitution means to you. A judge is within his/her power to order someone convicted of OVI to pay for the damage done.

Your Hawthorne Warrior M820B is in fact a Mossberg model 340, of which there were various designs. A lot of the parts are available through e-gunparts.com. But, be careful, and ask a lot of question when ordering parts. A lot of the parts are not a direct fit. I have a Mossberg 340KA, and had to replace the barrel. I ended up with a barrel from a Hawthorne M820B. The sights on the Mossberg barrel were dovetail mounted, and the sights on the M820B barrel are mounted with screws. That's just an example. This will get you started in the right direction.

In April 2008, my parent's long term care insurance placed Mark as a live in care giver at my parent's house for my father, who had late stage Alzheimer's. It was during the next two and a half years that Mark became like family with his exceptional care of my father. He truly brought good cheer and laughter to my father's last days.

Unfortunately, there is nothing you or your family can do to assist Mark at this time.

One of his main problems is his unlawful presence, which makes him ineligible to adjust status in the United States, & subject to a 10 year bar if he departs the U.S.

If Congress passes a Comprehensive Immigration Reform Bill, then perhaps they will provide a way for people in Mark's position to gain legal status in the United States.

It depends on where you are. Some states require that a defaultnotice must be sent, and the borrower must be given at least 11days to "make good' on the payment. Others don't require any noticeat all, and theoretically a lienholder could repossess the vehiclethe day after the payment was due.

No lender actually would do such a thing; repossession is a pain inthe rear for them, too. But you can't count on 60 days, or 90 days,or whatever. The best thing to do if you know you're late on yourpayments is to talk to the lender; they're more likely to "cut yousome slack" if you're communicating with them than if you appear tojust be ignoring the fact that you're behind on your payments.

It's also a lot easier to negotiate with the bank beforethey've gone to the hassle of actually sending someone out to takethe car back than it is afterward. By the time the car isrepossessed, the lender has more or less given up on the hope ofgetting paid any other way.

They all benefited from the generosity of my dad much, much more, than the value of the loan he made me. Can they put a lien on my house? If the knock is coming from down deep in the engine you may have some worn out connecting rod bearings and or main bearings. This could be from high mileage, abuse, lack of oil changes or possible oil starvation from steep angles during a bit of 4+4ing. The engine may continue to run okay for many miles if you nurse it. There is no quick fix for this. An engine rebuild would be a cure for that condition. Installing a good used engine would be another way out, probably cheaper than a rebuild.


ADD-ON: I once developed several knocks in my engine when I over-revved(?) it during a missed shift. It went over the red line with the result of a stretched timing chain and a couple of valves through the top a couple of pistons. I was able to 'nurse' it home from the beach but a re-build was absolutely necessary.

First, don't say 'came out of no where'. Things don't come out of no where. Saying it came out of no where is tantamount to admitting you didn't see the car which is itself a traffic violation NCGS 20-154(a) "The driver of any vehicle upon a highway or public vehicular area before starting, stopping or turning from a direct line shall first see that such movement can be made in safety...". Second, there were at least two witnesses, yourself and the other driver - possibly more if there were passengers. As to the possibility of saying the other driver was negligent, if you mean lying about it - yeah, don't do that but if you are referring to the fact they were speeding - sure, you can do that and if they were in fact speeding then they were negligent. The only benefit to doing that would be that in North Carolina, the doctrine of contributory negligence essentially bars an someone from recovering any compensation if it can be proven that they acted negligently and contributed to the accident in any way.

If you were awarded title (Which is separate from any mortgage), you are allowed to go back into court and get a court order transferring title. BUT, you will need to file a proof of service, giving him notice of this - and no, there's no way around this part. Sorry.

The whole process from setting up the business until arbitration was handled by attorney. The transaction was over and we paid Mr. Y the award in full. (Note. Mr.Y was not happy with the award amount granted by the arbitrator (a retired Judge), so he tried in many possible ways to get as much extra as he could and not letting us live well). As a result, he reported to both the Police Dept and X Bank (our former company bank account) that we forged his signature at the end when we closed the old account and transferred the remaining balance to open a new bank account but in fact we used a "pre-signed" check from him and this action was consent and was under our attorney's instruction to do so. The account then was frozen by X Bank because of this issue happened. Anyway, after 2 years of investigation, police department finally closed the case with no charges ever made and even the record is now sealed (we had documents from the PD). And we had further Arbitration Award that the Arbitrator had ordered Mr. Y to go to X Bank to close the case within 3 days so the fund will release back to us. Our attorney also confirmed this Award into a Judgment from the Court. However, Mr. Y failed to cooperate and had ignored the court order. We submitted all legal documents to X Bank and request to have the money release back to us but the legal dept from the bank denied our request and explaining to us that the request must be from Mr. Y. but not us ! We are the prevailing party, is that mean we will never get the money back unless the case is dismiss from Mr. Y?

You may not be able to find out who your aunt used as legal council though you should be able to view her will. The first spot to check is with the Register of Wills for the county your aunt lived in. The law does not require that wills be filed with the register of wills though it is a good practice to do so.

The personal representative (whomever your aunt appointed to manage her estate) opens up the estate and files the will with the petition to open the estate. Once an estate has been opened, the will becomes a part of the court file and a matter of public record (so anyone can look at it or get a copy). If an attorney helps with the estate administration that attorney will be identified on the docket.

I am from upstate NY and the creditor is from way over 6 years ago but I found out that they sued me in 2005 and as I had moved around a lot back then I never received any notice of this in the mail or otherwise. I only just got a notice from them recently, a letter from a law office for the creditor, referencing the court case. They were very vague about if they had already taken money (I'm not missing anything from my bank accounts) or if they will be taking it some other way. I do not have extra money and the payments I could make are extremely small after I pay my monthly bills. But my question is can they still collect? I mean if it's not on my credit report and it has not been for the past 3 years because once I started to get my credit in order I always checked - can they take the money? I mean, how can you possibly prepare to pay a debt you don't even know you have? Especially when I'm not just ignoring calls and letters I'm doing everything in my power to make sure I know where my credit stands. Does the judgement from court make it still collectable? Please help, I so can't afford for some lump sum to disappear from my bank account overnight or for my wages to be garnished.

Judgment stays on credit report for 7 years, but is enforceable in NY for 20 (yes - twenty) years. Judgment bears interest at 9% a year. If filed as a lien at the county level the lien is good for 10 years and can be renewed for another 10. Judgments have a negative effect on your credit report.

A creditor with a judgment can both garnish the judgment debtor's wages and levy a writ of execution against the judgment debtor's bank account (or just restrain the account pursuant to a restraining notice).
