I recommend that you bring an attorney to the DA "Office Hearing." First of all, the DA does not have power to conduct "hearings" or to command your attendance. The only reason most people, including attorneys, go to these meetings is that there is always the threat that the DA could decide to prosecute the case in criminal court. One upside of DA office hearings is that I have the opportunity to try to make my client's case to the DA (for example, in this case, the defense that your son was walking around an abandoned building, but he did not intend to steal anything). The difference between you or your son making these arguments to the DA, as opposed to an attorney, is that anything you or he says can be used as evidence against your son in court. What the attorney says is not evidence. But all it takes is one slip of the tongue on the part of your son and they'll say he confessed.

My sister has never claim him as a dependent on her income tax returns because she new that his mom and grandmother were to put it simply, messy. They have been claiming him as a dependent since his birth. First the grandmother then the mom once she became of age. To make a long story short my sister called his mom and informed her that she would be claiming him in 2011 because he would be graduating high school and with graduation fees and she also wants to buy him a car and for her not to claim him on her 2011 tax returns. All of these years my sister never ever asked them for a dime. The grandmother added him on her lease for section 8 for years and after Katrina in 2005 she wasn't able to prove that he lived with her so she got booted off the program. My sister lives in Baton Rouge, LA and so does the mom now. She still does nothing but she is upset about the news that she won't be able to claim her son on her income tax next year. Because she is messy not to mention totally ignorant what can we do to head off any retaliation. She might try to say that he was with her in 2011. She might try to forcibly take him from my sister's custody. I really don't know. What about emancipation. Help!

It shouldn't be the case, but it often happens because the person is usually in a vulnerable situation. If you believe your sister-in-law is being treated unfairly and against her will, then she can draft a new Power of Attorney for Health Care naming someone else if she is able. If her mental faculties are intact, she should be able to accomplish this with the help of a lawyer. If not, you might want to petition the probate court to be appointed guardian so there is court oversight as to her care. However, the daughter-in-law may have other reasons such as financial or insurance concerns to continue providing adequate care in the home.

This was clearly intended as a temporary arrangement and in fact, weeks before his death he requested his friend stop by to sign the title transfers back to us. I'm afraid it sounds like they are doing it exactly by the book except for the open house. They can't force you to do that, but showings on reasonable notice (24 hrs) you must comply with. Also, having given notice of it being listed for sale, they can give you verbal notices of showings rather than a written one each time for the next 120 days.

I would doubt that Bankruptcy would prevent them from revoking your registration but if you can't manage your debts you should speak to an experienced bankruptcy lawyer to see if this kind of debt is even dischargeable under the code. In that regard you should have posed this question as bankruptcy question rather than a traffic question.

If you were delinquent or late on an account, and it is being reported accurately, I'm not sure I see a problem. My guess is that accurate information can always be reported to the credit reporting bureaus. However, you probably want to speak with a credit repair specialist.

Thereafter, when I went to my storage a few days later, I found that they had put in an overlock on my storage unit and since it was already past office hours, I couldnt acces my storage.

That was my last day in Atlanta and hence, I had to return to Florida without getting imporatnt stuff out of my storage.

Public Storage apologized later (stating that they forgot to remove the overlock even after getting the payment), but I asked them to pay $400 as compensation, since that I'd have to pay to go back again later in June.

But, they are asking me to produce expense proof of $400. Isnt the mistake on their part and stress on my part enough for me to get a compensation?

Correct me if I am wrong; Aren't they just asking for proof that you'd have to "pay" to go back again later in June? The fact that they are even offering to pay your expenses is very reasonable considering that you were in Atlanta for more than two days. (Based on your comment about it being your last day in Atlanta..implying you were in Atlanta for more than 1 day.)

Produce the receipts of your travel expenses and they'll compensate you.

OR you can go to court, hire a lawyer, and produce receipts of your travel expenses and they *may* compensate you. Which one seems like a better idea to you?

You are lucky they are offering anything. It is certainly not the case that a mistake on their end and your "stress" means they have to open up their checkbook for whatever you claim as damages with no proof. That theory really never works anywhere. Moreover, the storage business is generally not generally going to be held responsible for the travel plans or unique circumstances of every renter (that is likely in the contract). Keep in mind the problem started with your late payment. Either cooperate or take the chance they won't pay anything.

If Dad hasn't paid any child support for a year, that is grounds for terminating his parental rights. And yes, you can combine that with the request for adoption (by the stepfather). You file a suit for termination and adoption.

One question is whether the owners of the former entity actually have liability. This is not an easy question to answer. Much depends on exactly how the entity went out of existence. In addition, you likely have important statute of limitations issues that will bar your claim, assuming that your claim is also at least five years old.

I strongly suggest speaking to a lawyer about your chances of success as to any such claim. It may be that an hour invested now with qualified counsel will save you hours and hours of chasing defendants with no chance of success.

Our assets were left to one another if one of us died with the individual trusts going to our respective children (this is a second marriage) upon the survivor's death. I just learned that my husband has created a new will removing me from any executorship, power of attorney, or trusteeship. He was not planning on telling me of these actions. I found out by accident. I need to know if there is anything I can do, especially since this was going to be his own little secret.

From a non-legal side, I would probably talk to your husband about this. From a legal side, you need to consult with an attorney and look into changing your will and trust so that your children are protected. You may have to re-title assets too.

I agree with Attorney Rosner. Your post raises a lot of things which are not "legal" issues, but marital ones. You need to talk this over with your husband and/or get some marital counseling maybe.

If that will not work, obviously your husband has changed his mind about things. Fortunately or unfortunately, that is his right. Wills and revocable living trusts can be amended at any time prior to death. And your husband does not need your perrmission to do that. Nor can you "force" him to make you the executor or trustee or agent under a POA.

Based on what you have stated, it appears that your husband has removed you from being executor of the estate and trustee. Why? Being in charge of the estate (if he has a trust there should not be much to probate anyway) or trust is not the same as disinheritance. without knowing more about this, I cannot speculate on motives, but maybe it was not done for a nefarious purpose. You do not indicate your age. Could it be that you are both getting up in years and he chose to put the burden of handling finances on someone else while leaving your rights to inherit intact? Who was made the executor and trusttee? His children? A lawyer or abanker? Maybe your husband knew how you would react and chose not to tell you? Or did he also change the inheritance provisions because he is thinking of ending the marriage?

I can't speculate and that is why you need to discuss this with your husband if its feasible or get him to go to counseling. Regardless of whether the marriage can be saved or not, you need to think about your own property and possessions and children of your own if you have any. What I suggest that you do is take a copy of the will and trust that was done as well as the new documents executed by your husband.

You need to pay the attorney to review. If you have your own trust then amend it (I assume it is also a revocable living trust), remove your husband as trustee/executor and change the distribution from your husband to children or whoever you wish. You should not have to re-title assets if they are solely in your own trust. If the assets are in your husband's trust, then this will be problematic. Do not go back to the original attorney who did your will and trust. If the attorney represented both you and your husband there is now a conflict of interest and it would be better if the attorney did not represent either of you. Find another elder law attorney - there are lots of them in your area. Many are also here at Law Guru (Miriam Jacobson comes to mind but there are others).

If the marriage cannot be saved, then you need to also see a family law attorney.

If by settle you mean a final resolution of the case were you get a lump sum and the case is dismissed, there is absolutely no requirement that a case be "settled". The case can be submitted on the record or after a hearing and an award can issue as to what you are entitled to with periodic payments starting and a lump sum payment of any benefits owed up to date of the award. There is no apparent reason that you attorney has not attempted to do so but it makes no sense why they would not have done so unless there was a good reason. You have to ask your attorney why the matter had not been resolved, such as your condition not yet being permanent and stationary.

I live in 1 large room along with a group of study "subjects" My direct neighbors have been behaving from the very beginning ( now is the 5 th week )in a noisy, obnoxious manner with total disregard to the facility's own rules . My complaints are taken but there is no actual effort made to make the conditions livable and once I was treated in in a rude way. My most recent conversation with the study chief ended what you can summarize " live with it or get out " On a couple occasions the complains by the other participants about the exactly same problem ( noise ) were addressed and remedied but not mine.

I am deprived of sleep because of the snoring at night and even the ability to take a nap because of noise during the day. I was offered to spent a couple hours at night in a separate TV room lying on 2x5 feet couch well suitable for a 6 year old, with a cold air from air condition blowing into my face and my neck and back are hurting from it.

I am exhausted both physically and emotionally .

I am able to quit anytime for any reason and be compensated for the time already spent but I don't want to do it since I have planned and adjusted my life around this study. Originally it was supposed to start a day after Christmas and on the momentary notice they have changed it to Dec 19 th 2012, which among others made spending Christmas and NY Eve impossible to spent with the family

I have signed an agreement but it does not address the problems I am exposed to but the basic civil behavioral expectations and rules were clearly set during the meetings at the beginning of the study.

( For clarification: My question has nothing to do with the drug tested -- it was understood this way by one respondent )

This scenario describes the tort of "breach of fiduciary duty" and you would have to prove that the employee's role was one that had such a duty. In most cases, that duty is held to persons at a Management, Director, Officer level and not simply an employee. Evidence that the employee is paid salary, files a W2, operates with very little management (not via negligent supervision but that the job itself requires autonomy), bonuses are available for excellent work, other fringe benefits, etc. would all prove that there was a duty to take care of the business.

If the matter involves $20,000 an attorney should definitely be consulted. The statute of limitations for a case like this is likely two years from the date you discovered the breach of duty, but again an attorney should be consulted with specific facts in order to ascertain whether a breach occurred and whether the statute of limitations has ady passed.

The answer for this question may surprise a lot of people and It will take some explaining to do. Rent is expensive to have your own Dojo or place of practice, not to mention paying for all of the materials needed including insurance. If you use weapons in the Dojo then it costs you extra as well. Some Dojo are full time, which they hold classes every day or the majority of the week. These instructors are full time and that's all they do is teach. Some will trade days, you may have one instructor one day and a different one the next. They can rotate. Most Dojo today will not teach one art, they will have a bundle of arts so that they can make more money and appeal to more than one group of students. Some Sensei will not get paid at all and often have to pay out of their own pocket to make rent. Other than common arts such as Karate or Tae Kwon Do, other arts such as Judo, Aikido, Kendo, Iaido and others will share a dojo with another art, creating a schedule so that it all works out. The less common arts usually cannot afford to have their own place, which is why they will find an existing dojo to teach at. You would usually be allowed to teach for free however money that is made on student membership will go to the dojo (a certain amount agreed upon).So, just being a regular instructor or Sensei usually do not make as much money as you would think, and most have other jobs that they do other than teaching. The highest paid job would be a Peace Officer Standard Training (POST) Use of force or open hand combat instructor. They will teach at police or corrections academy.Some may think that Military contracted instructors would get paid the most. This is incorrect. There are two options here, the military can contract out to a civilian or they will have their own hand to hand combat person which makes a standard military salary. On special occasion the military base may have a special seminar or training event and hire a couple instructors to teach special stuff which would add to their knowledge. These things are not a full time job so an instructor could not rely on this to make a living.These are just a few common scenarios that I hope answer this question. If an Instructor or Sensei had 30 students and charged them 100 dollars a month each, he would make 3,000 dollars a month. Depending on your space, rent could cost 2,500 a month plus paying the electrical bills. This would make the instructor maybe just 200 or 300 dollars a month. So now what you do is find other instructors to teach Aikido, Judo and other arts. Those teachers would only make good money if they could have a lot of students, which most of the time is not the case.

If you go and handle matters yourself ... well, you are experincing what can happen in that circumstance now and it is no fun - is it?. The best thing you can do is learn from your mistake, bite the bullet and hire an experienced traffic attorney to resolve this FTA for you. Based on your assertion that you were in fact in Court 7 years ago, it may be possible to have the FTA penalty stricken - this penalty is normally $200. You probably have already squandered a whole lot of money by not moving for an upward modification. You need to do so asap, as there is no retroactive application.

For the reasons you stated, his downward modification should probably be denied.

In Florida, with family law cases, depending on the parties' comparative financial resources, the Courts have the discretion to hold one party responsible for all, or part, of the other's attorney fees and costs. In other words, if the other party has significantly stronger financial resources, while you will still have to pay the retainer, do not assume that you will not be able to afford to retain an attorney. Reimbursement can be sought.
