The heirs under Arizona law should file an affidavit in the probate court to transfer this small estate to the heirs, since we don't know if there is a Will in the box. By following the proper procedure to transfer the small estate, the contents of the box may be sent to the heirs for distribution amongst them. There would be a filing fee with the Court, and you would have an order of distribution which the bank should honor. If they would like an attorney to represent them to accomplish this, I would charge a fee of $1,000.

This is not a mediation issue, it is a family law procedural issue. What you need is an order from the Court which has jurisdiction over your divorce proceeding, directing the managers of you 401k account how to divide the funds, whether 100% to you, 50-50, or some other distribution. You do not need to take further action if you want rights of survivorship. Are you sure you do? If you or he dies, the other gets your entire share. If this is exactly what you iintend, it works well. This means, however, you do not want to provide for your child or family from the real estate. Full support generally follows when the spouse has been a full time homemaker with no work skills, may be disabled, or for some reason could not be expected to support herself, for an indefinite period. Rehabilitative support is like temporary support so she can go to school or otherwise prepare herself to enter or re-enter the workplace. Transitional support generally means temporary support so she can find a job but probably already has skills. There are very broad guidelines for these so a lot is up to the discretion of the judge, or more often these days, to a Domestic Relations Hearing Officer who makes recommendations to the judge. Generally one starts thinking about indefinite support when the person has been out of work for around twenty years give or take. From what you told me you're bumping up against this but a lot depends on your existing skills and the likelihood that you can improve those skill, plus your physical or other limitations.
If it sounds fuzzy to you, it is fuzzy. You are not "entitled" in the sense that there is some hard and fast rule. You'll have a better shot at it if you get a good lawyer.

If its a older vehicle with a carburetor or a throttle body it could be the cable running from the throttle cable down to the trans may be bad. Older vehicles valve body can stick sometimes as well. You can usually just remove the valve body from the trans and clean it and will be fine. Could be a problem with the torque converter clutch. Newer vehicles have shift solenoids that go bad sometimes as well... But cant really answer your question with out more info.

If I recall correctly the thermostat on a 3.5L V6 2000 Oldsmobile Intrigue, is located to the left and below the throttle body. This is located on the drivers side of the engine bay (right side of the engine as you look at it) inside the water neck, which the radiator hose is directly connected to.

When you file your I-485 you should also file form I-765 to obtain work authorization and form I-131 for advanced parole travel authorization. Once your I-485 has been accepted you become a pending applicant for admission to the US and may remain in the US while your application is pending, even if your non-immigrant F-1 status expires. It takes about 90 days to receive the work authorization. With this you can continue your employment, though you may be eligible to receive practical training after you graduate which would also provide authorization to work. That request to work is also submitted using form I-765 and should be submitted at least 90 days prior to your graduation. Your foreign student advisor should be able to help you with that application. They will not help you with the I-485 and you should seek competent immigration counsel to assist with that process. .

A few weeks later, I found myself in another difficult financial situation in which he again offered his help. I wanted to leave my current apartment and rent a new one. I needed $5,400 for this, and he deposited the money into my bank account. I felt guilty that he was providing me such large amounts of money, and offered to pay him back based on the proceeds from a bar study loan that I had thought I would be receiving. I sent him my offer to repay him via text message. He never accepted my offer. There was no written or oral agreement to repay him. It was a mutual understanding that it was a gift.
Unfortunately, I decided against obtaining a bar study loan, and also against dating this man. I tried break up with him, but he told me he would sue me for "false pretense" to recover the money and the gifts he gave me. Can he sue me successfully in small claims court?

He definitely can't sue you to obtain the full value of the money in small claims court, as D.C. has a $5,000 limit on small claims actions.
As for his "false pretenses" suit, it is unlikely to be successful in any court. The website described essentially exists to allow rich men to pay for companionship. You both knew what you were getting into and absent him having a contract or otherwise compelling proof that the money he gave you was a loan, legally he doesn't have grounds for a suit.

Two months ago, I could not reach anyone at the storage company, After a great deal of research, I learned the company was no longer is business and that a new company had moved all of my belongings to their storage facility. It probably depends on your agreement with the original company. If the new company absorbed all of the business from the old company, then it should be subject to whatever terms and provisions you had with the old company.
If you do not pay timely, the new company could probably do what they are threatening.
Your best bet is to go to the new company and work out a new agreement so there is no confusion.

Might be able to work up a worker's compensation case, but I am not sure. It gets pretty fact intensive when trying to ascertain whether this was something that occurred during the course of employment, but it's been done before.
A private lawsuit against the ball thrower is plausible, but if I were his attorney I would be screaming consent / assumption of risk and that when your running between bases you're supposed to not run in the line of throwing, blah blah blah.
Interestingly, however, is that it is softball. The "soft" portion of the word sort of connotes that the goal of the game is more fun based and not hyper aggressive. If the company wanted its employees to be playing a real sport like that then they would have a hockey league (sorry, couldn't resist that comment - don't mean to be flippant, I know you've suffered real injury).

If the basis of the city's citation is that you cannot park there because it is not your property, then you have a basis to challenge the citation if you in fact are entitled to the use of an easement. An easement gives you property rights to use that property. If the basis of the citation is the city ordinance regarding weight restrictions, then that's a more difficult issue that would require further research.

That means that absent an employment contract, an employer needs no reason to fire you, so long as he does not break the law and fire you for reasons like race, sex, age, and religion. Son B dies without leaving a will. The property taxes and all monies paid towards maintenance of said property are found to be solely paid by Son A for the last ten years.

I don't know where the real property is located but I do not think that son A has acquired the entire property by adverse possession JUST by paying taxes.
This problem illustrates the failure of everyone to do estate plannim. Mom and Dad ought to have thought more about this. Son B should have created a will when he divorced.
Assuming that the land is located in PA and that the parents died before son B got divorced, the share would be as follows:
Son A, Daughter-in-law A and Son B would all own 1/3 as tenants in common (bear in mind that I have not seen any deeds or other documents) as daughter-in-law B conveyed her share to the others. She cannot "waive" anything. The only scenario I could see where she waived was if the couple divorced and then mom and dad died and daughter-in-law B disclaimed her right to inherit the land under the will.
Power of attorney ended at son B's death. Girl B could only use the power of attorney during Son B's life to manage the property and finances of son B. Since son B does not own the entire property son B can't do anything with the share of son B other than to maybe sell it to son A and/or daughter-in-law A. Nobody else would want it unless other owners all agreed to sell the whole thing. So the share of son B can't be mortgaged, rented out or otherwise encumbered unless all agreed.
When son B died, the power of attorney ended as I have stated. Assuming that son B lived in PA and that he had not remarried at the time of his death, then all of his property would go to his children (I assume that there was only girl and boy B).
In this case, the property is still owned 1/3rd by son A, 1/3rd by daughter-in-law A and 1/3 (representing the share of son B) will now be owned by son B's children, girl and boy b (girl and boy b each have a 1/6th interest). This is contingent on the land being owed as tenants in common.
If they drew up a new deed when the land was inherited from mom and dad which said they were to hold the land as joint tenants with right of survivorship, then in that case, when son B died, his 1/3rd share automatically would have passed to son A and daughter-in-law A by operation of law and girl and boy B would have no rights whatsoever in this piece of land. They would split anything else owned by son B but not this land.
Now son A has paid the taxes and so forth. I do not know what the land is worth or if it was ever rented out or if anyone lived there. Son A and daughter-in-law A would owe their 2/3 of the taxes and maintenance. To the extent that they paid more than their fair share, they would have a claim against son B or his estate but I don't think that he could go back more than 2 years for this. If son B lived in the home rent free, then technically a rental value should be assigned to the home and 2/3 of the rental value should have been paid to son A and daughter-in-law A. A claim for rent that is owed would also be subject to a 2 year period of limitation.
Note of caution - if this somehow got into equity court, they might allow a claim going back further. I cannot ssay as I have not looked at any documents or deeds and don't know the circumstances.
The real question is that it is never a good idea for this many people to own property. Do girl and boy b really want the land? How much has son A overpaid? What is the land worth as of today and what would son B's share be worth? Has son A sought to buy out the shares of boy and girl B, albeit at a somewhat reduced rate as son A has been paying more than his fair share of the taxes?
I suggest that the parties may want to consult with a real estate litigation attorney in the county/state where the land is located to definitively ascertain their rights. Pay the attorney for 30-60 minutes of his/her time as it will be worth it. The attorney will need to see mom and dad's wills and the deed to the land. The attorney will also need to know when the parties died and when son B divorced in order. Without any facts it is difficult to answer the hypothetical question in the abstract and so I am not certain I even agree with the premise of the question. For example, if A and B agree that widgets will be provided of a certain quality and at a certain time, then a court will clearly listen to any and all evidence that the widgets were of a different quality and/or were not provided on time. Finally, I am not certain if what is "good" for business or what is "bad" for business is the legal standard, so much as enforcing the reasonable expectations of the parties who voluntarily and mutually agree to a contract. The underlying policy considerations in the law here are certainty and predictability.

When i moved in I paid first and last but no deposit because I had to clean the rental unit myself. Anyway a snow storm (20in) hit in the middle of the month and even though I was not staying there I left the electric on 60 and I am still paying the electric bill to date. Not nearly enough information here. What's the procedural setting? Does the divorce decree say you can reside in the family home as long as your daughter does? Is this coming before the court on a motion to compel the sale of the home? Then an affidavit will be fine, but it should state that while your daughter attends school in NC, Long Island is her domicile. The difference between residence and domicile is the intention to return. You may be living anywhere but you intend to return to your domicile. It would help if your daughter is paying out-of-state tuition and shows Long Island as her permanent residence on the college's records. She should get a copy of those records and put that with the affidavit.

Not to put a damper on things, but there is quite a lot to watch out for. I suggest you consult with an attorney and do your research before proceeding. That being said, if would be best to register your DBA so as to enjoy some protection. In CA this can be done at the county level. For instance, the Los Angles County website can direct you as to how you can register your DBA. In AZ, DBA registration in done at the state level through the Secretary of State's Office. Depending on your job duties, pay, etc. I would recommend forming an entity to enjoy liability protection for your professional activities, rather than go the sole proprietor route. I am sorry for the length of this description. I assume the more facts, the better. Over 10 yeats ago, (1997 I believe) there was a vehicle accident. Two people were in the car. One was killed, the other critically injured, and ultimately paralyzed from the waist down. The vehicle belonged to my boyfriend who was not in the car or the same town at the time of the accident, nor was permission given for the car to be driven. The car was not registered or insured, nor were there license plates on it. After the accident, the owner of the car, who was also close friends of the two involved in the accident, was sued by the surviver of the accident. The survivor was awarded a $3 million judgment. The family of the individual who was killed, who was also the driver, did not attempt to sue the owner of the vehicle knowing that the driver was at fault, and that the vehicle was not legal to be driven on the road. The owner of the vehicle, as well as the two parties involved in the accident itself were all legal adults. The owner never listed the vehicle as stolen; he was informed of the accident, the loss of his long-time friend, and critical condition of the other friend later that day. Due to a feeling of guilt, mourning, and remorse, among other feelings I'm sure, the young adult owner of the vehicle incorported unhealthy coping mechanisms to deal with his own personal trauma regarding the loss of a friend, his actions ultimately leading him to jail. He was incarcerated at the time of the judgement made on him by the survivor of the accident. He was not able to be present for the hearings, nor did he have adequate representation. After the judgement was made there were several immediate attempts made by the owner sued to have a seasoned lawyer appeal the decision; the lawyers contacted had never heard of a judgement of that magnitude made in such a circumstance, and were not willing to touch the case. All hope was lost. My boyfriend, the owner of the car, sued for $3 million dollars, with noone to advocate for him, has only a 20 year old truck to his name, is in recovery for a long time drug addiction, is battling an incompacitationg depression, and can not maintain employment nor make and utilize an income that would allow him to support himself without wages being garnished; thus not allowing him to, in good conscience, start a family leaving the financial burdon on his soon-to-be spouse. The worst part of that issue being that he his an only child, and doesnt feel capable of carrying on a family name. **Is it possible to appeal this judgement, with actual representation, and the ability of the person who has been sued to be present for the case? Is there any possibility that the judgement can be termiinated? Who would take this sort of case?

Unfortunately, if judgment entered against him, whether or not he was present to defend himself, he had only 30 days from the date judgment entered to appeal. His failure to timely appeal waived his rights to overturn the judgment.
If he was not adequately represented by counsel in that case, he potentially had a legal malpractice claim agaist that lawyer, but needed to file that suit within three years of discovering the representation. Certainly 15 years later is far too long. That claim is gone to, unfortunately. I dont see that he has any legal rights at this stage.

The parent who has primary custody of the minor child has the presumptive right to move the child outside of county. Your scenario is a bit confusing but it seems like you have visitation and the ex-wife is the primary custodian. If this is the case and you have been able to do weekend visitations for the past 6-9 months I think you will be fine. Move-Away issues are with the primary custodian. Lastly even if you were the primary custodian she cannot force you and your husband to stay in San Diego. The issue would be whether or not a custody modification needs to be made due to your move. In this case you are stating you have weekend visitation and you continued to have weekend visitation. That's a pretty good case that the status quo works. I would however speak to an attorney in your area that knows the local rules and judges.

The trust document and/or will sets forth the fee to be paid to the trustee representative. If your sister was paid nothing you need to see if the document itself authorized it.
I don't know if the trust and will were located in North Carolina. Each state has their own fee schedule so you can use the state statutes as a guide. For wills, in NC, for example, the executor's com mission is about 5% of the probate assets and disbursements. However, fees are set by the clerk of court and are generally determined by the size and complexity of the estate. For example, a very simple will leaving all assets to one heir is less complicated than an estate where properties are owned in multiple states. Other states, like PA, have a graduated fee schedule with the percentage decreasing as the estates grow larger.
Trusts follow much the same rules. Banks usually have fee schedules set forth for their services and you could also use that as a guide.

As a result, the unsecured debts have to be paid from her estate (bank accounts, furniture sale, etc.).
Although creditors often try to guilt the family into paying for the debts, the family members shouldn't be bullied into paying for debts out of their own pockets.
Now, the exceptions may pop up if there were liens on the house BEFORE the life estate was created. This can be verified through a simple records search.

They do this two or three times a year and they have these ridiculous rules that you can't have certain items such as your bike, or your patio chairs stacked in two, a satellite dish etc. I know they have these rules in the lease terms but are there not federal or state laws for Virginia that govern what space is yours when your leasing and what you can have on it as long as your not doing anything illegal etc? The only crime that I can see you being charged with is receipt of stolen property, pursuant to Penal Code section 496. The prosecutor would have to prove that the item was stolen, and that you knew it was stolen in order to convict you.
You need to ask yourself whether the money you make from this is worth all the hassle, or whether or not you should inquire as to whether it is stolen or not.

I am one of 4 sisters who inherited 2 houses from our parents. We each have an undivided 25% interest in the property. However, 2 sisters were listed in my mother's Will as co-executrixs after my mothet's death. My mother died in Feb 2007.Succession was opened and completed in December 2007. The Judgment of Possession placed me and the other 3 sisters equally in possesssion of all of our mother's estate. My father died ten years prior to my mother and his estate was also for equal possession of everything. Well, the 2 sisters co-executrixs have taken advantage of their positions and have used their power to financially benefit for their own selfish purposes.
In spite of the Judgement of Possession they have rented 3 apartments to tenants in the property and are collecting rent. I, not only was not informed about their decision, I have and am still presently not receiving any rent proceeds, nor any accounting of the monies.
Am I entitled to receive the 25% rent proceeds because of the Judgment of Possession? The other siblings have collected rent on three apartments since April 2007 and I've recieved zero. I recently discovered that they're also collecting rent proceeds from a federal housing voucher program for one of the tenants. Upon discovery of this issue, I immediately informed the federal program that I too am an owner. I brought all of the proper documents proving my ownership interest. Upon review of the documents by the legal team in the federal program, they concluded that I was and still entitled to receive my 25% interest from any and all proceeds from my parent's estate.
However, my siblings are still refusing to honor this process. They refuse to give me my 25% interest, as well as respect tyhe Judgment of Possession.
They removed my personal property from one of the homes and discared them without my knowledge and subsequently rented the apartment where my property was. I travel a lot because of my job and during one of my business trips they engaged in this terrible act.
How can they be legally stopped? What are my rights as they pertain to my undivided 25% ownership. Can they legally rent the property without my consent, as well as collect rent? Where do I fit in to this scenario? Do they have a right to take these proceeds and do whatever they want.can they rent the property to whomever whenever they feel like it.
Doesn't the Judgment of Possession mean that they are no longer executrixs and can't do and act as they please in particular, excluding me from every aspect of my parents' estate?
What steps do you suggest I take? Thank you

You are an equal co-owner. The judgment placed you all in possession and that ended the duties of the executor. You are entitled to your percent of any proceeds derived from the property. No one can be forced to own property together in Louisiana. You have the right to petition the court to divide the property or sell it and equally split the proceeds between all owners.

Your best recourse will be through the small claims court. So long as you can show them that he did in fact warranty the product. You do not need a lawyer to file that claim or represent you in court. This is basically what Judge Judy does and being in CA, if you are near to LA, you may even bring it there, which is really binding arbitration.
You may want to let him know that this is exactly what you intend on doing so he understands that you will make him waste his time.

If the laptop was a gift (your boyfriend might not agree with this premise) then your boyfriend had no right to insist that you pay for it, and you had no obligation to do so. He also has no right to treat the laptop as his own.
From a non-lawyer perspective, your boyfriend and your relationship both sound unhealthy. The risk of losing a laptop might be worth taking if it means you can make a change.

I bought a house 6 months ago. The previous owner had bought the place from a foreclosure auction, refurbished the house, and resold it to us as a standard sale. Today I received a letter from the California franchise tax board that the 2nd previous owner's (the one that got foreclosed on) LLC did not file their taxes. It states that some of the consequences is that they can seize the LLC property or place a tax lien on the LLC property.
Since this 2nd previous owner or the LLC was already foreclosed, and I'm the current owner after a standard sale with title insurance, can the CA FTB place a tax lien on my home or seize it? Or will they go after his new home? If I look up the LLC, the entity address shows my home address, and that's what worries me.
