we had a contract with a construction company, total cost listed on contract as 5000, now 1/3 of the job is done and the bill comes at 3200, for the rest of the job, the estimate cost is 4700. This makes the total cost to be $7900.
In order to proceed, we need to sign a change of order with the company, however, we feel they are overcharging and we are not willing to continue. Can we refuse to sign the change of order and back out from the contract?

Change orders are tricky things. If you modified the job after the contract was signed, the contractor is entitled to a change order. The amount of the change order should have been negotiated before the change was implemented. If that is the case, then if you don't want to pay for the change say "forget it, stick to the original plan." If the change you requested has been implemented, however, you do owe extra and must pay for it. If you refuse to negotiate in good faith for the change order in that case, you will be breaching the contract and will be liable to the contractor for the reasonble value of the work (unfortunately I and many other lawyers have made plenty of fees litigating what is the reasonable value of disputed work).
If, on the other hand, the job has simply turned out to cost more than the contractor agreed to charge, with no changes in the scope of work, that is his problem. In that case you should absolutely refuse to sign a change order and if the contractor refuses to finish the job for the amount agreed, you can fire them, file a complaint with the Contractors State License Board, then bring in a new contractor to finish the job, and then sue the first contractor for the difference between $5,000 and the cost of the new contractor finishing the job.

Generally, no; a change order is an addendum or modification to an existing contract and failure of the parties to execute the change order leaves the original contract in place, unmodified.
However, the most common use of a change order is when the owner of a project decides to change the nature or scope of the work, e.g., wants a three-car garage instead of two, or wants marble countertops instead of Formica, after the price is decided upon and contract is signed. The change order will specify the additional work or costs the contractor will be incurring as well as the additional price for the changes. This is not to say that a change order cannot be used to increase a contract price with NO change in the work to be done, but why? Contractors are usually expected to live or die by their bids, and if they underbid, that's a learning experience for them.
If the job cost has gone up for reasons that are owner responsibility, that's another matter. There are also cases where the owner bears the cost responsibility for unforseen difficulties such as obtaining permits or excavating rock where loam was expected.
Without reading the contract or understanding why the contractor is over-running on costs and under-performing on percentage completion, I cannot really say whether the contract is breached, whether you can back out (it seems a bit late in the game) or whether you should tell the contractor to just finish the job as specified in the contract and for the previously-agreed contract price.
There are times when you should accommodate your contractor, others when you should tell him to perform for the agreed price, and a few others where you are justified in firing them and considering the contract sufficiently breached to do so without liability. Deciding which this is would require analyzing the contract and the performance to date and reasons why the overall results are not pleasing.

We (my husband and I) filed Chapter 7 almost 3 months ago. We appeared in court last month. We are trying to find a foreclosure or HUD home to buy. When the latest lender (ACS - based in Utica, NY) purchased my loan, they sent me a statement/letter stating that if I made 15 more consecutive on time payments, my interest rate would be reduced by 1 full percentage point. I've now made 17 or 18 consecutive payments, and the interest rate is still the same. When I contacted customer service they tried to tell me I needed to make 32 or 36 consecutive payments. When I told them that I was holding the statement in my hands that reads "15 consecutive on time payments," I was told I would have to prove it. So I faxed a copy to a number the rep gave me along with a letter explaining the issue, and my next statement still did not reflect any change in interest rate. So I called again, and the rep told me "I have your paperwork and information right here, I will get it processed right away." Of course, my next statement still didn't reflect any change in interest rate. I called yet again, and this time I was told that I didn't qualify because I had made a late payment 5 years ago, before ACS had even purchased my loan. So then I asked, "Well then why was I sent a statement that told me I would get this reduction if I didn't even qualify? And why was I already told my next statement would reflect the change if I didn't even qualify?" All the rep would say was that the statement that informed me about the rate reduction bonus was sent in error and that the previous reps that I spoke to were wrong. It seems to me that if this was in fact THEY'RE ERROR, then they should make good on it. Thoughts? Is there anything I can do?

You are only entitled to a free attorney if you are found to be indigent and the court is looking to put you in jail. If the TX A G waives jail, then no free attorney even if you are broke.
Were you served with paperwork? You might argue that you were not properly served. However, the Supreme Court of TX has just changed some rules regarding service and I believe that emails are now ok. I don't know about a mere phone call.
If you cannot hire an attorney, show up and ask for a re-set to hire one.

Every parent has an obligation to pay child support. Your daughter is old enough to figure out where she wants to live -- if the court had to decide this issue, your daughter's preference for living at her father's house might influence the court. You have a right to have parenting time and to have the current court order enforced until it is modified. You can of course file a police report if your daughter is not at the pick up point for your parenting time. It sounds like you ... your ex... and your daughter might benefit from family counseling. That is a option to paying attorney fees to work out a problem that will resolve itself when your daughter turns 18. The decisions you make today are going to impact your relationship with your daughter in 2 years and for the rest of your lives... when kids do not want to live with a parent and the parent's chosen mate, there is a reason for it... and it might make sense to look at it from your daughter's point of view... she does not want to live with your boyfriend... your boyfriend is your choice... not your daughters.

The boys started horseplaying and rough housing with each other. My perception: the rough housing was just horse play the boys were never mad or trying to fight. The camera on the cieling makes it look as if the boys were fighting and staff just let them fight. You are playing with fire. It is a psychoactive drug and maybe considered dangerous. It is also my understanding that in 2008 the California legislature passed AB259 into law and that both "Salvia Divinorum" and "Salvinorin A" both became illegal substances.
I know there was a big push to make it illegal to sell to minors. However the wording of the bill changed and at that point it became simply an illegal substance. I believe the bill was introduced my Assembly member Anthony Adams. You may want to contact his office to check it's current status.

I appeared on the date agreed upon only to learn the attorney that issued the subpoena was delayed in court and unable to make it to the deposition. I am now expected to appear on September 1 for the deposition. My question is, since I showed up the first deposition am I legally obligated to appear on the rescheduled date?

I have spent almost $35K in attorney's fees in the last five years. I have an ex-husband who works in the IT department, where one of his tasks is to support the superior court judges. He has been consistent in bringing us back to court continuing his efforts to reduce his support payments. Our last adventure was a three day trial and I still owe my current attorney $13K for her services. Because we were outplayed, I ended up losing about $800 per month in spousal and child support. After an almost 13 year marriage, the spousal support was cut earlier than is typical because I was portrayed as a lazy woman taking advantage of the system when in fact I was at the time home schooling our two special needs children.
My ex husband has canceled court ordered life insurance, has not ever paid court ordered child care costs, is in arrears on medical co-pays as well as child and spousal support. He has not split his retirement accounts as per the divorce decree from 2010. His legal custody was temporarily taken away due to his inappropriate involvement in our son's special education plan and since he's gotten his custody restored, he's made a mess of our child's IEP.
At the time of the trial, my attorney said we could not bring up these issues but would do it "later." I've been asking my attorney to help me and she has refused stating I owe her too much money. Today I was given notice that I could sign an agreement as follows:
a) I would represent you on a limited-scope basis solely for the purpose of dividing the retirement
accounts per the Marital Settlement Agreement. During this time period, where I am only
representing you on a limited-scope basis, if you have any custody and visitation issues, you
would represent yourself on those issues.
b) I would reduce your current bill to $8,500, a savings of approximately 35% to you. A lien would
be placed on your case for the benefit of our firm, and this reduced balance would be paid directly
from one of the divided retirement accounts upon division.
c) Upon conclusion of the retirement account division, the balance for the fees accrued for this
matter between November 1, 2013 and the conclusion of the retirement account division would
be paid directly from one of the divided retirement accounts.
d) After the retirement accounts are divided and your account is paid in full for both the reduced
current balance and the balance for the retirement account matter, I would then be able to
represent you regarding any child custody and visitation matters you may have at that time. If you do need my representation for a child custody and visitation matter, we could discuss the
retainer for such a matter at that time.
She then says I can sign a substitution of attorney if I do not agree and will need to set up payment arrangements.
I am barely feeding my children at this point (I am not exaggerating) and have nothing left to cut to make ends meet. Is this an appropriate way to handle business? Basically as I understand it, I will have to pay penalties to cash out retirement funds (if and when they are finally split) to pay her for past services where we were outwitted and I lost a large portion of support and on top of that, I will have to pay her even more to recover those funds that were due to me from a basic MSA that my ex-husband has not cooperated to pay as originally ordered. And, if I need any custody/visitation help, I'm on my own. It's a small matter of time before he drags me into court for something else. In fact, we're past due by his standards.
Can you please give me some guidance and maybe even a little glimmer of hope for my future?

The agreement between your attorney and you is governed by contract law, so both parties are free to negotiate changes to the original retainer agreement. If the only source of funds available to pay the attorney's fees is the retirement account, it may be wise to use your portion of those funds to pay the attorney, especially if the attorney is offering a discount, and if your portion of the retirement account is significant.
If you have to go to Court to enforce an order or judgment (the MSA) attorney's fees should be available as a part of the order, so there may not be any out-of-pocket expense to you for that.

Not an easy question to answer. Assuming it is an effective non-compete agreement, the answer likely is yes. However, the Texas Supreme Court recently ripped most non-compete agreements and the law up recently to shreds. You really need to get an Attorney to look at it and research the law. I suspect that would take anyone at least a couple of hours of work!

If you have enough money to have a prenup, you should take the time and spend the money to hire an attorney. An experienced attorney can sit down and discuss what you want and craft an agreement that should hold up in court. Is it really worth the risk of doing it on your own?

the fuel injectors and fuel pump - and maybe the tank too, to get the right vents and filler cap for diesel instead of gas the exhaust system to get the right catalytic converter for diesel the gears in the gearbox to get the right gear ratios to suit a diesel engine diesel does not use any spark plugs so you would have be sure to use a safe method to disable the high voltage ignition system (which supplies sparks for gas ignition) and replace it by the right kind of electronic engine management unit to control the diesel fuel injectors etc.In short, it would not make sense to try to do it from a cost point of view.You could perhaps buy a reconditioned diesel engine made to go in the same model of car, but, unless you could fit it yourself along with all the other bits and pieces, it would be far cheaper just to buy a secondhand diesel model of your vehicle and sell your present gas model.

I recently found out that due to a miscalculation on my part I left the US after 5 months of studying and 31 days (I thought the grace period was one months and thus 31 days, I found out later it is actually 30 days), this was about a two years ago. Meaning I overstayed by one day. My I-94 said D/S instead of an expire date. Will this 1 day overstay have any consequences on my future travels to the US? When you are "Duration of Status", any overstay issue is determined by the U.S. Department of States after you depart the U.S. Meaning, that issue would only arise at the U.S. Consulate when applying for a new visa or other immigration benefit.

In April of this year, my husband and I separated. I asked him to leave the apartment where we lived with our 2 children (ages 4 & 2) in New Jersey and he left. In order to make sure he stayed out I changed the locks - a move which he was aware of. In June, he changed the locks on me when I was at work. On the grounds of harassment, I got a restraining order (which covered the children and I) and relocated to Pennsylvania, right on the border of NJ. I moved in with my mom, a location that he is very much aware of (we had our wedding there and several birthday parties for the kids there). It is 54 miles away, and and hr away on the train.
The restraining order was lifted on August 3rd. That same day and the day after he told me that he is filing a motion to have the children returned to New Jersey. While we were in NJ, the father saw the kids maybe 3 or 4 times during the separation - and according to research I am within jurisdiction of 50 miles to be away from him - and it will not cause a hindrance on him having parenting time with the children.
Is this a case that he can win? This is more so a bid to gain control over me. The children and I being in PA with my parents offers many benefits - none of which the father is concerned with.

As long as she continues to pay rent and follow her obligations under the lease, the lease will survive the sale and she cannot be forced out during the term of the lease. Now, once the lease ends, she can be asked to leave with appropriate notice. Unfortunately, as a renter, there is no way to guarantee a long term living arrangement anywhere.
She has to give access to the son with proper notice to enter the home, but she does not need to leave. She needs to keep a copy of her lease and make sure she pays rent on time every month. Expect that if she is late in rent, they will probably move to evict her quickly.

Generally, you can't change a court order by mediating an agreement. A court order is changed by another court order (signed by a judge).
Often there is a lag time between (1) mediating a settlement and (2) actually getting an order signed. I could tell you stories.
Regardless of what you agree to, a judge has to make a finding (in writing, in an order) that the new arrangement (i.e., no supervision) is in the child's best interest.

Since the prior entity no longer exist, the main defendant should be the new company and Does 1 through 100 to make sure that you can easily amend the complaint later.
More importantly, handling your own wrongful termination lawsuit is a bad idea for many reasons, about which a separate article (or a book) can be written. I urge you to consult an experienced employment attorney in your area to discuss your case and filing a lawsuit. Most attorneys work on full or partial contingency, but even a one hour consultation to discuss your case and your claims can save you a lot of time, money and aggravation of making the common mistake that many people who represent themselves make, that can be easily avoided.

He claims this is the average of the last six months, beyond our triple net. Does he need to produce documentation that the amounts he claims to have paid were in fact paid? I believe the triple net amount we were charged were his estimate of what would be more than adequate to cover. I cannot believe he so grossly underestimated the amount. What recourse do I have?

I'd say a situation like this is somewhat unusual, but not impossible. My advice is:
A. Review your lease agreement carefully, looking for any and all language indicating what goes into the triple-net calculation, and when and how it is billed.
B. Ask the lessor for documentation. The lease probably permits this, and if it doesn't, I'd think a businesslike landlord or property manager would let you look at its costs and expenses anyway, or at least would give you an oral explanation. Whether there has really been a gross under-estimation, or there were unforseen and possibly unforseeable expenses, or maybe just your failure to anticipate some billable item, a good manager should be willing to provide you with some consultation, especially if they expect to be paid promptly and to keep the tenants happy.
C. Consider comparing notes with the other tenants who may be similarly impacted. Maybe another tenant can explain the charges in a way that'll make everything understandable, or maybe you'll get agreement that the landlord is wrong.

I got up and started cleaning up the cups. Later the cop found out i was 20 and said I was in possesion of alcohol. I was confused and clerified with him that I was cleaning up my house. But he said there is a zero tolerance rule. I got charged with 65662 B.P. and he wrote "red dixi cup w/ beer poured into another" on my ticket. I was cleaning up the cups on the table. Technically the officer was right. You had beer in your hands and you knew what it was, which amounts to possession. Being charged with possession does not mean you are accused of having alcohol in your system, so it doesn't matter that you weren't drinking and the officer did not have to give you a breathalyzer test.
Most officers would probably not cite someone in that position if there was an adult present who was also hosting the party. You may be able to negotiate a lesser charge or get the case dismissed outright, but you will want an experienced lawyer in order to get you the best possible result.
