Assuming proper procedures are followed, and assuming the tax lien is junior to the mortgage being foreclosed (I.e., recorded after), the only way it is paid from the foreclosure is if the property sells for more than the mortgage balance. Then the surplus proceeds go to the next lien in line.

The agreement was not signed by my lawyer, and at the hearing the judge said she would not approve it, but no order was filed saying that the reaffirmation was either approved or disapproved.

I am currently in a 15-month lease with my apartment complex. I have lived at the address for one month. In that time frame, I have had to call maintenance to fix a mold issue, fix a leaking refrigerator, spray for insects, among other things. Also in this month living here, I have spent two nights in 85 degree temperatures because the Air Conditioning has gone out.
I want to go in and demand a reduction in rent cost or receive something for these inconveniences, but I don't know if these will hold any ground because of my lease. An attorney cannot answer this question without a detailed review of the lease. You should read it over carefully to find out what you are supposed to do to terminate it without penalty. You can send written notice of an intention to repair and deduct, this is contained in Florida Statutes which you can find online.(Chapter 83)

I receive phone calls like yours on a daily basis. I'm going to vent so here goes...
Every family law attorney gets calls like yours on a daily basis "begging" that the attorney accept their emergency case for free. I have not accepted a private case in order 5 years & I still receive calls on a daily basis - so I know that people have exhausted every other attorney out there if they finally call me.
I quit practicing family law because I have accounts receivable of over $75,000. I cannot afford to practice family law anymore because former clients quit paying after I get them custody. They promise and then then quit. This is even after I discount their legal fees 50-75%. After practicing law over 20 years, I just give up. It's not worth the hassle any more. I'm not willing to give away my time and expertise for people that don't appreciate my level of knowledge and experience. I'm very good at what I do and most attorneys with my level of experience charge a deposit of at least $10,000 when a client walks in the door. I used to charge under $2,500 so that people could afford to hire me. Unfortunately, custody battles are time consuming and expensive. My rates were below I decided to just mediate these days and enjoy the rest of my career.
Also, most family law attorneys In Harris County, for example, do their pro bono cases through the local pro bono group such as Houston Volunteer Lawyers since their malpractice covers all pro bono cases. Plus, all filing fees are waived if its a HVL case.
You can look on the State Bar of Texas website for the local pro bono organization. The wait time will probably be months if you qualify. Some require you to come into their office for a personal interview.
Many attorneys offer a free consultation and payment plans. I recommend that you look at that avenue. Quite frankly, I doubt that a brand new attorney will take your case for free - most have student loans of over $125,000 and they cannot afford to accept pro bono clients.
I bet you pay for car repairs, dental work and plumbing repairs. Attorneys expect to be paid for their knowledge. If your toilet was overflowing you'd find the money. If your car would not start, you'd find the money. Now your family is in crisis, so you need to find the money.

The Request for Entry of Default will be rejected if your response papers are on file. I also do not understand why anyone would attempt to enter a default for no money.

If the divorce was finalized less than 30 days ago, I would file a Motion to Amend, Modify, or Reform the Judgment and ask that the name change be removed from the final decree.
If the divorce was more than 30 days ago, I would file a Motion for Judgment Nunc Pro Tunc and ask for the same thing.
You would have to notify the opposing party of the filing of your motion and let him know of any hearing set on your motion. But I don't think the judge would deny the motion.

If it's been more than 30 days and the nunc pro tunc approach that Mr. Daley suggested doesn't work (it may, it just depends on the judge you're dealing with and whether your ex fusses about it--that's not technically how you're "supposed to" do it), you can file a whole new cause of action just to get your name changed. Actually, anyone over 18 can file for a name change at any time, for just about any reason except to commit some sort of fraud.

I'm not sure quite what you mean about the whole nine yards, but as far as changing your name goes, no you definitely do not have to do that (ever, actually). In fact, your name stays the same by default, so all you have to do to keep it the same is...nothing. About getting married in general, assuming you're both 18, competent, not married to anyone else and all that, all you have to do is go down to your county courthouse and fill out a marriage license application with the county clerk (basically confirming all those issues above plus a couple more). The clerk will then issue your license, and 72 hours later, you'll be able to get married--no name change, frilly white dress, or mother of the bride required. I think the license may only be valid for thirty days, though, so don't get it until you're ready to get married.

My friend Lauren keeps her son about 90% of the time and the natural mother hardly ever calls or sees the child. She doesnt know who the father is and both of the grandparents are deceased so there is no other family. The natural mother mentioned to Lauren that she was thinking of relinquishing her rights of her son to her. Lauren is more than willing to take the child but wants some paperwork in place to do so. I looked up Provisional Custody by Mandate and that would work however, it seems that is only for 1 year and has to be extended every year. Is there any other paperwork that can be done by a Notary that would give the custody for a more extended period of time until Lauren could go to court to get full custody? I missed a payment and received a notice with intent to foreclose in November 2011. I was able to come to an agreement to get back on track with my payments and I submitted a signed agreement and payment by December 6, 2011. My payments since that time are 1 month early. I have been trying to complete renovations to the kitchen and bathroom and informed the mortgage company early in the year. After submitting my agreement I went out of state to help my son during cancer treatments but continued to communicate with the mortgage company by phone and email 2-3x per month. They were made aware that I was out of state. My son-in-law would drive by and check on the property while I was away. By Mid February he found that the mortgage company had broken into the back of the house, destroying my burgular bar doors, changed the locks and ransacked my basement. When he drove by the front door was wide open but the burgular bar door was locked. The back of the house had been cleared out (there were old cabinets from the renovations) , and my air condition compressor was missing. The mortgage company admits to entering unlawfully (the property was never foreclosed). They claim to have done this in late November but I was never notified. I filed a police report and I want to seek damages. I cannot afford an attorney. What approach should I take?

Aside from the marketing pushes, to answer your question...
Yes, you will need an attorney. Technically, each of you should have your own attorney unless there is a full discussion of any potential conflict of interest and waiver of that potential issue. One attorney can possibly represent both of you, but in some circumstances, it's not possible.
A couple of other things:
Theft of under $50 can be an infraction. Petty theft is a misdemeanor and is anything from a penny up to $950. Your attorney may be able to get the charge reduced to an infraction.
The court date is obviously an error. You're likely to get a notice of correction in the mail with the correct court date. In case you don't, though - discuss this with your attorney so they can check with the court and/or the prosecutor's office to get the correct date.
One last thing - should you get a letter from the store or a law firm on their behalf asking for hundreds of dollars - don't pay it without discussing it with your lawyer. These "civil demand" letters are all bark and no bite.

Stock is not the same as life insurance. You are not the sole beneficiary; you and your siblings are all beneficiaries of the stock. The only way to get this is either for all of you to do it or to probate an estate for your mother. The personal representative could get the stock or have it liquidated and could divide the proceeds between you and your siblings.
If probate is necessary, you will have to do that in the county/state where your mother resided at the time of her death. If this in PA, then you need to talk with the Register of Wills at the Orphan's Court.

If you 'end' the claim with an agreement to 0% Permanent Disability but acknowledge there was the injury requiring treatment, the only 'legal implication' is the Insurance Index record of a work injury.
If you try to withdraw the claim form, you personally need to pay back all the doctors and therapists and testing facilities because they saw you based on your promise you were hurt on the job and pursuing benefits through the Labor Code.
So it's really goofy and a horrible idea to withdraw the claim form.
If you ever request benefits from any insurance company for any purpose in the future (car accident, fall in the grocery store, a new work injury, apply for new health insurance) this claim can be 'discovered' by the insurance company reviewing your past, even if its a 0% permanent disability and you got no settlement money.
You'll just have to do the explaining in future actions that you fully recovered with zero residual disability.

Well, that might be a problem.....if you simply turn the car in, they will most likely sue you for the lease balance.....not sure how much this would be in your case, but it could certainly be a problem. If they do that, and the amount is substantial, you might be faced with the choice of somehow negotiating a settlement, or having to file bankruptcy. Obviously, if you already had a lot of other debt, that option would at least be a bit more palatable.

Under the facts you described, you are only liable for the differnece betweemn the price it sold for and the amoutn you owed (plus costs to repossess and sell). Since your wages are being garnished, it appears that the lender has obtained a civil judgmetn againt you. Based upon your written loan agreement, you may also be liabel for th ecosts of that suit plus reasonable attorney fees. You should look at that judgment to see what they wre awarded. Many people are surpised by how much interest, costs and fees can add up to.

I got a letter from a credit collection agency stating that they are going to take me to court for the credit union that gave us the loan because I never contacted them about the money owed to the credit union. This is the first I heard of this. I did get a letter from the credit union months ago stating that they got money to fix the car and then got money when they auctioned it off. When I called them they told me that I had to talk to to the collection agency when they send the information to them. I never heard from them. I live on disability and barely make it through each month. I cannot work and need every bit of that money to live. Can these people take my social security disability that I get each month? Without knowing more details, there are a few issues you should consider.
The first is the letter you received from the collection agency. Does it have a line saying that the letter is from a debt collector and is used to collect a debt? Also, does it indicate you have the right to validate the debt? If not, you may have a FDCPA claim against them. This largely depends on if they did send you another letter before the one you mention in your question. Nevertheless, if you haven't done so, you should send a validation letter.
The second issue is with the possible lawsuit. If your only income is social security disability, then those payments are exempt from collection. If you own your house, you should make sure you've claimed a homestead on it. If you own a car, you should find out what it's current value is. At this stage you may be "collection proof", which means you may get a judgment against you, but they won't be able to actually collect on that judgment.
You should really consider contacting an attorney who practices in consumer debt law to help you with these cases. Proof is always a big problem with many debt collection cases, and an attorney can give you the best chance of a favorable outcome. Good luck to you.

The reason the man on the Sister Wives show is not prosecuted is because he is actually only legally married to his first wife. The rest of the "marriages" were only "spiritual unions." Because a mobile home has a title, if he didn't transfer title into your name, I think you'd have difficulty proving that he passed ownership to you in his lifetime. If he intended for you to have it after his death, he would have needed to write a proper will. Wills cannot be oral.
I'd say if the other heirs want to assert a claim on the trailer, that you just trade your interest in other assets for getting the trailer, or buy out their interest. Talk to the heirs and the executor about it. Surely a trailer that is over ten years old is worth practically nothing to anyone but you.

However, recently, while trying to leave a party, he chased after me trying to fight me. The male is quite larger than me and has a history of doing serious damage to other males. I was able to quickly get in my car, but as I was pulling away he did strike my vehicle, while not leaving damage. I am not concerned with the car, but should this individual come after me again what are the most extreme measures that I can take to prevent serious bodily harm which I am certain to occur, (eg, only hand to hand, small knife, stick, etc.) I do know calling the police is the first thing tht should be done, but that is not possible when the individual is pursuing me. I am not sure where this most recent incident happened or where you live or where he lives, but you do not have to put up with this and shouldn't.
Go to the police department in the community where this individual is hassling you and speak to one of the sergeants or lieutenants in that community and ask for their help. You can file a private complaint against the individual who threw something at your vehicle and chased you.
Those are actionable offenses.
How did this all start? Are you saying that YOU are facing charges as well, or are you just afraid of his pursuing you?
You do need an attorney, and should not wait until a catastrophe occurs. If this individual has a record, the police can determine that.

There is no particular form for Santa Clara County other than a recorder's cover sheet (which you can likely find on their website or the internet). A notice of completion is a fairly standard document. Here is a link to a form that contains the updates enacted in to law as of July 1, 2012: http://www.firstam.com/assets/title/ca/blank-documents/notice-of-completion.pdf
A notice of completion does not need to be notarized but does need to be verified under penalty of perjury. It is not required to be served on anyone but it might be good practice to do so unless you're hopeful that the GC and any subs will blow their lien deadlines.

Do you know of peculiar facts related to the incident? Did you get information that the owner made incriminating statements? Do you know the owner to have a poor reputation (does that lead you to believe the owner lied)?
In any case, wait for the police to fully investigate this matter. Discuss the issue with your home insurance carrier. If you develop facts and or proof substantiating your suspicions, you may look to retain a lawyer to file a civil action against the owner for your property damage plus an incidental costs you incurred related to the civil action.

Why is this coded as a medical malpractice issue? Although I don't fully understand your question, I will attempt to give you a few answers, as to possible solutions.
1) If the Trustee is also the Settlor/Grantor of the Trust, and it is a Revocable Trust, then the threat may very well be real, and using his/her Grantor powers, could ultimately revoke or amend the Trust to exclude particular beneficiaries.
2) If the Trust is an Irrevocable one, by it's language, or by death of the Settlor/Grantor, then the Trustee is limited to only those powers outlined in the Trust and he/she may not arbitrarily or unilaterally alter, amend, revoke or de-vest any of the vested beneficial interests.
It sounds like by "kick out" you may be referencing a residential property held in Trust, the Trustee may have special powers to sell or rent the property, it would be in your best interest to consult with an experienced Trusts and Estates attorney to determine your rights.
You may be able to remove the current Trustee, and replace him/her with someone that will uphold the Trust provisions, and not take advantage or abuse their powers as Trustee.

In order to properly answer your question, one would have to see the papers you signed. You may be referencing something called "credit life insurance," which is probably the most expensive kind of life insurance one can purchase. It is sometimes offered in conjunction with a mortgage, auto loan or other large debt, so that the insurance policy pays off the outstanding balance when one of the insured persons dies. If that is the case, you probably paid the insurance premiums as a part of your mortgage payment during the time of ownership of the house. Without seeing the actual terms of the policy, we cannot advise you on whether it provided coverage for your husband's passing.
Normally, when an investor or bank buys an existing mortgage instrument, they take it with all the terms intact and your rights and obligations as the borrower do not change. Again, one cannot assume this occurred when the mortgage was sold without first reviewing the documents.
You really need to consult an attorney who can go through your escrow documents package from when you bought that house and determine whether a claim could have been made upon your husband's death that would have paid off the balance. It may not be too late if there was a policy in effect at that time.

Sounds legal to me. You could ask to come in and look at the bills every now and then as a fair quid pro quo for paying half of an unseen bill. If this were your electric or gas, it would be an entirely different matter - see Civil Code section 1940.9.

CAN they? Anyone CAN do anything they like. Whether you have an enforceable written contract with the lender will determine if you have an grounds for a breach claim against them. Unless you can informally resolve this with the lender and get funded, you will lose the purchase deal because of your breach. You are not clear on what documents were signed. If you are the seller and the purchaser's loan was not approved, then the question would arise as to whether your sale was contingent on the purchaser obtaining financing. If it was, then the failure to get the loan would be a failure of a contingency and not a breach of contract.
