He does not speak english and I don't know if he was able to read through the laws that the New York department has. He had to leave soon after he was laid off due to his mother's passing. But---there are chemicals that may seal the plug and save a great deal of work as most plugs are hard to access. In the old days, one dumped 3 egg whites in the radiator and wallah. it sealed. Of course you can also plug up your heater etc with this method. The new chemicals are much better, check K-mart, Wal Mart or Auto Zone. It is possible to buy a house while the divorce is pending if your ex-to-be is cooperative. Normally, however, it is a really bad idea because it must be documented and arranged very carefully. I cannot recommend strongly enough, therefore, that you have an attorney help you with both the process and dealing with documenting what you and your ex-to-be agree on. Otherwise the whole thing could easily come back and bite you . . . HARD.

You are most likely tenants by the entirety meaning you each have a full interest in the house. The best way to dispose of the house by some fair written separation and property settlement agreement between yourselves. Doing it this way will keep your overall cost down. However, if you can not agree, you will need to hire an attorney and dispose of the property by equitable distribution. There are numerous factors (too many to go into here) that will come into play if the house gets divided this way. Also, be aware that if you get divorced without addressing the property issues you will most likely be barred from bringing them up later. But to more specifically answer your question, the fact that you did not pay the majority of the mortgage does not mean you are not entitled to anything. Also, a judge normally will not make you sell if there are other options the parties can agree to or that are more fair to the parties. Again, a lot of factors are considered by a judge in making that decision.

You must accept it if it is tendered within the three-day period. If it's outside of the period and you want the tenant removed, do not accept it and immediately file an unlawful detainer lawsuit. It would be wise to seek the help of an attorney. Usually, unlawful detainer attorneys' fees are reasonable and it's well worth it because, especially with rent stabilization laws, there are a lot of minefields which an unknowledgeable landlord will not be able to navigate.

First, just so you know, there is no "legal separation" in PA.

When you file your divorce, you will be able to make claims for child custody, distribution of assets, child/spousal support, alimony, and attorney's fees/court costs, and/or any other related claim. If the other spouse earns more than you and the breakdown of the marriage wasn't your fault, you will likely be entitled to spousal support until a divorce decree is entered. If you are the one how cares for the children the majority of the time, then you will also get spousal support.

If you can agree to the terms of custody, a custody agreement can be entered. If not, you will need to proceed to a trial.

If you are able to reach an agreement regarding distribution of assets, then that agreement can be filed, and if not, then those claims would need to be heard before a divorce master.

I would highly suggest that you retain a lawyer. There are many moving parts to this and there is a lot on the line.

Making a gift of real property from parents to a child while the parents are alive is one of the biggest financial mistakes most people can make. It will immediately subject your parents to gift tax if there is more than about $39,000 in equity in the property. On top of that, it will almost certainly be a violation of their loan. Then, later on when they pass you will lose the tax benefit of the stepped up basis. What this means is that whenever you sell the house you will have a taxable gain on everything between what they paid for it and what it sells for. If it passes to you by way of will or a living trust, you will only pay tax on the gain from the value on the date the second of them passes away and the price you get. That difference in a 94xxx zip code can easily mean tens of thousands of dollars in extra taxes, and even hundreds of thousands depending on how little they may have paid and how much it appreciates. They need to talk to an estate planning attorney.

apparently you may not have filed an inheritance tax return or received clearance for Department of revenue inheitance tax bureau that no taxes are owed. Ask the escrow company what they need to release the funds then get the proper documentation. if you would like to discuss the matter further you may contact my office.

You do not really indicate what happened here. You could not have closed the estate at all if you did not receive a notice of appraisal from the PA revenue department. However, if your mother died 2 years ago, I am surprised that the register of wills is not nagging you for status reports as to why the estate has not been closed.

Even if no taxes are owed to the IRS there are inheritance taxes to be paid by the estate and those would have been owed. The funeral expenses would be paid by the estate but if you paid them, you would file a claim and seek reimbursement. Since you are the only heir, I am not sure if it makes a whole lot of difference but reimbursing the funeral expenses will reduce the inheritance that you get and also reduce the percentage of taxes owed.

You really need to speak with a probate lawyer who practices in the county where the estate is pending. It would be worthwhile to pay the lawyer to review the file and see what has been done to date. If the estate was closed in error, it may need to be re-opened. If the estate is still open then inheritance tax returns would have to be filed; perhaps the probate attorney can assist with that if he/she also handles tax matters.

Once the estate is properly handled then you or the probate attorney can contact the escrow company and get the funds released.

Assuming its credit card or personal loan debt, the answer is no, if the surviving spouse did not apply for the debt as a co-borrower. The surviving spouse may be indirectly liable however. An estate may need probated for the deceased spouse. To the extent that the deceased spouse had probate assets, then the debts of the deceased spouse would have to be paid from the deceased spouse's estate before the surviving spouse or other heirs would receive their inheritance (other than the family allowance). However, not all assets are probate assets - like land held as a tenancy by the entireties, joint checking accounts or life insurance or an IRA/401(k).

If the debt was for medical expenses incurred in the last 6-12 months of debt or for things like nursing home care, then the answer may be yes. The deceased spouse's estate would be primarily liable for the debts, but to the extent there are outstanding medical bills then the medical provider might look to the surviving spouse who would be liable under the doctrine of necessaries as it exists in PA.

Please see a local probate attorney who practices in the county in which you reside to assist you with this before you decide to pay or not pay.

If the deceased spouse truly had no probate assets and the debt is only for something like a personal loan or credit card in the name of the deceased spouse only, then all that may be necessary is to send a certified letter to the creditor advising that the deceased spouse has passed away (send a copy of the death certificate) and that no estate will be probated as there are no assets justifying probate and that you as the survivor are not personally liable for this debt. That should be the end of the matter.

You state that you are 'going through divorce', so I do not know what you mean by that. Is a divorce in the court system? Are you and your spouse talking about getting a divorce? If I were in your situation, I definitely recommend that you confer privately with an attorney of your choosing about your issues with your spouse, particularly since you state that your spouse owes you money. The work of the attorney includes aiming to ensure that your rights are vigorously asserted and protected to the fullest extent possible under law, and that includes issues of debts that one (former) spouse owes to the other spouse. "Legal"? Yes and no. No, your Louisiana marriage ceremony did not constitute a valid ceremony for Texas purposes. However, this is actually one of the more legitimate (at least in my personal view) reasons for having common-law marriage. I would assume that you and your spouse believed at least initially that you were legally married, and that after this ceremony, the two of you announced to everyone that you were now married and referred to each other as husband and wife, considered yourselves to be married and have all the usual obligations toward each other that go along with marriage, and lived together as husband and wife. If all of that is true, then you are just as married as if you'd gotten married in a Texas ceremony by someone qualified to perform the ceremony. The downside to that, perhaps, is that yes--you really do need to get a divorce in the usual way.

Hello, I recently agreed to sell two 80s era Kenwood ham radio receivers to an individual out of state. The receivers belonged to my dad who passed away ten years ago. I'm not an expert with the radios and was selling them to help my mom. The buyer, whom I first dealt with to buy some power cables for these particular receivers runs a business restoring these old units. He had some questions about the receivers which I answered. All the problems I could find were disclosed to the buyer at which point he offered $450 plus shipping for both receivers. I felt that was low and asked for $650 plus shipping to which he agreed via email. All of our correspondence has been via email and I still have all of them. The buyer them asked for me to ship the receivers without payment, and stated that is how he usually handles buying used equipment. I asked for a good faith deposit of $150-200 before shipping and he sent $175. Once he received the receivers, he is now trying to back out of the agreement because they have more problems than he knew of. As stated I told him of all the problems I could find with my limited expertise. Is the original written agreement binding in a case where items are unseen?

He is now saying he would send them back to me and pay part of the overall shipping cost. I don't yet know how much that "part" would be.

As the old saying goes, "possession is 9/10ths of the law," and you have now placed an out of state party who is merely a potential buyer in possession, which is almost never a good idea unless the deal is nearly certain, or unless the items are easily recovered intact if the sale does not close. You should have dealt with the issue of return shipping in the event of refusal before you shipped the goods out of state to him (you could have requested a security deposit from him for such expenses). You could now argue or litigate with him over that expenses later, but the outcome would be uncertain, and he would retain possession of some valuable equipment in the interim. It would also be difficult if not impossible to sue anyone without spending more than the value of these items, even in state, much less out of state. You have allowed yourself to be placed over a barrel, and therefore now have very little practical choice other than to renegotiate a price that will close the deal. One item available in your negotiations would also be how well you will rate one another on the website used for the sale.

I have been paying child support for almost 14 years but it is now causing a financial and physical hardship on my family due to work changes since 2001. I had lost my career in 2001 and had no choice but to take what I could for 1/2 of what I was making. I live in TX but my primary support is in CA. I contacted the state several times and argued that I cannot pay what they are asking for due to the wages I make. They stated that since the children live in CA, I have to pay for CA support calculations. This makes no sense at all but went along and did the best I could. TX is enforcing the CA order and set the back-due payments at $250/mo + current support - which was all that I could afford. This was agreed upon in court, signed by a judge, and acknowledged by the OAG's office in CA. Now, and almost $85K in back-due support due to the amount that was being requested (and only could pay 70% of it throughout the years at 50% of my check being attached), there is only one child left and 9 months until the child support is done. However, CA has raised and is enforcing the back-due payments at $850/mo + current support ($450). Even at 55% of my check, I cannot pay the full amount...therefore going into more arrears every month - this has been the case since 2001 which explains the high back-due amount.

I am not in the best of health anymore, am needing surgery on an injured shoulder (has been for almost 2 years), need vehicle repairs, and am on the verge of loosing my apartment due to the financial burden the support order is placing me (and my family) on. They are threatening me with suspending my TXDL (which I drive 40 miles to work each day - no public transportation either), threatening to put me in jail, and take what they can on my assets (all of this is in a letter from the State of CA).

Keep in mind that I have put myself through school (BS/BA), work full-time, am a responsible tech at a large corporation, and take care of my children our here in TX (along with my step-son). My ex in CA has never worked since the day my children in CA were born, has basically lived off of my child support payments with her husband, was ordered to get "gainful employment" by the courts, has been in trouble for trying to pick up my children in CA drunk, showed up to court with a .06BA level, and is now going through a divorce where her husband is requesting child support from her.

Is there some precidence that can be used to protect myself and keep the state from forcing me into poverty, or is there an attorney in CA that could help me. I don't have a lot to give....but I can do do what I can.

Are you still active duty or have you been discharged?

If you are active duty - yes, there are some things that could be done.

If you are discharged, then the issue will be what kind of discharge you received and if it was related to the false drug allegation? Possibly you could use this information to seek a discharge upgrade.

A debt collector doesn't "freeze" a bank account. IF he has a judgment, he can garnish your bank account.

Filing a lawsuit is not the same as actually having a final judgment.

If you have no tax liability then you do not have to file a tax return. you should see what taxes you do owe and what deductions you are entitled to get back. It is not that difficult to do your own tax preparing and filing.

well you should have received a CD with your phone when you purchased it. By putting that into your computer you can add maybe a USB or download music off the internet. By opening up my computer you can transfer the music into the :Phone Playlist: section. This will enable music to be transferred onto your phone. You may have to try at least once or twice to be able to transfer the music.
If you did not receive the CD contact your nearest store and see if they can give you a CD for a reasonal price. They may charge alot for the single CD. Or ask a friend or someone you know with the same phone to download the CD's software onto another CD...they should do it free.
Sometimes the Motorola Rival needs to expand its memory and this can be acheived by buying a memory card...these range from the price of 20 and upwards (In rare cases). These steps for me worked so try them out.

The outcome likely will depend upon what's in the purchase agreement. Apparently you had through September 30th to cancel. I would say signing without having completed your due diligence was very risky (or foolish?), and you should have at least canceled or demanded a written extension of your right to cancel before 9/30. Now, the issues may boil down to whether the purchase agreement contains (1) an "integration clause" stating that it is the entire agreement of the parties and any prior or contemporary agreements, written or oral, are canceled and have no further force or effect (or wording to this general effect); and (2) language relating to the deposit making it subject to forfeiture as an estimate of the seller's damages (or similar language).

Also, was there anything in the agreement about buyer's due diligence? Does it say due diligence has been completed? Does it grant more time?

Is there anything in the agreement relating to mediation, arbitration, or attorney fees? Were you represented by an agent, or just the seller?

If you can provide me with the answers to tese questions (off-site and directly), I might be able to give you a better prognosis.

Unless your agreements required the agent to provide the documents you requested, you are going to have trouble cancelling and/or obtaining a refund. You really need to stop looking for advice on the internet and contact a local attorney who can go over the documentation with you and advise you based on a full understanding of the documentation and the transaction.

What was the order of death here? I need to know specifically when people died. I also need to know if your parents or brother had a will.

Assuming that everyone here lived in NC (your parents and sibling) and that nobody had a will, this would be as follows:

father's assets would pass to mother. She would get approximately 1/3 of the real property and the first $30,000 of property plus 1/3rd of the balance. However, this relates only to probate assets. Life insurance, joint bank accounts or land owned as a tenancy by the entireties with your father are all no-probate assets. The children would inherit the other 2/3 of real and personal property. When mother died, the children would then inherit whatever mother had left.

You indicate that a sibling died. If he died after the father but before the mother, his share of father's estate would pass as per his will or to his spouse (if any) and children in the same proportions (1/3rd to spouse and 2/3rd to children). When mother died, her share would pass to her 2 surviving children and the grandchildren would take the share of their deceased father.

However, if anyone had a will, then assets would pass as per the will.

If your father had a will, then he probably left all his assets to your mother. If the mother had a will, she may have left everything equally to her children. If one of her children died before her leaving 2 grandchildren, then the anti-lapse statute in NC provides that the grandchildren would inherit the share of their deceased parent, assuming that these children are the legitimate biological or adopted descendants of the mother and sibling who died.

Because this is such a complex question and depends on the order of death, whether the children are legitimate (or paternity was established if they are not) and whether anyone had a will, your best bet is to sit down with a probate attorney who practices in the county/state where your mother lived at the time of her death to definitively nail down who gets what.
