I have been fight for SSDI for almost 6 years. The firm that was assigned to me by my insurance company did not do a very good job. After 4 years of waiting I was given a hearing at which my assigned lawyer in the area did not represent me well. I wanted to question things during the hearing and he waved me off, these things I felt would have mattered in the judge's decision. Then I did not hear from them unless I called them about the appeal. I received a letter from SSDI three weeks ago regarding the appeal and waited to hear from them but never did, so I called them to find out what the information in the letter meant. Now, I believe I have been approved for benefits (and I once again had to call THEM), I am suppose to pay these people 25% or $6000 for their services. My question is, is there any way to fight this? I don't mind paying them a portion of that because they did file the paperwork needed to file and to appeal. If they kept in contact with me and showed me they cared about my case I would not have a problem with it, however, after not hearing from them for two years straight unless I called them, well I just don't think this arrangement is fair any longer.

I suggest that you talk with those attorneys directly about your dispute. However, $1500 for six years worth of representation does not sound unreasonable. Additionally, the reason why you hired them is for their expertise. Perhaps the lawyer had experience with that judgee and knew what he or she likes to hear and that is why your concerns were not presented.

Therefore, despite people thinking it is legal, it is not, and judges have found people guilty of possession because it violates federal law. There was a boom in head shops but now several have closed as it's not worth the risk until this gets sorted out in the appellate courts. This is true regardless of whether you have a prescription - still illegal due to he federal laws.

It really depends on what it is you want to prove, and whether subpoenaing the server's records would be worthwhile or cost-effective under all the circumstances. If you're trying to prove you weren't served properly, in most cases you are better off just responding to the lawsuit than trying to challenge the adequacy of service. However, one would have a valid lawsuit against a server who filed false proofs of service; if the damages were significant, in such a lawsuit one could theoretically subpoena the types of documents you mentioned. If the stakes were sufficiently high it might even be worthwhile to subpoena cell phone tower records that, of course, track the movements of every cell phone subscriber. I'm not aware that process servers are required to, or that they do, routinely log GPS coordinates. Some employers (for example trucking companies) do GPS-track their employees, so anything's possible. Consult a lawyer and watch out for legal time limits.

So what is the question? I don't understand if this was a school or an employer or both. You may have some defenses if you were not provided with information, but an attorney would need to see what you signed and whether the information was buried somewhere in the documents you signed. Ideas cannot be patented. If you invent a novel way to carry out that idea, you may be able to patent the invention. This does not mean you must actually build your invention, but it does mean you need fairly specific designs. (There are a few things that can be patented besides new inventions, but they seem to be beyond the scope of your question.)

I disagree wholeheartedly with whoever told you that mediation is a waste of time. Regardless of the validity of the claims you may have in your case, there is always a risk that you will lose, and mediation helps avoid those risks. Mediation is a non-binding effort by the parties, through the use of a neutral third-party (the mediator) to settle claims in your case and avoid any risks. The mediator has no authority to force you to take any amount of money as settlement. He/She can only try to get the parties to agree.

Of course, there are some mediations that are a waste of time, but the majority of them are not. Also, arbitration is much more like a trial and is generally binding on the parties. If the arbitrator rules against you, the case is over and you lose. I would personally rather have a jury decide my case than a single person.

Well, you could end up owing him (and his lawyer) a bunch of money in the wake of his lawsuit for breach of fiduciary duty. People who are in business together owe a legally-enforceable set of duties to each other and to the company. See, for example, Corporations Code section 17704.09(b)(3): "A member's duty of loyalty to a limited liability company and the other members is .... (3) to refrain from competing with a limited liability company in the conduct or winding up of the activities of the limited liability company."

An LLC can be dissolved by a court when the owners are deadlocked, as appears to be the case here, where you have two equal owners who cannot agree on how the LLC is to be managed and run. See Corporations Code section 17707.03(b)(4) allowing judicial dissolution when the LLC management is deadlocked or subject to internal dissention.

Another route that might be looked at is whether the LLC's organizational documents provide any ideas; e.g., perhaps the non-contributing member is in violation of his duties under a management agreement, or perhaps his ownership interest could be diluted below 50% by a capital call that he wouldn't respond to, or something else of this sort.

Finally, if the guy just isn't very interested in the company, you could offer him a buy-out or something of that sort -- it wouldn't have to be all cash up-front -- or see if he would be amenable to bringing in a third member (one that you could work with). There are a lot of possibilities that are better than going into competition, Making a final decision which way to go would require knowledge of the guy's personality, the depth of everybody's pockets, the size and prospects for the business, and other factors that can't be lifted from an on-line question. I do not believe that being behind on child support payments would be a deciding factor if relocation must be litigated, but I would need to do the legal research to be absolutley sure. I do know that the Judge would consider what is in the best interest of the children, and there is a presumption that it is in their best interests to have a meaningful relationship with both parents. In many relocation cases the parent who desires to move is allowed to do so as long as adequate provisions are made to assure significant and meaningful parenting time is enjoyed by the other parent. The seller told him that the transmission and engine were great but that the gas in it had gone bad from sitting too long, and for him to fill it up with high octane and drive it for a while to run the bad gas out. The car was still running terrible (constantly stalling out) so we took it to a mechanic. We thought it had something to do with the spark plugs and wires. The mechanic replaced the plugs and wires and some other minor things for $215 then told us the engine needed replaced and it would cost more than the car was worth. So we just brought it home. If all he filed was a paternity action and you have not been served with papers nor requested to participate in the discovery of paternity - then I would say he did not file anything and just told you that. If there is a record on file, then you can look it up at the court house. If there was a record at the court house you would have been advised as to having a DNA test done. Since I do not believe this is the case, leave. If he wishes to pursue in the next state , so be it.

You need at least an injunction to stop him from selling off marital assets. You also probably need a forensic accountant to go over all the books. Your attorney would line up the forensic accountant. Hire an attorney as soon as possible. You won't be entitled to a "do over" if things go badly. The judge/court is not going to act as your attorney. In Florida, with family law cases, depending on the parties' comparative financial resources, the Courts have the discretion to hold one party responsible for all, or part, of the other's attorney fees and costs. In other words, if the other party has significantly stronger financial resources, while you will still probably have to pay a retainer, do not assume that you will not be able to afford to retain an attorney. Reimbursement can be sought.
