The landlord upon knowing we were there raised the rent $600 from one day to the next. the other family is moving, so the landlord had us fill out an application. He told the other family we didn't qualify, and we would have to move out. ( He hasn't told us personally) How long legally does the landlord have to give us to find another place to rent?? Also, it is not clear to me from your question whether you are paying for the child who is living with you and is over 18. If you are, and if the child has graduated from high school or is not enrolled in an educational program, than you PROBABLY do not need to continue payments. If you owe past due support, or if a court order in your case says otherwise, than you should probably continue paying. Nothing can replace an in-person consultation with an attorney in these types of cases, so speak with someone who does family law in your area.

You were charged with speed competition. Probable cause is one of the standards that the officer can use as a basis to stop you. Yes, you should get an attorney. That charge is a fairly serious criminal traffic violation. Depending on the policies of the District Attorney in the district where you were charged, you may be able to enter into a plea bargain to resolve this matter favorably. Such a plea bargain may involve all, some or none of the following: paying a fine, attending a safe driving school and / or perform some community service - again depending on the policies of the DA. Also, often the officer's input is taken into consideration. ADA's are more likely to listen to your story and help you out if you were polite and cooperative with the officer involved. Of course you always have the option of going to trial but usually from a cost benefit analysis, it is less expensive to negotiate a plea bargain. Finally, this information is just the tip if the ice berg there are many other factors and options that a local attorney can make you aware of.

Even if no probate is required, the law requires the Will of someone who passes to be filed with the court within 10 days of their death.

Usually this is not a problem, even if filed after 10 days. However, if someone wants to press it there is a procedure to compel them to file it, and they can be charged for costs to do it.

The question is whether they are selling off probatable assets and defrauding creditors. Household items are not normally included because they often are exempt from creditors, but not always. If there are no probatable assets, then creditors are out of luck anyhow.

You need to be careful. As legal right under NJ law, no. Paying the rent upto 4:30 PM on the day of court would do it, but you are beyond that point. The LL can waive the eviction, however if you are going to try that, get it in writing.

The ultimate sanction is to have a lawyer file a contmpt petition against him, which could result in him going to jail, unitl he makes payments. Also, non-payment of child support is one of the few instances in PA where you can have his wages garnished. You need a good agressive lawyer who has experience in these kinds of cases.

This week I was notified that they had not calculated my escrow account accurately, forgetting to include the adjusted property taxes since my home was new last year when I purchased it. I was told that I would have to pay $2400. for Septembers taxes and then pay an additional $400 per month on my house payment/escrow. I had changed from Chase Mortgage 30 year fixed at 3.75% to a 20 year 3.87% fixed rate. The lender has offered to re-write the loan to 30 years and try to get my interest rate back to 3.75% to keep my payment at a reasonable level. My question is there anything else I can do? I was in the middle of purchasing a new vehicle which thankfully I was able to stop because of this mess and I'm wondering if I have any recourse....Turns out he is not "able" to move my rate back to 3.75% but rather keep it at 3.87% so now I am in a worse position that if I would have left it at chase. The reason I was refinancing was because I had added equity by completing a master suite and bath and was able to stop paying the PMI, while at the same time reducing my term to 20 years. Now I'm back at 30 with a higher interest rate and out the fees for the refinance process. Shouldn't they have to make me "whole" if you will?

I can understand how this would be frustrating. The problem is that you are responsible for the real estate taxes one way or another. It is possible someone made a mistake by not catching the increased tax amount sooner. However, consider if they had caught it sooner. You would have ended up paying the $2,400 as well as the extra $400 per month right out of the gate instead of it coming up after your closing, so you are now in the same position. In addition, it may be that the new tax amount just became available in the last week or two, so perhaps there is no error here at all. If you are interested in a more comprehensive answer, you would need to take all of your closing documents, as well as your disclosure documents, to a real estate attorney for review.

inherited property in equal parts along with 2 siblings, one of whom is the executor and lives out of town. The other sibling and myself occupy 2 of the 3 apartments in the building. Neither of us have paid rent to the Estate for several months, but I offered to pay rent from my share of the Estate savings account I would have after Probate. The 2 siblings decided to sell property, but I said I will not sell, and offered to buyout their shares if I could obtain funds, but this is uncertain. I received a letter from the Estate attorney stating the property is expected to sell soon and I should make preparations to vacate property within 30 days.

Can they begin an eviction action even though I am an heir and not a tenant ? I will refuse to sign any sale of property papers, but executor said they don't need my signature.

Also, they are planning to remove contents / furniture from my apartment I occupied with decedent, even thou I said I will purchase everything from my share of the Estate savings account. One third of contents belongs to me and I do not wish to sell. How can I stop them from removing or selling contents ?

In our divorce settlement I was also entitled to 7.5 years of the his retirement at the value when our divorce was final. I found out there was no QDRO filed at the time of my divorce so when I found out my ex was collecting his retirement I paid a firm in NV to file the QDRO as most law offices sub out this service. We have been working on this for months as Cal-Pers has been particular. A few weeks back we finally had an answer from Kings County CA and they state I need to now file a "joinder". The QDRO firm states they ahve never encountered this and send me the information on how to file the joinder. I have tried calling Kings County Clerk and get no answers other than they cannot give me legal advice nor do they tell me why I now need to file this. I am beyond understanding. Between that and trying to get help here in NV with my CA child support issues I don't know what to do. Here is what I am asking, Why if my divorce settlement clearly states I have a right to his Cal-Pers retirement do I now need to pay to file this joinder?

Second, how can I get someone to help me with my lack of payment on my child support and the 2.5 years of unpaid spousal support? The NV office tried to help me but twice had me fill out the wrong papers(supposedly since my ex lives in CA I must fill out different papers). Unfortunately, too many firms claiming to know something about QDROs really are form-peddlers who are clueless as to how the retirement plans, or State divorce law, actually work.

If, as it appears, the divorce was in CA, and the QDRO must be processed there, you do need to join the plan (this is an artifact of CA divorce law, not national ERISA-based QDRO rules). If you call our office, we will be able to refer you to an attorney who can handle the CalPERS issues, and and either advise you on the nonpayment of child and spousal support, or get you to someone who can.

How would it be used against you? There are no Heart-Balm causes of action in PA (actions for alienation of affection or criminal conversation). Do you have minor children? Do you have custody? Will they be exposed to someone you are just dating? This could conceivably affect any custody if that is an issue.

Will you be seeking alimony? If another man was cohabiting with you after a divorce this too could affect that. Otherwise, I don't see how you dating would be relevant.

PA still recognizes fault based divorces and adultery is one of the grounds for that, but I don't see how post-separation dating would translate into adultery during the marriage as it would not be the cause of any marital dissolution.

I suggest that you go and consult with a family law attorney. You will need one for the divorce and to help adjudicate any other issues like child custody/support, alimony or the division of your marital assets and debts.

Assuming the marriage is legal, the woman is going to have to go to domestic relations court and file papers. Probably divorce proceedings! The Court will most likely issue a restraining order and the man will have to move out.

The answer may not be that simple. It does depend on the facts. Your best bet is to talk directly to an attorney. If you have a prenuptial agreement it should be covered in that. If not-get one next time! Pre-nuptial agreements should be used more often than they are. If you have already been through a divorce, there is no excuse for DOING IT again without some protection!

On June 15, 2010 I was charged with felony 5th Degree Sale of Marijuana in Polk County, MN. I served electronic home monitoring and am currently on probation and in good standing with my probation and the courts.

However, my problem is that I've found it next to impossible to find work because of that wonderful little box on job applications that ask if you've ever been convicted of a felony while assuring you that checking yes will not bar you from employment; a bigger lie than Santa Claus.

I am just wondering if there is any way to sue an employer for discrimination for not hiring me solely on the basis of being a convicted felon. I recently submitted an application and resume to a car dealership who seemed very interested in me until they spoke to me about my felony. They told me on the phone as well as sent me an e-mail that they would not hire me solely because of this conviction.

This event as well as many other similar experiences just seem to be a ridiculous and unnecessary level of discrimination, and I would appreciate any advice as to how to do something about this legally, possibly through lawsuits as I won't be able to seal my criminal record until 2014. An attorney can charge for any work they do on your case since that is part of the retainer agreement, however the work to prepare a substitution of attorney form is minimal at best so I can't foresee a large charge at all. If you are looking for spousal support and the other side does not work, it may be difficult to get, you would need to argue to the court and convince the court that the money is not a gift but is actually income which he could use to pay you support. You should speak to the former attorney to see if you can work out your billing dispute, if it is patently unfair then you may speak to the state bar to see if they can help you with fee arbitration and try to work out the billing dispute. As long as the bill is reasonable for the work which was performed you may not be able to get much of your fees back.

The charges filed against me are two CC larceny and one Grand Larceny >=$200. This was on 4/10. I was picked up the very next day by the police, where the magistrate gave me copies of the three warrants, and the next morning I had a video arraignment, was granted a bond for $15k. I got a bondsman @10%, and the hearing is actually today. This entire time, I have been trying to get her to drop the charges, and settle out of court. Unfortunately, I have only just now (literally 15 minutes ago as i write this) to see if she would consider dropping the charges. Evidentally, they have been telling her this whole time that it is now out of her hands (which tells me that perhaps she was considering it in the first place), but she had learned that info second hand from unqualified people. Well, I finally got to speak to her and when she wakes up she is going to call her lawyer to find out what she can do about it.

My questions are basically 1) is it too late for her to attempt to contact the DA/prosecutor to have the charges dropped? 2) was/is there a time window for the DA/prosecutor (i dont know which one actually files the charges) to drop the charges? For example, does the district attorney have a cut off point where he can no longer do anything about it?

My trial date is on 5/10.

Please advise me, great expert! I cant afford to have felonies/jail/prison. I am sure we can all agree on that. What can I say to her to help keep her prepared for such a move?

You have to file a petition in the court where you were convicted to set aside your conviction.You do not tell us when you were convicted, what the charge was, etc. Was it a juvenile adjudication or an adult conviction? Some offenses / crimes cannot be set aside. You have to file an application in the court where you were adjudicated (juvenile case) or convicted (adult case). There will have to be a court hearing. This is not an automatic thing. For an adult case, you have to wait at least 5 yrs after your conviction. For a juvenile case, you have to wait until at least 1 year after your disposition (sentencing) on the juvenile case or until you turn 18, whichever is later. You have to submit your fingerprints to the State Police so it can check for other cases.

You likely have a common law trademark in the name in the Richmond area ( assuming you did not register the mark). If they are in the same area, you can bring suit to force them to stop using the name (if necessary - often a letter works to get them to stop).

the compressor on all vehicles has a clutch which is activated by a solenoid that draws it in. that solenoid does not receive power until the engine and computer have run long enough to stabilize operations...generally 3-5 seconds. now on older vehicles (1950-1979) i am not 100% on their operations. in any case they won't operate until the voltage regulator stabilizes the power. it is not a mechanical engagement. therefore, again, no it will absolutely not blow your compressor.

even if it some how were to be stuck engaged and you started your engine unless there is a malfunction in the system it would still be just fine. it is a sealed system containing its own oil. failure by start-up is not possible.

Impossible to answer your questions without seeing the paperwork. Remember the five year period starts from the date the last payment was due on your mortgage. Did they issue a satisfaction of the mortgage? If so, then you likely are OK.

If you want to disinherit your children, you may do so. Leaving them $1.00 is, in my view, not very smart. You will leave behind a lot of hurt feelings which, if you're deceased, cannot be undone. It would be better for you to state simply that you are choosing not to make any provision for your children or wish to disinherit them for your own personal reasons.

However the choice is yours. You also can add an "in terrorem" (in terror) clause which says that if anyone contests your will they cannot inherit. However, these clauses do not prevent people from challenging a will if they have valid grounds, so in my view, they are not all that effective. You can accomplish the same result by disinheriting the beneficiary and by making sure that no possible grounds to challenge the will would exist. Typically, grounds exist where the person who made the will (the testator) either lacked mental capacity or some type of fraud or undue influence existed. If no grounds exist, then a beneficiary is not likely to file a will caveat - caveats cost money and it has to be worth it. No beneficiary is going to spend money when there is little chance that they will win.

Getting back to your problem - you can try a do-it-yourself kit from www.nolo.com or some other service. I am not endorsing these products. While they may or may not be fine for you, you could screw it up in trying to draft your own will. Further, these kits are usually meant for uncomplicated situations. You are trying to disinherit your children which is a complicating factor.

You can do a couple of things - try one of Attorney Jacobson's suggestions. There are lawyers who will provide you a service pro bono (for free) or at reduced costs. Wills should not cost all that much anyway. Shop around - prices can vary. If you only want to disinherit your children but leave all else the same, consider a codicil to your will. Perhaps that will be cheaper. But ask the attorney how much they would charge for a codicil as opposed to a whole new will. A caution about codicils - usually these must be executed with the same formality as your original will and unless the change is minor, I recommend just doing a whole new will.

If you are really strapped, look at your old will. If it was done correctly, you can copy some of the old language and just change the part regarding distribution of your assets to reflect that you are disinheriting your children and name the new beneficiaries. This is my least favorite option and unless you are exceptionally savvy about what you are doing, it will be better for you to seek out legal counsel. Further, the laws may have changed or prior counsel may have erred. For this reason, its better to get a lawyer to look it over and make the changes for you. You don't want to leave your beneficiaries the unintended legacy of an expensive lawsuit by trying to save a few dollars.

Without knowing any other facts, it stands to reason that the Cabinet wants the child out of your care because your son is about to be released from prison, since the dates coincide. In 2009/2010 a gentleman forged my signature stating that I quick claim deeded the house to him. I have been renting since 2008. The guy who frauded my signature was tried and pleaded guilty. The taxes on the property have escalated to over $23,000. The house still has not forclosed; someone is still living in the home, if I am still the legal owner who do I contact to help me get the people out and sell the home or move back in it. There seems to be a few steps in this process and I would certainly recommend you meet with an attorney and bring any legal documents in your possession. The first thing I would recommend is obtaining a title search to see who is claiming they own your property. If you are the last recorded owner then you can simply file a lawsuit in district court to evict whoever is unlawfully living in your home. Once an Order is granted, the local law enforcment can remove the unlawful persons from the Property.

We originally though we would have pay a $1300 initation fee, but we were informed THREE OR FOUR times that if we had been members previously and had paid that fee, all we would have to pay now is the monthly fee. We were jumping up and down that day.

We called today to join, and some twenty year old answered. She said we had to pay $25/month since we left or the $1300 initiation fee. We told them we were informed differently just last week. They said, "we're sorry". ***Note that the acting manager we talked to last week was 100% POSITIVE we wouldn't have to pay any fees.

We asked to talk to the REAL manager, but he's off right now. He'll give us a call. Can we threaten to take legal action? Can we demand it? How about a meeting with the employee we talked to last week with the actual manager.

This is not a legal ethics or anything. As a private company they can make offers and revoke them unless you accept or rely upon them. Unless they advertised it there probably is nothing you really can recover because you didn't accept the offer when made.

The debts shall survive the filling of any petition in bankruptcy by either party, weather voluntary or involuntary, and all proceedings taken thereunder, as well as general assignment for the benefit or creditors or other proceedings base on insolvency, and claims hereunder shall at all times remain in full force and effect and enforceable until performed and discharged in accordance with the terms of this Agreement, The parties further specifically intend any hold harmless or debt agreement to be in the nature of the payment of alimony or spousal support and shall not be dischargeable in bankruptcy as it is not a division or property or a property settlement. Such a duty arising hereunder is the enforcement of a marital duty in accord with public policy.

The debtor spouse currently has the financial ability to meet his or her obligations under this Property Settlement Agreement and that the needs of the creditor spouse and children outweigh the burden on the debtor spouse of satisfying the obligations.

The creditor spouse shall be entitled to attorney's fees and cost incurred in protecting his or her right to support in a bankruptcy proceeding and if he or she substantially prevails, in a non-dischargeability claim.

The debtor spouse shall continue to perform his or her non=support obligations under this Property Settlement Agreement until there has been a determination that such obligations are dischargeable.

So I would like to see if I can still file now because I need to file ASAP and I will be getting money from her 403 retirement account so will that hurt this matter when I get the money. If you can explain if I can file now or not being that I an going thru an divorce now.

Or see if the judge would accept an Alford plea. That us a type of plea where the defendant agrees to take the penalty without a formal admission of guilt.

Keep in mind that innocent people can be wrongly convicted. If the case against you is strong, taking a CWOF and avoiding the conviction may be a good option. On the other hand, being found not guilty after trial allows you to move to seal you record immediately. In the end, the decision to plea or go to trial is yours and yours alone. Balance the risks versus rewards with your attorney.

Most employers prefer American Society of Engineers (ASE) certified mechanics or "Automotive Technicians" as they like to be called :) but from what I've encountered you could be a retard and still be able to get a mechanic job if you find someone to hire you, doesn't mean you'll get hired by big dealers/auto shops, or get paid the same as an ASE certified person. Hell you don't even have to speak English or have papers either ,just have a toolbox and a car with a sign that says "Oto Mekanyk i com to you house" true story :) ,

In Texas... as far as the auto shop you still have to comply with local licensing laws forexample chemical and hazardous material recycling, like engine oil, tranny fluid, register your business and pay your taxes, employees etc etc but employees/mechanics don't have to have any certification or school degrees whatsoever if they can prove to the boss they know what they're doing. You only need an inspection license to do car emission/safety inspection stickers, and you need to have a license and special equipment to work on certain year model Air conditioning systems using R22 freon.
