I don't see why Mr. Kohler thinks who owns the mower matters. What matters from a legal standpoint is whether the gardener failed to exercise ordinary reasonable care under the circumstances and how the rock got there. Fault may be apportioned too. For example, my toddler leaves things in the lawn all the time, including rocks. So if this happened in my yard, and I knew the kid had been throwing rocks and the gardener didn't, it would probably be my fault, and I'd just thank goodness it hit my window and not one of the other gardening crew, because then I'd surely be sued. On the other hand if the rock was obviously in the way of the mower, and the gardener just decided to run over it thinking it wouldn't matter, he is probably liable. If the kid put the rock there and the gardener ignored it, liability would be allocated on some percentage between him and me.

You bought your truck 11 years ago and you still had a vehicle loan? What kind of vehicle was this? A semi?

My focus is on consumer transactions not commercial. If this was for a tractor trailer, it might be wise for you to consult a local attorney. Even if this is consumer loan, you may have some defenses which have to be raised in a proper answer. Answers have to be filed within 30 days after you receive the summons and complaint.

If you have no defenses to the action and if money is tight, you may want to consider spending your money on a bankruptcy attorney instead. I don't know what assets and debts you have, but you want to see whether you qualify for a chapter 7 or 13. Of course, it would depend on whether this is your only debt and your other circumstances.

You don't ask any questions really. I would need to see the loan paperwork, but the lender may have the right to "accelerate" the debt and demand the entire unpaid balance, not just the past due amount. If this is the case, the lender does not have to accept what you offered and your options would have been to refinance the vehicle or file bankruptcy if you wanted to keep the vehicle.

The vehicle was evidently not redeemed and it was sold. Usually the vehicles are sold at an auto auction and bring in a lot less than the balance. I also don't know how long it has been since the sale and demand for money. The loan agreement may have allowed the lender to charge pre-judgment interest and it is conceivable that if you did not pay, that the balance grew from $5000 to $10,000 again.

As an alernative to bankruptcy, have you tried to contact the lender and see if they will settle? Most debts settle for between 50% and 80%. If you do not have the funds, I am not a fan of making payments unless you have assets that can be seized. If you don't have much in the way of assets and are "judgment proof" then save up your money and try to resolve this when you have at least 50% of whatever the balance has grown to. Judgments earn interest at a rate of 8% per year in NC. If the creditor wants more than 50%, see if you can use whatever you save up as a down payment and pay out the balance over 1-12 months. Some creditors will not let you pay out like this and if that is the case, keep saving till you can pay in a lump sum. It is important that if you are able to resolve the debt in this manner that you get a writing from the lender before you pay a penny. If you want to resolve the debt and have the funds but would prefer not to do it yourself, I can assist you for a reasonable fee. I will be happy to review your circumstances for free via email. Since you were not at fault so no points will be assessed against you, contact your insurance company and have them go after her. If they will not get back any deductible they charge you, then you will have to sue her in Small Claims Court. Or you can give her one last call and tell her she can pay in one lump sum or be sued and have to pay the filing fees and your expenses. You will have problems collecting from her so it is better to make the claim with your insurance company.

Just for the record, I shower every morning before work and use deodorant/light perfume.

I can list many many things he has done or caused to be done in the past 10 years. I have reported this time and time again, but because they do not do it when anyone is around that is not part of the group, and they always have a different story, it never seems to go anywhere.

last week, i was in the office and bumped into a co-workers mouse and when her computer screen lit up it was on her email. i normally would just close the window/computer down but noticed my name being mentioned and curiosity took over. there was email after email between this co-worker and my supervisor stating that i stink, no one at my table in the break room had washed our A$$es in weeks, that my hair is disgusting, laughing at the boots i wear, and even about my where abouts and time punches. i had been ill that morning and they were talking about that i was faking being ill but that i was SICK looking.... very degrading comments about the fact that i live in a mobile home.... and the list goes on....

It might be good to raise this with the union higher-ups.

The personal statements made between the workers is on company computers and company property and is part of the company's assets, they are not personal to the writers as they are done on the office computers. The liability on your part for viewing and recording them would be under the control of the company, its handbook, directives or other supervisory materials. Though I don't think it improper for you to look at the email left open, it seems to be bad form to look through your co-workers other emails unless you are that persons supervisor. on the other hand those comments and the actions of the workers does create a bad work environment and it is upon the company to correct it. Without further facts or review of company policies I cannot say if what you did was legally wrong.

However as shop steward reporting the personal comments to the company does put you in an awkward position as your job is to protect all workers jobs. It is a moral dilemma that I cannot provide further guidance on.

As a result of everything, on top of his prior charges of assault he now has battery and domestic violence charges and is currently in jail. DCF has gotten involved. DCF could theoretically get involved and try to say that you are failing to protect your child from domestic violence. While that is a very difficult thing to do sometimes, it is possible.

Keep in mind simply by calling the state attorney's office doesn't guarantee that the charges will be dropped. He needs a lawyer.

The statute says the DMV will not reinstate your license until you do the program. The DMV is bound by the statute. To work out how much current is drawn you need to divide the Watts by the Volts. Depending on where you are the volts will be either 240V or 120V. You would need to allow for some head room.

So, in the UK: 600 Watts / 240 Volts = 2.5 Amps (so a 3 amp fuse should be fine)
In the US: 600 Watts / 120 Volts = 5 Amps (so a 5 amp fuse won't give you any headroom - which might be okay if you keep the volume low :)

In almost any motor vehicle, engine oil is checked by examining the oil level indicated on a removable dipstick. With the vehicle stopped, secure from movement, and engine OFF for at least a minute or two, open the engine compartment (usually the hood) and locate the dipstick handle. This handle is usually a loop of metal or plastic, often colored, extending slightly from a dip tube near the engine block. (There are other dipsticks in the engine compartment; the one you want should be the highest and most reachable. If not certain which is the crankcase oil dipstick, consult the vehicle manual.)With a paper towel or rag in one hand, remove the dipstick with the other and wipe off any oil clinging to the rod. Note near the bottom of the stick a patterned indicator area or a pair of indicator marks perhaps an inch apart. This area represents the acceptable oil level range. Now reinsert the stick, being certain to seat it fully. Immediately remove it again and hold it horizontally so you can see the indicator area and so the oil on the stick doesn't flow. You should see oil clinging to the bottom of the stick up to a point, showing you exactly the engine crankcase oil level.If the level is within the range, all is good. If the level is at or near the bottom of the range, remove the oil-fill cap and add one quart of oil. If the level is a little below the bottom of the range, one quart will still be enough to bring the level within the range. If no oil seems to be showing on the stick at all, carefully retry the test. If still no oil is seen, then the oil level is very low, and the addition of more than a quart of oil might be necessary. To be safe, recheck the level after adding oil. Of course, replace and fully seat the dipstick and replace the oil-fill cap before starting the engine.

The general rule in California is that you must sue the defendant: (a) where the defendant resides (in this case PA); (b) where the contract was to be performed (also PA); or (c) where the real property in disute is located (in this case not applicable since the action does not relate to California real property). You could always sue him in Small Claims Court in California and make your argument that the contract was made in California. Since you are only claiming $2,083.00 the only down-side to such a lawsuit would be that you would have lost your relatively small filing fee and the fee you paid to a process server to serve the owner in PA. Your other option would be to find a lawyer in PA to sue the owner in a PA court.

I have received two emails from Stacy Papachristos (IpAssure). Maybe you've heard of her. Telling me that I need to forfeit all my profit, stock, etc. or her client will proceed further legal actions.

She called and i told her i had not sold any and have no stock, (both true), she said she has record of me selling 75 sets on ebay. I faxed her a pdf of my paypal sales which shows none sold.

She now says that I must pay $400 in legal fees.

The facts that her website is terrible, there have been misspellings in emails, she literally copies and pastes emails from other people selling bose headphones, and she accused me of selling 75 make me think she is just extorting.

Yesterday I was on a beach with 5 other people when two cops approached us and asked for ID's. All 5 of the other individuals had a beer in front of them, however I clearly did not. The officers were nice and simply said: having a beer at the beach is not a problem if you put it in a cup or other non-identifiable container. However, the officers wrote only 2 tickets: to myself and another friend. He said that he did not want to write tickets for women (the other 4 friends were female). Since I had no alcohol near me and a friend of mine knew of my outstanding ACD she offered that the officer instead write her the ticket. The officer assured me several times that the violation (in Queens) would not affect my ACD (in Manhattan), and proceeded to write me a ticket. I am a PhD student. I apply and am funded primarily through federal avenues. I am also not sure what positions I may be applying to in the future so maintaining a clean record is of great interest to me.

To be clear, I had a drink earlier that day (never out a marked container of alcohol). I was by no means intoxicated and had no drink by me when the officers approached. Another thing to note is that I literally cannot read the title of offense.

My question is: Should I simple mail in the guilty plea and save time, and perhaps money? Or is it worth attempting to get this dismissed? I am somewhat confused about the timeline for being able to see the officer's actual allegations. I am under the impression that the content of the allegations largely determine whether a dismissal is likely.

You need to understand the legal reason the court gave for denying your modification. Because of your (quite) substantial change in circumstances, the court should have allowed you to make smaller payments within your means. There has to be something not stated here. Once you know what it is, you can work on eliminating the obstacle.

Because this is a rather difficult situation, I would strongly recommend that you do your best to have representation. Try finding an attorney who will accept payments or credit cards. There is also an organization specializing in helping fathers/men. Do a search. You can also try to find an attorney who wil charge a flat fee but in any case, not all lawyers charge $300 an hour.

Texas "justice" is at work. Yes, the DWI - not DUI, can be "enhanced" to a third degree felony. Depending upon previous felony convictions, the case can be enhanced to a second degree felony.

I have insurance coverage up to 100,000 for bodily injury and earn 56,000 per year (pre-tax.) However, in the last tax year I filed for insolvency. I do not own a home and do not have the title to my car. As I am still paying off debt (especially student debt!), I continue to live hand-to-mouth. If you filed bankruptcy after the accident and were not intoxicated when the accident occurred, the debt may be discharged in the bankruptcy. Effectively this would limit your liability to your insurance coverage. See your bankruptcy attorney.

If the case is settled, your liability is likely to be settled for an amount that is not greater than the insurance coverage as the carrier is probably going to require a release before it cuts a check.

It may not matter what your mother's will said in this regard. This language may or may not be relevant. I would need to see the entire will to know if this is merely wishful language or a binding requirement.

The important question is who inherited the land? If the land went entirely to your sister, then your mother's thoughts are irrelevant. They are not going to be binding. If you and your sister (as well as any other siblings) inherited the land equally, then that is an entirely different issue. You all have a right to possess and enjoy the property. If one of you is excluding another beneficiary from the home then any one of you can bring what is called a partition action and can force a sale of the property or require the beneficiary who wants the land to buy out the shares of those who don't.

I would suggest that you consult a real estate litigation attorney in the county/state where the land is located. Allow the attorney to review the will and see what the best course of action should be.

In PA, assuming this is something like a credit card debt, you cannot be put in jail.

Depending on the circumstances of the debt, the most likely scenario is that they can sue you civilly and recover a judgment. Once a lawsuit is file, that exposes you to even more costs so it would be better to resolve now if you can. PA has some unique exemptions and depending on your circumstances, assets may or may not be at risk, including your bank account.

You indicate that this as an NJ collections law firm. There are several that I am familiar with -Hayt, Hayt & Landau, Apothaker & Associates, Nudelman, Klemm & Golub. All of these have PA-licensed attorneys and all of them can and will sue.

What you do depends. If you have a valid statute of limitations defense, maybe you do not even try to settle and wait and see if they sue. If that happens, you would then hire an attorney to assert the statute of limitations on your behal.

If you want to settle, that is admirable. But don't do this without consulting an attorney first. If you settle and the debt is barred by the statute of limitations, you run the risk of reviving the debt. And even if you don't have a statute of limitations issue, if you don't get a settlement letter and keep it, then the creditor can always sell off the debt and you will have to pay again.

I agree with Ms. Hunter's assessment but would add a couple important points. If the creditor that is collecting, as opposed to the lawyer they are using, is not the original creditor, you may have a good defense.
