The marital home is in my husbands name I can't afford the mortgage on the home myself unless my husband was to refinance it so the kids and I could stay the lawyers have asked him to refinance it he does not want to do that can the court order him to do that or do we have to sell it.

If you have an attorney, it is curious that you don't ask counsel these questions. Discuss the matter with your attorney, (s)he knows more about the situation than any other attorney MAY know.
