If a house is left to 3 siblings, can the executor sale it to pay medicaid?



Answer

If Medicaid is in the picture and the homeowner is deceased, then the executor would have no choice but to satisfy Medicaid's lien. If the homeowner is still alive but in a nursing home, the family should've been visiting with an Elder Law attorney long before now to learn how to save the house from loss. It is never too late but you lose many options by waiting to long.
