I've filed for divorce pro se with the court. My spouse was served with the original complaint and the 21 days have passed for him to respond. I've mailed all of the necessary forms to the court to request a hearing date except the Final Decree because I don't know how to do that. The court sent it back to me stating that they need the final decree. The only form I can find on the courts website that pertains to any type of 'Decree' is the Decree of Reference. Is this the same as the final decree?? I'm at a loss as to where to find this information, as it was not in the Uncontested Divorce Manual on the courts website.

No, what you need is not the decree of reference. Try another circuit court
clerk's office and/or website and you should be able to find a form for
a final divorce decree in the forms/instructions packet for pro se divorce that I mentioned in my previous answer.

You CAN go all the way back (15 years), depending on certain factors.
You'll want to look at the Texas Family Code sections 160.636(g) and (h) and at section 154.131.
Section 154.131 says that:
(b) In ordering retroactive child support, the court shall
consider the net resources of the obligor during the relevant time
period and whether:
(1) the mother of the child had made any previous
attempts to notify the obligor of his paternity or probable
paternity;
(2) the obligor had knowledge of his paternity or
probable paternity;
(3) the order of retroactive child support will impose
an undue financial hardship on the obligor or the obligor's family;
and
(4) the obligor has provided actual support or other
necessaries before the filing of the action.
(c) It is presumed that a court order limiting the amount of
retroactive child support to an amount that does not exceed the
total amount of support that would have been due for the four years
preceding the date the petition seeking support was filed is
reasonable and in the best interest of the child.
(d) The presumption created under this section may be
rebutted by evidence that the obligor:
(1) knew or should have known that the obligor was the
father of the child for whom support is sought; and
(2) sought to avoid the establishment of a support
obligation to the child.
In other words, there is a PRESUMPTION that the Judge goes back only four years (when ordering retroactive child support), but you can put on evidence that will rebut the presumption (and get more money).
I have personally been involved in a case where the Judge order 15 years' worth of retroactive child support.
You'll want to try to get evidence of Dad's earnings for the past 15 years. Retro is based on how much he actually earned.

In most instances, these things are located by mailings to the decedent. Bank accounts usually have monthly statements mailed to the decedents address. Forwarding mail to the representative is the usual practice. Life insurance sends invoices if premiums are due, and usually sends annual reports if not. Both types of matters can also in most cases be determined by reference to the decedents last income tax return, the decedants checkbook and the decedants personal records.

You are right. The only thing you might want to consider, for your OWN sake, is that while you do have until that last moment to vacate, clean out, etc., that leaves NO time for the landlord to ok the condition and then your security deposit is held over until after you're gone. I do recommend that if you can arrange it, a move-out a day or two before the end of the lease as long as the landlord is willing to do a move-out inspection AND return your security deposit too. And the inspection should have a move-out checklist and sign-off by yourselves and the landlord. That way if the landlord wants to be cute and stop payment on a security deposit refund that is paid by check (most won't do cash....), you can show that the landlord ok'd the condition in person.

Now the lender comes back from underwriting saying that the association let their FHA status expire 2 years ago! So my loan is no good for the condo purchase. I was suppose to close in 3 weeks. I hope your contract provides for a financing contingency for an FHA loan, because if it is impossible to get on this building, your only option may be to terminate IF the contract still gives you that out. Apparently you decided to proceed without an attorney; now is NOT too late to get one involved. Closing in 3 weeks sounds highly unlikely even if the building could get a current approval. As to damages for the misrepresentations about whether the building is approved, that is highly unlikely unless you have them in writing.

Your question doesn't explain what happened, either at the time of your arrest or in court. It isn't even clear that you've been to court yet.
Whatever may have happened, "temporary lapse in judgment" is not a defense in the trial court or a ground for appeal. If they don't, you will have sat in jail in the meantime, and face the possibility of this happening over and over. If they do, there will be trouble when you get back there.

The judge was clearly inaccurate on, without exaggeration, at minimum of 70% of his factual account from the record and he also was lawfully incorrect on some issues. It was a horribly written decision. He chose to not agree with arbitrator but the previous hearings officers report which we proved to be incorrect. Overall it is just a very messy arbitration and decision by a superior court judge. My question is that is there anywhere where I could research inaccurate decisions by superior court judges and is it immediate grounds for a reversal of the superior court decision based on his inaccurate factual accounts and errors of law? It depends on how he transferred the property. At the time, his will was not in effect. If the condo was properly transferred, then there is not an interest in the condo that would go through the will unless he kept his name on the deed. If he did, then his interest may transfer to his children through the will's provision as part of the probate process. To answer your question thoroughly and accurately, an attorney would need to inspect the title to the property and the time that the events took place.
Lastly, "personal" property does not include land, houses, condos. Those items are considered "real" property. Personal property are assets such as money, stock, furniture, jewelry, clothing, etc.

What do you mean by your stepmother has "allowed" your father to remain in an unmarked grave? Funeral & burial costs are the responsibility of your father's estate. Who is the estate executor? Is it your stepmother? Does she have the funds? If she does not have the funds, why haven't the children stepped up? Even if the stepmother has the funds and is the executor of the estate, is there anything which precludes the children from getting the money together and getting a suitable grave marker for your father?
What does your father's will or any other documents say about this, if you know? Some people do not want fancy burials and perhaps this is what your father would have wanted. I don't know.
In answer to your question, I would want to see any will, living will or other document articulating your father's wishes, if there is such a document. If there is not and no arrangements were made prior to your father's death, then it would fall to the surviving family members. I still don't see why any interested family member can't make a deal with the cemetary to pay for a gravestone.
I am not sure why your stepmother would need any of the children's consent to do anything. She was the wife. If she is the person who dealt with the cemetary, then I don't see any prohibitions on her exhuming your father's body and moving him to another cemetary. I also don't see any prohibitions on any of the children doing likewise.
I checked the PA statutes briefly (assuming your father is buried in PA) and I did not see anything therein directly addressing the situation. My advice would be that if you and your stepmother cannot all get along and work out whatever is causing the dispute, then the only alternative would be to file some kind of petition in the courts and get a court decree - perhaps an injunction to prevent his removal? In such case, you should contact local counsel, preferably a probate litigation attorney as he or she may be more familiar with this type of situation.

The best advise I can give you is to get a lawyer. Don't take this in the wrong way, but it is clear from your question that you are not knowledgeable enough about the law to successfully prosecute a lawsuit in District Court.
If you cannot afford to retain a lawyer consider seeking out legal programs that offer lawyers to the indigent AND/OR try to find a lawyer who will agree to take on the case with a contingency agreement.

Hmmm. Is your situation one of those unfortunate cases where you were removed from title in order for your husband to qualify for a larger reverse mortgage? Or are you still an owner or the owner? Perhaps you weren't "on title" in the first place?
By the way, I'm doubtful that it would have been possible to "put your name on it" even if that was your hope and intention.
In order to see whether there's any easy solution, we'd need to know (1) who were the owners before the reverse mortgage, i.e., how was title held; (2) were you removed from title as part of the process of qualifying for the reverse mortgage; (3) who is "on title" now that your husband has passed away (i.e., did you inherit the house?); and (4) what is the current balance due and current fair market value of the property.
Also, have you been contacted by the lender yet? I assume the lender is aware of the fact that your husband has passed away -- they do check on that periodically.

I'm sure there must be some facts you have left out -- your reaction to your roommate writing a check that bounced was to call the police? That's a little dramatic/overkill -- did you give him an opportunity to make the situation right before you got the police involved? Regardless . . .
Is your roommate on the lease? If so, he has possessory rights to the property and only the landlord can "kick him out". If you paid your ex-roommate's portion of the rent, your only recourse is to sue him for it. You cannot sell his stuff without risking a lawsuit against you for theft/conversion and I would not throw it away either. Instead, I would communicate the situation to your landlord and ask the landlord to take the appropriate legal action to evict the roommate. Offer to pay the landlord the dead-beat roommate's share of rent until you can find a new roommate to take his spot and your landlord should be happy to oblige. Once the landlord completes the eviction process against your ex-roommate, the sheriff can put your ex-roommate's stuff out on the street for either your roommate or the trash man to pick up.

Is the potential buyer legally able to file a claim against us for not providing a disclosure statement even though she never purchased the house and we didn't go to settlement? Also, what is the difference between an agreement of sale and an agreement of transfer? We did sign a contract of sale with the lendor but an agreement of transfer was not signed. A judgment is not necessarily a lien against real estate. Judgments that are entered in the Special Civil Part in New Jersey do not become liens on real estate unless they are docketed. Then they automatically become liens. Judgments in the Law Division becomes liens.

Many counties have put their liens and mortgages on the Internet so a search at the County web site might be a good start. A "legal separation" is an option for parties who do not want to be together, but do not want to get divorced. A "legal separation" is not required for a petition of dissolution, but has different residency requirements. For example, parties may not meet the residency requirements for a dissolution of marriage, but would for a legal separation. The law allows them to first file for legal separation, and then convert the case to a divorce case when the residency requirements have been met.
You may also be confusing "legal separation" with physical separation. A physical separation is when the parties live apart with the intent to remain apart indefinitely. This kind of separation is important, because it determines whether assets are separate property or community property.

It's not clear to me exactly what happened here. If his rights were terminated by a default judgment following publication by notice he can move for what's called a rule 60 motion to overturn the judgment, if he were successful then you would have a trial as if he had answered the original petition. Success on such a motion is hard to predict. If his rights were terminated in an earlier action he may have less recourse. Talk to your lawyer.

As a Franchise Attorney I can only say it depends on what they consider "wholly owned." And there's also the question of whether the financials state the financial position on a consolidated basis, even if it's a wholly owned subsidiary. If not, you're not getting the true picture because it's mixed up with the parent's financials. Consult with a good business or franchise attorney in your area for specific advice.

You can't. The bank wasn't a party to the divorce, and I'm assuming they weren't a party to the later transaction, where you gave up your rights to the house. The only ways to get your name off: (1) your ex refinances the house in his name alone or (2) your ex sells the house.

First, if a lender holds two deeds of trust on an investment property (the first being a $300,000 note to purchase and the second for $200,000 for a HELOC) then can the bank obtain any deficiency judgment after completing a non-judicial foreclosure on the second or first when I defaulted on both? The bank is foreclosing under the junior lien (the HELOC loan). I know for certain that under CCP 580(d) no deficiency will be allowed for the junior lien, but I'm not certain about the senior lien that the bank owns as well. Could they obtain a deficiency judgment on the senior lien? Secondly, I owe a substantial amount in back property taxes on this property (about $25,000) from the last several years. I've been unable to pay these amounts because of financial problems. I have taken massive losses each year over the last five years. However, I do have other assets and properties that I own free and clear. I used a lot of my savings trying to make my mortgage payments but those have been depleted as well. Once my tenants stopped paying I couldn't even make my mortgage payments. I'm worried about a bad faith action against the bank after foreclosure. I'm worried that they may try to argue by saying something to the effect of: "hey, he could of sold his other houses and paid the property taxes." Lastly, I've read that suing for bad faith action is under tort law. Would the bank be permitted to obtain a prejudgment lien on my other properties if they decided to sue? If so, how likely would it be? To my understanding they would have to convince the court that they have a pretty solid case. Any advice would be greatly appreciated.

The answer to your first question is "no." Under Simon v. Superior Court a bank holding two deeds of trust and two loans cannot foreclose on one and then sue for deficiency on the other. Your concern about the property taxes is misplaced. When a lender forecloses on a property they take responsibility for any tax liens without recourse against the borrower. I also have no idea what you are talking about regarding a bad-faith lawsuit. The tort of bad-faith is a cause of action that insureds bring against insurance companies for wrongful denial of claims. It has nothing to do with borrowers and lenders.

I agree with Mr. McCormick. A lender is not considered frozen out when they hold both the first and second deeds of trust, and is not permitted to obtain a judgment on one of the notes. Bad faith actions are between insurers and their insureds, not in situations involving deeds of trust and secured property transactions.

I'd be inclined to say that suing the inspector would be futile, for the following reasons:
(1) Home inspector contracts are carefully written by attorneys who are fully familiar with the litigation issues home inspectors are often forced to face......the contracts are full of limitations on liability couched in all kinds of terminology.
(2) Lack of power to an outlet in the pumphouse is not something the inspector would determine during the normal course of a proper inspection. Sure, lack of power to the pump itself is something an inspector should catch ..... but I doubt there is any negligence involved when the inspector fails to stick his neon voltage-checker in every outlet, especially in an outbuilding. (I have a pumphouse on my property ...... it has electric lighting, but I can't recall ever noticing whether there were electric outlets.)
(3) Direct-burial of low-voltage (115/230 volt) cables can be entirely proper......it depends upon the type of cable used. If it is Type UF, it's probably permissible under the Uniform Electrical Code and Underwriters' Lab requirements (UF stands for "underground feeder"). Now, since I'm a lawyer, not an electrical contractor, and I haven't seen your installation, I'd be hesitant to say that this particular direct-burial installation is up-to-code ..... but it might be.

You state that the "decedent" never brought his father's will to probate. Based on your question, the decedent is the father and I assume that the grandfather's will was never probated. Yes, the grandfather's estate (whether testate or intestate) would have to be probated to transfer the property to the proper beneficiary (which you seem to indicate was the father). Simultaineously, the father's estate could be probated with (if appropriate) listing the grandfather's real property as part of the father's probate estate. No, they could not share the same accounting. Each estate "stands on its own" and the administrator or executor of each estate must account seperately for the court and the beneficiaries.

I planned on getting all of this fixed as soon I was able to make the payments: only I got pulled over 2 weeks after getting my (minimum wage) job. I was wondering if the judge will be lenient on my case? Can I plead for community service instead of jail time? I really cannot lose this job because of jail-time, as we have to manage on a meagre $180 a week. This is a first offence, and there was no accident or damage or anything.
