I work 88 hrs and get paid as regular time, is that legal?
Answer
88 hours in what time period? California overtime law is as follows: Any nonexempt employee (depends on duties, etc.) who works over 8 hours in a company workday don't count meal period) OR over 40 hours in a company workweek is owed time and one-half. Any time worked over 12 hours in a workday is paid at double time. Any work in a seventh consecutive workday is paid at time and one-half for the first 8 hours and double time after that. If owed overtime, you can go back 3 years and sometimes 4 and you get 10% interest per annum plus your attorneys' fees.
