My husband and I are separated. I wish to move into our less expensive rental property. The property has tenants on a "month to month" basis. I sent a certified letter to them to let them know I was not renewing their lease. He has told them they don't have to move and offered them a 3 year lease. Do I have the right to move the renters out so I can live there?

If you both own the property, you both need to agree. If you cannot agree, than seek court intervention. Seek legal help.

No.either has authority to rent unless a judge rules otherwise. You are entitled to 50per cent of the rent.
