Question

My ex-husband is currently serving a five year sentence for possession and distribution of child pornography. When he is released, he will be required to federally register as a sex offender. I have gotten remarried and have full legal and physical custody of our two minor children. I would like to petition a court to terminate my ex-husband's parental rights. Do I have any legal standing to terminate his right? What would my current husband and I have to do to allow him to adopt our children?

Answer

Your questions require you to consult with a family law practitioner who is familiar with termination proceedings and whether you can institute them.
