I have a tenant who I am evicting from my house. He has received a Notice to Pay or Quit and and Eviction Form. He has responded by stating he is staying a month and a half longer, until June 15. And still he has paid no rent for 3 months.

My question is this: I want to sue him for unpaid rent, plus late charges and anything else I can legally charge him for. Are there specific forms for this? How long does the process take?



Answer

The cause of action you are looking for is a rent an dpossession action. You can sue for the back rent and interest, plus other damges described in yrou written lease. If the tenant is still there, you can also ask for possession of the premises.
