I work for a partnership in Southern California, and my bosses installed a fence last September for a man, who has since failed to pay us any amount of the price. We finally gave him a deadline of the 23 of this April. If he does not pay by then, what kind of legal action can we take to get our money? Can we remove his fence? or does this have to go to court? If so, what is the most fiscally economical way to do that?
Answer
I suppose your company is now limited to a lawsuit for breach of contract, and I hope they are properly licensed, or it may go nowhere. The partnership should understand that there is a set of laws providing for so-called mechanic's liens on contracts for the improvement of real estate, under which you can get a lien on the property. It's too late for that now.
