I have been issued a summons for falsely reporting a crime. The prosecution is threatening to charge my boyfriend with the crime I falsely reported unless I plead guilty and waive my right to trial by jury. Can they do this? Is it legal? It doesn't seem like they should be able to make any type of threats like this when they are interfering with my constitutional right to a trial by jury. Advice?
Answer
You have a right to trial by a jury. By the same token, the prosecutor may charge any offense where he/she believes there is probable cause to support the charge. Given the fact that they have filed an inconsistent charge, your boyfriend would appear to have a strong defense.
