Question

wage garnishment.

i live in california. a court from oregon sent a writ of garnishment to my payroll. i had a car repossessed a year ago. the car was bought in california. is this legal or did they file in the jurisdiction? my payroll department say they will honor this rquest immediately.

Answer

Re: wage garnishment.

Generally, a judgment creditor has the right to enforce an out of state judgment through a garnishment based upon the "full faith and credit" clause of the U.S. Constitution. There are specific California hoops to jump through [such as converting an out of state judgment into a California judgment], but it is legal.

Good luck.
