I have just signed for a Certified letter containing a Summons. The date on the Summons is June 18th. The date on the envelope shows it was mailed June 30th. I believe this 12 day gap represents a legal lapse at the very least. What can I do as i am now up against the 30 day filing date.
Answer
A summons needs to be served on the defendant within 60 days of the filing of the lawsuit. So the 12-day gap is not a legal lapse. Your 30-day period starts on the day you actually received the document, so save the envelope with the postmark as evidence that you were not served on June 18th but instead were served on July 1 or so.
