Question

I went to court today and when I asked for a continuance the D.A. jumped up and said I thought we were going forward with a plea agreement today....if we aren't then all offers are off the table and I will need the paperwork back (to my attorney). My question is whether or not this is grounds for me to request a new attorney as I didn't at any time tell my attorney that I would take the plea agreement and it seems that he told the D.A. that I would. This makes me uncomfortable as far as feeling he is looking out for my best interests. Can I request a different attorney because of this?



Answer

It depends on whether you have a public defender or a private attorney. If you have a private attorney you can fire him at any time. If you have a public defender - it is alot more difficult and they do not just switch attorneys without a large reason.

Eitherway, my suggestion is that you hire a new attorney. If he is trying to make you plea and you have never told him that - then you can already see where the case is going and he may not be fighting for you the way you need him too.
