Are we required by Illinois laws to have a homeowners association in our subdivision and are there any time frames for instituting one after houses begin being sold in that subdivision?



Answer

Normally homeowner associations ("HOA") are set up by the documents that create the subdivision, through recorded instruments. If that was not the case, there is no time frame but all owners would have to join in creating one -- this would not be a case of "majority rule".
