I have a demurrer filed on me as Plaintiff, The hearing date for the demurrer is tommorow. I have not responded to the demurrer by mail, can I file and serve the defendants my opposition to the demurrer on the hearing date ?
Answer
It is in the trial judge's discretion. Don't be surprised if he/ she tells you no.
Answer
E-mail the documents to the other side and the Court [if it allows e-mail filing; it probably will allow fax filings immediately. Call up to find out the tentative ruling and follow the directions for appearing at the hearing to oppose the Motion. If the Court does not allow your written opposition in, then you can make the same arguments orally.
