How do I know which chapter of bankruptcy to file and how do I do it?



Answer

Most people file a Chapter 7 if they want to get rid of debts. If people have fallen behind on home payments and need time to catch up, and/or eliminate a second mortgage or line of credit secured by the home, they often will file a Chapter 13. Repayment of a portion of the debt will occur monthly for three to five years.

How to do it? There are self-help books in bookstores and libraries, plenty of material on the internet, or find a lawyer who knows the ins and outs of bankruptcy. Some people are able to do it on their own if their bankruptcy is not complicated.
