My ex was declared a vexatious litigant in the California courts. She just filed a new lawsuit in the federal courts. The told me that I need to add something to the vexatious litigant filing to cover federal courts. She told me to consult a lawyer which I can no longer afford. Do you know how I would do this?
Answer
take a certified copy of the vexatious litigant order to the federal court clerk. I have not researched the issue, but it is unlikely that a state court can make an enforceable order preventing an individual filing a case in federal court. I would expect the federal court to make a vexatious litigant finding upon receiving the certified court order.
