Question

My husband has a child from a previous relationship. He pays his child support and is responsible for health ins. In the support order he is responsible for 50% of uninsured health care expenses. It also stipulates that the mother is ordered to submit to him all bills, receipts, forms and statements showing the uninsured portion within 30 days of her receiving them. To date she had never contacted us regarding this, however today she sent a stack of insurance bill copies dating from 2007 -2010 demanding payment. She also elected to have braces put on the child without contacting us and is demanding payment for those also. Are we still obligated by law to pay said expenses even though she failed to adhear to the child support order, the order says she has to submit the bills to him within 30 days

Answer

Does the order really say that or does it say that she has to submit them within 30 days in order to get payment quicker? There are lots of orders out there that have different language and they mean different things.

As to the braces, are orthodontic treatments included in the order? Does she have the exclusive right to consent to dental work?

As with all orders, the specific language is critical and you must read it carefully. If you don't understand something or think that there is a conflict, then see a qualified family law attorney for help.
